CONTRACTUAL QUESTIONS
Question 1 - Two-phase advisory down-select process
Combined Synopsis, paragraph (iii); Attachment 4, L.5.4 and L.8
The Combined Synopsis states that this acquisition uses a two-phase advisory down-select process with a Phase One submission of concise technical information and a Rough Order of Magnitude (ROM) price. Attachment 4 contains no Phase One instructions, and L.8 establishes a single due date for complete Volume 1 and Volume 2 quotations.
(a) Please confirm whether a single complete submission is required by 16:00 CEST on
2 September 2026.
(b) If the two-phase process remains applicable, please issue an amendment stating the
Phase One content requirements, the ROM price format, the Phase One due date, the date of Government's advisory notification, and the Phase Two due date.
Answer 1 - Two-phase advisory down-select process:
(a) Confirmed. This solicitation does not employ a two-phase advisory down-select process. Paragraph (iii) of the Combined Synopsis/Solicitation states only that "Quoters shall submit one complete quotation in response to this solicitation, consisting of two physically separate volumes: Volume 1 - Price Quotation and Volume 2 - Technical
Quotation," which the Government will evaluate through "a comparative best-value evaluation of complete quotations." There is no reference in paragraph (iii), or elsewhere in the solicitation as issued, to a Phase One concise technical/ROM price submission, an advisory down-select, or a Phase Two submission. Section L.5.4 confirms the same single, two-volume submission structure (Volume 1 - Price
Quotation; Volume 2 - Technical Quotation), and Section L.8 establishes one quotation submission at 16:00 hours Central European Summer Time (CEST) on September 2, 2026 for both volumes (Volume 1 and Volume 2).
(b) No two-phase process is contemplated by this solicitation, and none will be implemented. The single-submission, comparative best-value evaluation process set forth in the Combined Synopsis, paragraph (iii), and Sections L.5.4, L.8, and M remain unchanged. Quoters shall submit one complete quotation, consisting of Volume 1
(Price Quotation) and Volume 2 (Technical Quotation), no later than 16:00 hours
Central European Summer Time (CEST) on September 2, 2026.

L.5.5.3.5(E).
(b) Yes. A separate sample Quality Assurance (QA) Report is required as part of the quotation submission under Volume 2, Tab E. The sample QA Report is separate from the Preliminary Quality Management Program (QMP) required under Section
L.5.5.3.5(E), Preliminary Quality Management Program. The sample QA Report shall demonstrate the Quoter's understanding and proposed approach to the QMP reporting requirements described in Section E.5.17.
The solicitation is amended to clarify Section L.5.5.3.5(E) submission requirements.
Please refer to the amended document 19GE5026Q0099-0001 – Attachment
4_Sections L through M.
Question 3. NCAGE code at quotation closing:
Attachment 3, K.1(d); Attachment 4, L.5.5.2(G)
(a) Subsection L.5.5.2 (G) requires proof of an active NCAGE code with the submission but also provides that a quoter not currently possessing a code shall initiate registration prior to award. Please confirm whether evidence of a submitted NCAGE application is acceptable at quotation closing, with the active code required before award, or whether an active code is mandatory at closing.
Answer 3 - NCAGE code at quotation closing:
(a) Subsection L.5.5.2 (G) is amended to clarify the NCAGE code requirement. Please refer to amended document “19GE5026Q0099-0001 – Attachment 4_Sections L through M” for the revised language. In accordance with the amended provision, a

Question 5. Acceptability of the institution issuing the required securities
Attachment 2, H.1.1; Attachment 4, L.5.3.1 and L.5.5.2(H)
(a) Please confirm whether Irrevocable Letters of Credit issued by a commercial bank licensed by the National Bank of Ethiopia, using the forms prescribed in Section J, are acceptable to the Government.
(b) Please confirm whether any confirmation, correspondent-bank, geographic location or credit-rating requirements apply to the issuing institution, so that the quotation-stage bank evidence can be arranged on the correct basis.
(c) Under FAR 28.204-3(g) and FAR 52.228-14(d)(1), an ILC is required to be issued or confirmed by a federally insured financial institution rated investment grade. Ethiopian commercial banks, acting independently, may not meet these requirements. If a Quoter is unable to obtain an ILC issued or confirmed in accordance with FAR 28.204-3(g), will the Government accept another permissible form of security under FAR Part 28?
(d) Will the Government accept the required performance and payment securities issued by an NBE-licensed Ethiopian commercial bank in Ethiopian Birr (ETB), calculated at the equivalent security value?
Answer 5 - Acceptability of the institution issuing the required securities:
(a) The Government cannot confirm that an ILCs issued solely by an Ethiopian commercial bank will be acceptable unless the issuing/confirming institution and the
ILC otherwise satisfy the requirements of Section H.1 of the solicitation and applicable
FAR provisions/clauses.
