Contract Documents Summary
This is a comprehensive bid package and contract document set for a public works construction project issued by the City of Olathe, Kansas, in partnership with the Johnson County Community Action Roadsides (CARS) Program. The project involves improving Black Bob Road from 153rd Terrace to 159th Street, converting it from a 2-lane rural roadway to a 4-lane divided arterial section. Improvements include construction of a new single-span prestressed concrete bridge, new pavement, curb and gutter, medians, traffic signals, streetlights, sidewalks, storm sewers, water mains, and related infrastructure. The project is divided into three phases with specific milestone completion dates: Phase 1 (Mill and Overlay Project and Black Bob Road closure north of 157th Terrace) requires substantial completion within 183 days or by August 31, 2026; Phase 2 (Bridge crossing and intersections at 157th and 158th Terraces) requires completion within 425 days or by April 30, 2027; and Phase 3 (159th Street improvements) requires completion within 486 days or by June 30, 2027. Sealed electronic bids were due on February 9, 2026, with public opening to follow on the same date at https://olatheks.bonfirehub.com. The bid package includes detailed specifications, drawings (330 sheets), technical requirements, and a comprehensive schedule of values with approximately 222 line items covering excavation, paving, concrete work, utilities, landscaping, traffic control, and miscellaneous construction activities.
The contract is awarded to the lowest qualified, responsible bidder on a stipulated price basis with unit price adjustments for quantities varying more than 20 percent from estimated amounts. Contractors must submit a bid bond of 5 percent of total bid amount and provide a performance and maintenance bond equal to 100 percent of contract price, valid for two years after final payment. The City of Olathe retains 5 percent retainage on progress payments with 95 percent payment released until substantial completion, then 97 percent until final completion. Liquidated damages apply at $2,300 per day for milestone delays and $4,300 per day for substantial completion delays. Contractors must provide evidence of good standing from the Kansas Secretary of State, maintain specified insurance coverage with the City and Engineer named as additional insureds, and comply with labor and tax exemption requirements. An Owner's Contingency Allowance of $500,000 is included in the contract for unforeseen overages and change order work. Asphalt material prices are subject to monthly indexing adjustments based on the Kansas Department of Transportation Asphalt Price Index. All work must conform to the City of Olathe Technical Specifications and Design Criteria Manual and the Kansas Department of Transportation Standard Specifications, with construction limited to 8:00 a.m. to 5:00 p.m., Monday through Friday, unless approved otherwise.

NOTICE TO BIDDERS
Sealed bids will be received online at https://olatheks.bonfirehub.com, until 2:00 p.m. local time, on February 9, 2026, for the construction of Black Bob Road, 153rd Terrace to 159th Street, Improvements City Project No.
3-C-041-23 and CARS Project No. 320001523.
At said time and place, and promptly thereafter, all bids that have been duly received will be publicly opened online at https://olatheks.bonfirehub.com.
The work consists of the following:
This project will improve Black Bob Road from 153rd Terrace to 159th Street from a 2-lane rural roadway to a 4-lane divided arterial section. Improvements will include a new single-span prestressed concrete bridge, new pavement construction, curb and gutter, medians, traffic signal, streetlights, sidewalks, and storm sewers.
Bid documents including drawings and specifications are on file at the office of Public Works of Olathe, Kansas, and are open for public inspections. Bid documents and drawings may be downloaded free of charge from https://olatheks.bonfirehub.com. Only bids submitted electronically at https://olatheks.bonfirehub.com will be accepted.
This project was originally bid on April 15, 2025. The bid was subsequently pulled back due to previously unrealized vertical profile design requirements at the Black Foot Court intersection (for a separate project that extends west of this intersection). In this plan set, this resulted in the redesign of 159th Street, between Stations 288+75.66 and 299+03.26. The sheets impacted by these changes have been updated, and the bid tab has been updated accordingly.
An Owner’s Contingency Allowance determined by the City will be included within the Schedule of Values for this project.
