Each quote shall be in the form prescribed by, and shall contain a response to, each of the areas identified in the solicitation provision entitled “FAR provision 52.212-1 Addendum, Instructions to Offeror’s—Commercial Products and Commercial Services.” The Government reserves the right to make award solely on initial quotes received.

Exchanges with Best-Suited Contractor:

Once the Government determines the contractor that is best-suited (i.e. the apparent successful contractor), The Government reserves the right to communicate with only that contractor to address any remaining issues, if necessary, and finalize a Contract with that Contractor. These issues may include technical and price.

The Government considers it to be in its best interest to allow consideration of award to the lowest priced technically acceptable (LPTA) Quoter. For evaluation purposes, Quoters shall be listed in order of price from lowest to highest. The Government will award on a LPTA basis unless the ordering officer is aware of past performance information that indicates lower than Satisfactory Confidence. In that case, the Government reserves the right to consider the past performance of other offers, conduct a price, past performance tradeoff, and award to other than the lowest price offer. Quoters will be deemed technically acceptable based on the following:

TECHNICAL ACCEPTABILITY:

To be determined technically acceptable, an offeror must submit a proposal that provides delivery and pricing for all items listed in the RFQ and contract pricing worksheet. Only quotes that provide for delivery of all items (or acceptable substitutions as outlined below) listed in the RFQ/Contract Pricing Worksheet will be determined to be technically acceptable.

If any item(s) is/are determined by the vendor to be unavailable for delivery, an acceptable substitute* shall be quoted. A quote that does not provide for delivery of ALL line items, or acceptable substitutes, will be determined to be technically unacceptable and ineligible for award, UNLESS all vendors responding to the RFQ determine the same line item(s) to be unavailable for delivery. If all vendors responding to the RFQ determine the same line item(s) to be unavailable for delivery, and no acceptable substitutes are proposed, the line item(s) will be removed from each vendor’s quote and the Government’s price evaluation will proceed without the item(s).

* Acceptability of substituted items is at the discretion of the customer.

The Contracting Officer will use the following rating table:

Rating Description Acceptable Proposal provides pricing and delivery for all items listed in the RFQ and contract pricing worksheet, or acceptable substitutes if necessary, and therefore clearly meets the requirements of the solicitation.

Unacceptable Proposal does not provide pricing and delivery for all items listed in the RFQ and contract pricing worksheet, or acceptable substitutes, and therefore does not meet the requirements of the solicitation.

PRICE:

Price will be evaluated by totaling the prices for all line items listed in the RFQ and contract pricing worksheet.

If any line item(s) is/are removed due to unavailability and unacceptability of substitutes, the Government will confirm the newly calculated price with the lowest priced offeror. Note: if the lowest priced vendor chooses to increase/alter any other pricing contained in their quote, they assume the risk of no longer being the lowest priced offeror, in which case the Government will proceed to award with the new lowest price quote.

CONTRACTOR RESPONSIBILITY:

To be eligible for award, a quoter must be determined by the Contracting Officer to be a responsible prospective contractor under FAR 9.104. To be determined responsible, a quoter must:

(a) Have adequate financial resources to perform the contract, or the ability to obtain them;

(b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and Governmental business commitments;

(c) Have a satisfactory performance record;

(d) Have a satisfactory record of integrity and business ethics;

(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor an subcontractors);

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and

(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
