About this file
This administrative code document from the City of Palm Bay establishes procedures for donating city-owned surplus single-family lots to a Community Housing Development Organization (CHDO) designated by the U.S. Department of Housing and Urban Development. The purpose is to facilitate the development of affordable single-family housing, with an annual review process involving the Community & Economic Development Director identifying potential surplus lots. The document outlines a comprehensive procedure where the CED Director reviews city-owned real estate, ensures the properties are not needed for future city use, prepares a list of potential surplus properties, and compiles detailed property data including market value and potential tax revenue.
The administrative code specifies a multi-step approval process involving the City Manager's review, preparation of an agenda memo for City Council consideration, and evaluation of the public purpose, property value, city costs, and potential revenue from home construction. Upon City Council approval, the CED Director will coordinate with the City Attorney's Office to draft a contract for sale or donation that includes specific provisions such as construction commencement timelines, performance expectations, affordability periods, and claw-back provisions in case of non-performance. The latest revision date is August 1, 2024, and the document replaces a previous administrative code (AC-72).
