About this file
This is a proprietary information disclosure form from the City of Arlington, Texas, Office of Procurement, applicable to the Annual Requirements Contract for Stormwater CCTV Services. The document establishes procedures for vendors to designate sensitive information as proprietary and restrict its public disclosure in compliance with the Texas Public Information Act. Vendors must identify proprietary pages by page number and clearly mark each page with the word "PROPRIETARY" in capital letters highlighted in yellow at the bottom center during submittal. The City will make reasonable efforts to protect marked information from disclosure, though the final determination regarding what must be released rests with the Texas Attorney General. Failure to properly mark proprietary information will result in unmarked sections being treated as non-proprietary and subject to public disclosure upon request.
All submitted materials become City property upon receipt and are presumed public unless properly designated otherwise. Notably, pricing information cannot be marked proprietary and will be made publicly available in a bid/proposal tab following review of all submittals. By submitting a response, vendors agree that pricing is not proprietary and may be released. The document includes a chart for vendors to list page numbers containing proprietary information and indicates whether only specific sections within pages qualify as proprietary rather than entire pages.
