About this file
This document contains multiple Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) provisions related to telecommunications equipment and services representations. The provisions, dated November 2021 and December 2019, implement Section 889 of the John S. McCain National Defense Authorization Act and Section 1656 of the National Defense Authorization Act.
The key requirements prohibit federal agencies from procuring or using telecommunications equipment or services from certain vendors, specifically those using covered telecommunications equipment as a substantial or essential component of any system. Offerors must review the System for Award Management (SAM) for excluded parties and provide representations about their use of such equipment or services. The provisions mandate detailed disclosures if an offeror indicates they will provide or use covered telecommunications equipment, including information about the equipment's manufacturer, product details, proposed use, and potential permissibility under the prohibitions.
