About this file
This is a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process submitted by the Utah Department of Transportation (UDOT) Procurement Division. UDOT seeks to procure AASHTOWare software licenses from the American Association of State Highway and Transportation Officials (AASHTO) to support the transportation agency's pavement and bridge management operations. The requested procurement includes Bridge Management Super Site Licenses, Bridge Management Services Units, Bridge Rating Unlimited Option, and Pavement ME Design Subscription Service (nine licenses). UDOT claims that AASHTO is the sole source for this proprietary software, which was developed specifically to meet state transportation agencies' engineering needs based on requirements submitted by member agencies. The software is not available through other vendors or resellers. No specific response date, due date, site visit, bidder's meeting, award date, or contract term renewal options are identified in the notice.
The total estimated cost for the procurement is $212,240, comprised of Bridge Management Super Site Licenses at $93,500, Bridge Management Services Units at $11,600, Bridge Rating Unlimited Option at $62,700, and Pavement ME Design Subscription Service at $44,440. UDOT has not identified transitional costs or special circumstances justifying the sole source award beyond the proprietary nature of the software. No incumbent vendor information, set-asides, or funding sources are specified in the documentation. The justification provided emphasizes that AASHTO, as a national association of state transportation officials, is the exclusive developer and provider of this software, and no personal, financial, or fiduciary relationships exist between UDOT personnel and AASHTOWare.
