About this file

This is a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process issued by the State of Utah Department of Health and Human Services (DHHS) Purchasing on behalf of the Division of Juvenile Justice and Youth Services (JJYS). The procurement seeks to contract with a single vendor to provide Talking Circle groups designed to help JJYS youth develop coping skills aligned with the stages of change model and improve their interpersonal relationships. The service must be provided within the State of Utah at JJYS facilities. The contract term is five years, running from April 2, 2026, through April 1, 2031, with renewal options contingent on budget availability. No specific response dates, site visits, or bidder conferences are identified in the notice.

The estimated contract value is $220,000 over the five-year period. The sole source justification is based on Elk River Foundation being the only identified contractor with five or more years of experience leading Talking Circle groups for juvenile populations while being authorized by a recognized indigenous peoples tribe to conduct the groups. The conducting procurement unit conducted online market research and consulted with purchasing and contract management to confirm the service's uniqueness and unavailability on existing state or agency cooperative contracts. The public notice period allows interested and qualified vendors to submit written challenges with documentation demonstrating competing sources or comparable services. Interested vendors should direct all inquiries to Jane Stecklein at DHHS Purchasing (385-303-3429 or dhhscontracts@utah.gov) rather than contacting JJYS directly.

Solicitation #: DHHS26069

Issuing Procurement Unit: DHHS Purchasing

Conducting Procurement Unit: JJYS

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Issuing Procurement Unit is publishing this Notice in accordance with the requirements of the Utah Procurement Code. The Conducting Procurement Unit submitted this form to DHHS Purchasing seeking to award a contract without competition if it is determined by DHHS Purchasing, in writing, that:

· there is only one source for the procurement item;

· transitional costs are a significant consideration in selecting a procurement item; or

· the award of a contract is under circumstances described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.

In the following pages the Conducting Procurement Unit has identified its justification for seeking to award a contract without engaging in a standard procurement process.

Determination of Other Interested Vendors The intent of this Notice is to determine if there are any other interested and qualified vendors that meet the specifications outlined this Notice. Any such vendors must submit the following information in writing to the Issuing Procurement Unit:

· the name of the contesting person; and

· a detailed explanation of the challenge, including documentation showing that there are other competing sources for the procurement item.

In addition, the vendor should submit:

· Documentation that the vendor can provide a comparable or better procurement item that meets or exceeds the specifications;

· If the need for a proprietary item is identified as the justification for this notice, documentation that the vendor can also provide the same proprietary procurement item or an equivalent procurement item;

· If transitional costs are identified as the justification for this notice, a cost comparison of the identified transitional costs with the vendor’s anticipated transitional costs.

Regardless of any prior communications with the Issuing Procurement Unit or the State, vendors interested in responding to this Notice must complete and submit a written response to this posting containing all of the information requested above. (No action is required if you agree with this Notice.)

DO NOT CONTACT THE CONDUCTING PROCUREMENT UNIT. All questions regarding this notice, including requests for additional information, shall be obtained through the Issuing Procurement Unit during the publication period.

If, after the public notice period has passed, the Issuing Procurement Unit determines that there are other interested and qualified vendors that meet the specifications of this Notice, the Issuing Procurement Unit will not award a contract pursuant to this notice.

If, after the public notice period has passed, no valid challenges have been received, then the Issuing Procurement Unit may award a contract to the identified vendor without competition.
