About this file

This is a Conformance Statements attachment for an On-Call Construction Management Services contract opportunity with an Arizona County. The document establishes the framework for responders to indicate their acceptance or exceptions to the County's Scope of Work, Terms and Conditions, and any supplemental agreements. Responders must clearly mark YES or NO regarding their compliance with the Scope of Work and Terms and Conditions. Those selecting NO must provide detailed exceptions by section and paragraph, including proposed alternate language and rationale for changes. All proposed changes to the Scope of Work must be submitted as tracked changes in the solicitation Attachment A, and any changes to contract terms must be tracked in solicitation Attachment C - Draft Contract. Responders may propose supplemental agreements, such as End User License Agreements or Lease Agreements, provided they do not conflict with or duplicate existing terms in the Scope of Work or Draft Contract.

The document emphasizes that any exceptions not included in the Conformance Statements will have no effect on the resulting contract unless specifically accepted in writing by the Procurement Officer. The County will not consider the responder's preprinted or standard terms as part of any resulting contract. Taking exceptions may negatively impact proposal evaluation, and proposals that take exception to any solicitation requirement may be subject to rejection. The contract number referenced is #262231SOQ, indicating this is a statement of qualifications-based procurement for on-call construction management services to be provided county-wide on an as-needed basis, with scopes potentially including design, specification review, and miscellaneous services.