A satisfactory bid bond executed by the bidder or an acceptable surety, in an amount equal to five percent (5%) of the total bid for work shall be submitted with each proposal. A scanned copy of the BID BOND must be included with the online bid submitted at https://olatheks.bonfirehub.com. The original copy of the BID BOND form must be submitted to the ENGINEER within 48 hours of bid opening. Failure to submit original copy of the bid bond will result in rejection of bid and OWNER’s selection of the next low qualified bidder.
The successful bidder will be required to furnish and pay satisfactory performance and payment bond or bonds.
The City of Olathe, Kansas, reserves the right to reject any or all bids or to waive any informality in the bidding.
Bids may be held by the City of Olathe, Kansas, for a period not to exceed sixty (60) days from the date of the opening of bids for the purpose of reviewing the bids and investigating the qualifications of bidders, prior to awarding the contract.

2. COPIES OF BIDDING DOCUMENTS
A. Complete sets of the Bidding Documents in the number and for the deposit sum, if any, stated in the Advertisement or Invitation may be obtained from ENGINEER via https://olatheks.bonfirehub.com.
B. Complete sets of Bidding Documents shall be used in preparing bids; neither OWNER nor ENGINEER assumes any responsibility for errors or misinterpretations resulting from the use of incomplete sets of Bidding Documents.
C. OWNER and ENGINEER in making copies of Bidding Documents available on the above terms do so only for the purpose of obtaining bids on the work and do not confer a license or grant for any other use.
3. QUALIFICATIONS OF BIDDERS
A. Contractor to provide a Certificate of Good Standing from the Kansas Secretary of State prior to the project award.
B. To demonstrate qualifications to perform the work, each BIDDER must be prepared to submit, within five (5) days of OWNER's request, a notarized "Statement of Bidder's Qualifications." A form for this purpose is included in this document. All information requested on the form must be provided. Each bid must contain evidence of BIDDER's qualification to do business in the state where the project is located or covenant to obtain such qualification prior to award of the contract.
4. EXAMINATION OF CONTRACT DOCUMENTS AND SITE
A. Before submitting a bid, each BIDDER must (a) examine the Contract Documents thoroughly, (b) visit the site to familiarize himself with local conditions that may in any manner affect cost, progress or performance of the work, (c) familiarize himself with federal, state and local laws, ordinances, rules and regulations that may in any manner affect cost, progress or performance of the work; and (d) study and carefully correlate BIDDER'S observations with the Contract Documents.
B. Reference may be made in the Supplementary Conditions for the identification of those reports of investigations and tests of subsurface and latent physical conditions at the site or otherwise affecting cost, progress, or performance of the work which have been relied upon by the ENGINEER used in preparing the drawings and specifications. OWNER will make copies of such reports available to any BIDDER requesting them. These reports are not guaranteed as to accuracy or completeness, nor are they part of the Contract Documents. Before submitting his bid each BIDDER will, at his own expense, make such additional investigations and tests as the BIDDER may deem necessary to
City of Olathe ITB-2 PN 3-C-041-23 determine his bid for performance of the work in accordance with the time, price and other terms and conditions of the Contract Documents.
C. On request, OWNER will provide each BIDDER access to the site to conduct such investigations and tests as each BIDDER deems necessary for submission of his bid.
D. The lands upon which the work is to be performed, rights-of-way for access thereto and other lands designated for use by CONTRACTOR in performing the work are identified in the Supplementary Conditions, General Requirements, or drawings.
E. The submission of a bid will constitute an incontrovertible representation by the BIDDER that he has complied with every requirement of this Article 4 and that the Contract Documents are sufficient in scope and detail to indicate and convey understanding of all terms and conditions for performance of the work.
5. INTERPRETATIONS
All questions about the meaning or intent of the Contract Documents shall be entered on line via
Bonfire. Replies will be issued by addenda via Bonfire to all parties recorded as having received the bidding documents. Questions received less than three (3) days prior to the date for opening of bids will not be answered. Only questions answered via Bonfire through an addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.
