RFO FAR 52.212-2 - EVALUATION - COMMERCIAL PRODUCTS AND COMMERCIAL

SERVICES (JAN 2026) (DEVIATION)

The Government intends to issue a firm-fixed-price purchase order to the responsible quoter submitting the lowest-priced quotation that is technically acceptable and conforms to every material term of the solicitation.

Technical acceptability and responsibility are pass/fail. Among technically acceptable, responsible quoters, price will determine selection. The Government may award based on initial quotations without discussions, but reserves the right to communicate with quoters, request clarification, or seek revised quotations consistent with simplified RFQ procedures.

B. TECHNICAL ACCEPTABILITY - PASS/FAIL

NO. FACTOR PASS STANDARD

1 Specification compliance Quotation and supporting literature demonstrate compliance with every salient characteristic for all six CLINs. Any proposed “or equal” item is fully identified and substantiated.

2 Sample timeliness and identification

All six samples are delivered on time by courier/cargo, properly labeled, and supported by acceptable carrier proof of delivery.

3 Sample conformance and quality

Samples conform to the stated materials, colors, construction, features, workmanship, and intended operational use. Samples are free from material defects and are commercially suitable.

4 Quantity, size, and delivery commitment

Quotation accepts all quantities and sizes and demonstrates ability to complete final delivery within the required period and at the stated destination.

5 Warranty Quotation provides at least the required 12-month warranty and accepts the repair/replacement obligations.

6 Terms and certifications Quotation takes no unacceptable exception to the solicitation and includes required representations, certifications, and disclosures.

A quotation must pass every technical factor. The Government is not required to permit correction of a material omission or technical deficiency after the deadline. Minor informalities may be handled at the Contracting Officer’s discretion consistent with the RFQ procedures.

C. PRICE EVALUATION

• The evaluated price is the grand total of all CLIN extended prices, inclusive of all costs required by the solicitation and exclusive of VAT.

• The Government will verify arithmetic and may correct an apparent clerical extension error when the intended unit price and quantity are clear, after confirmation with the quoter as appropriate.

• The Government will evaluate price reasonableness using competition, market research, historical prices, catalog/market data, or other appropriate techniques.

• The Government may reject a quotation that is materially unbalanced, contains omitted or nominal CLIN pricing, is unreasonably high or low, or presents unacceptable price risk.

• Prompt-payment discounts will not be used to determine the lowest evaluated price.

D. RESPONSIBILITY DETERMINATION - PASS/FAIL

Before award, the apparent successful quoter must be determined responsible under FAR 9.104-1. The Contracting Officer may use the quotation, SAM, responsibility databases, references, financial information, Solicitation for 19TU1526Q3790 Local Guard Force Battle Dress Uniforms, U.S. Embassy Ankara | Page 19 of 23 SENSITIVE BUT UNCLASSIFIED production capability, and other reliable sources. The quoter shall provide requested responsibility information promptly.

RESPONSIBILITY AREA PASS STANDARD

Financial resources Adequate resources or ability to obtain them.

Schedule capability Ability to meet the sample, production, and final delivery schedule considering existing commitments.

Performance record Satisfactory record of timely, conforming supply performance; lack of relevant history will not by itself be treated favorably or unfavorably.

Integrity and ethics Satisfactory record of integrity and business ethics.

Organization and controls Necessary organization, production controls, quality assurance, personnel, facilities, and supply sources.

Eligibility Otherwise qualified and eligible for award under applicable laws and regulations.

E. BASIS FOR AWARD

Award will be made to the lowest-priced technically acceptable, responsible quoter. If two or more acceptable quotations have the same evaluated price, the Contracting Officer will resolve the tie using a reasonable, documented method consistent with applicable law and the solicitation. The Government may reject any or all quotations, cancel the solicitation, or waive minor informalities when in the Government’s interest.

Legal effect of RFQ: A quotation is not an offer. The purchase order issued by the Government is the Government’s offer. A binding contract is formed when the supplier accepts the purchase order in writing or by substantial performance, consistent with RFO FAR 12.201-1(b).

SECTION 5 - OFFEROR REPRESENTATIONS AND CERTIFICATIONS

The quoter shall complete this section and submit all disclosures required by provisions incorporated by reference.