6. BID SECURITY
A. Bid Security shall be made payable to OWNER in an amount of five percent (5%) of the
BIDDER'S maximum bid price and in the form of a Bid Bond (on form attached, if a form is prescribed) issued by a Surety meeting the requirements of paragraph 6.01 of the General Conditions.
B. The Bid Security of the successful BIDDER will be retained until such BIDDER has executed the agreement and furnished the required Contract Security, whereupon it will be returned; if the successful BIDDER fails to execute and deliver the agreement and furnish the required Contract Security within ten (10) days of the Notice of Award, OWNER may annul the Notice of Award and the Bid Security of that BIDDER will be forfeited. The Bid Security of any BIDDER whom OWNER believes to have a reasonable chance of receiving the award may be retained by OWNER until the earlier of the seventh day after the "effective date of the agreement" (which term is defined in the General Conditions) by OWNER to CONTRACTOR and the required Contract Security is furnished on the sixty-first (61) day after the bid opening. Bid Security of other BIDDERS will be returned within sixty (60) days of the bid opening.
7. CONTRACT TIME
The number of days within which, or the date by which, the work is to be completed (the contract time) is set forth in the Bid Form and will be included in the Agreement.
City of Olathe ITB-3 PN 3-C-041-23
8. LIQUIDATED DAMAGES
Provisions for liquidated damages, if any, are set forth in the Agreement.
9. SUBSTITUTE MATERIAL AND EQUIPMENT
The contract, if awarded, will be on the basis of material and equipment described in the drawings or specified in the specifications without consideration of possible substitute or "or-equal" items. Whenever it is indicated in the drawings or specified in the specifications that a substitute or "or-equal" item of material or equipment may be furnished or used by CONTRACTOR if acceptable to ENGINEER, application for such acceptance will not be considered by ENGINEER until after the "effective date of the agreement." The procedure for submittal of any such application by CONTRACTOR and consideration by ENGINEER is set forth in paragraphs 7.04 and 7.05 of the General Conditions and paragraphs SC 7.04.A and SC 7.04.D of the Supplementary Conditions.
10. SUBCONTRACTORS, ETC.
A. If the Supplementary Conditions require the identity-identities of certain
SUBCONTRACTORS and other persons and organizations to be submitted to OWNER in advance of the Notice of Award, the apparent Successful BIDDER, and any other BIDDER so requested, will within thirty (30) days after the day of the bid opening submit to OWNER a list of all SUBCONTRACTORS and other persons and organizations (including those who are to furnish the principal items of material and equipment) proposed for those portions of the work as to which such identification is so required.
Such list shall be accompanied by an experience statement with pertinent information as to similar projects and other evidence of qualification for each such SUBCONTRACTOR, person and organization if requested by OWNER. If OWNER or ENGINEER, after due investigation-investigations, has reasonable objection to any proposed SUBCONTRACTOR, other person or organization, either may before giving the Notice of Award request the apparent Successful BIDDER to submit an acceptable substitute without an increase in bid price. If the apparent Successful BIDDER declines to make any such substitution, the contract shall not be awarded to such BIDDER, but his declining to make any such substitution will not constitute grounds for sacrificing his Bid Security. Any SUBCONTRACTOR, other person or organization so listed and to whom OWNER or ENGINEER does not make written objection prior to the giving of the Notice of Award will be deemed acceptable to OWNER and ENGINEER.
B. In contracts where the contract price is on the basis of cost-of-the-work plus a fee, the apparent Successful BIDDER, prior to the Notice of Award, shall identify in writing to OWNER those portions of the work that such BIDDER proposes to subcontract and after the Notice of Award may only subcontract other portions of the work with OWNER'S written consent.
C No CONTRACTOR shall be required to employ any SUBCONTRACTOR, other person, or organization against whom he has reasonable objection.
D As provided in Article 7 of the General Conditions, the CONTRACTOR may utilize the services of SUBCONTRACTORS on those parts of the Work which, under normal contracting practices, are performed by SUBCONTRACTORS; provided, however that the CONTRACTOR shall not award subcontracts which total more than 50% of the total Contract Price based upon the unit prices within the Bid submitted to the OWNER by the