(b) The quotation-stage letter from the financial institution is required only to confirm that, in the event of award, the institution will provide the securities required under Section
H.1.1, totaling 40% of the Purchase Order amount. As stated in Section L.5.3.1, the letter serves solely as evidence of the Quoter’s ability to obtain the required ILCs or bonds, as applicable, and does not constitute the required performance or payment security. The actual ILCs or bonds provided after award must comply with the requirements of Section H.1 and the applicable FAR provisions/clauses. The actual
ILCs will be subject to review and approval by the Contracting Officer. Accordingly, the Quoter should ensure that the financial institution identified in its quotation-stage letter is able, in the event of award, to provide security that meets the requirements of
Section H.1.1.
(c) If the Quoter is unable to satisfy the requirements for an ILC issued or confirmed in accordance with FAR 28.204-3(g), the Quoter may consider other acceptable forms of security provided under FAR 28.204-2, or similar form of security that meets the requirements of FAR Part 28, as applicable.
(d) The required performance and payment securities shall be denominated in the same currency as the Quoter’s quotation. There is no requirement that the performance or payment security be denominated in U.S. dollars. Accordingly, if the Quoter submits its quotation in Ethiopian Birr (ETB), the required performance and payment securities may be provided in ETB.
Question 6. Progress payment for materials delivered but not installed
Attachment 2, G.4.2(a); Section I, FAR 52.232-5
Subsection G.4.2(a) provides for payment for labor and materials completed and in place, while FAR 52.232-5 addresses materials delivered to the site.
(a) Please confirm whether approved equipment and materials delivered to and securely stored at the project site, but not yet installed, are eligible for progress payment.
(b) If so, please identify the evidence the Government will require in support, including as to title, insurance, inspection, segregation and storage conditions.
Answer 6 - Progress payment for materials delivered but not installed:
(a) In accordance with Section G.4.2(a), progress payment requests shall cover the value of labor and materials completed and in place. Accordingly, materials and equipment delivered to and securely stored at the project site, but not yet installed or incorporated into the work, are not eligible for progress payment unless specifically authorized by the Contracting Officer in accordance with FAR 52.232-5.
(b) Any consideration of materials or equipment delivered to and stored at the project site for purposes of a progress payment is subject to the prior authorization of the
Contracting Officer and the requirements of FAR 52.232-5. The Contractor shall provide such supporting documentation and evidence as may be required by the
Contracting Officer to establish compliance with the contract requirements, including evidence of title, where applicable, and satisfactory conditions for identification, inspection, protection, and storage of the materials or equipment.
Question 7. Defense Base Act insurance and CLIN 0005
Attachment 2, B.7.1 to B.7.4; CLIN 0005
We are presently in the market for a tender-stage quotation for Defense Base Act coverage and are unable to close that price without the following confirmations.
(a) Please confirm whether the Government has designated a specific carrier, broker or
Defense Base Act insurance program through which coverage must be obtained, or whether the Contractor may place coverage with any carrier authorized by the U.S.
Department of Labor.
(b) Defense Base Act policies are commonly subject to payroll audit at expiry, and the carrier's minimum premium may exceed the rated premium. Please confirm whether
CLIN 0005 will be adjusted to the audited premium, or whether any amount above the figure quoted is absorbed within the firm-fixed price under clause B.7.3.
(c) Please confirm that the premium in respect of subcontractor employees at all tiers, as required by B.7.4, is to be carried within CLIN 0005 by the prime Contractor.
(d) Please confirm whether the U.S. Department of Labor has granted a waiver under section 1(a)(6) of the Defense Base Act in respect of Local Country Nationals, or Third
Country Nationals, engaged on Department of State contracts performed in Ethiopia.
If such a waiver is in effect, please provide a copy or identify it, as the waiver materially affects the remuneration base on which the insurance is rated and therefore the amount quoted at CLIN 0005.
Answer 7 - Defense Base Act insurance and CLIN 0005:
(a) The Government has not designated a specific carrier, broker, or DBA insurance program. Section B.7.2 states: "DBA Insurance may be obtained from any U.S.
Department of Labor (DOL) authorized DBA insurance broker. A list of DOL approved insurance brokers is available at http://www.dol.gov/owcp/dlhwc/lscarrier.htm. The Contractor may therefore place coverage with any carrier/broker authorized by the DOL; no single designated carrier is mandated.
As courtesy information only, and without endorsement or recommendation by the
Government, prospective quoters may wish to contact the following as one potential source for DBA insurance:
K2 Oconus Insurance Services, LLC
Kevin Pedone, Chief Growth Officer: kpedone@k2oconus.com
Quoters remain free to obtain DBA coverage from any DOL-authorized broker or carrier of their choosing; identification of this contact does not constitute a
Government preference, requirement, or endorsement.
(b) CLIN 0005 will not be adjusted based on the final audited premium, actual payroll, or any carrier minimum premium that exceeds the amount quoted by the Quoter. As stated http://www.dol.gov/owcp/dlhwc/lscarrier.htm mailto:kpedone@k2oconus.com in Section B.7.3, DBA insurance is included in the total evaluated firm-fixed price, and the Contractor will be reimbursed only to the extent the Contractor provides documentary proof that the DBA insurance has been paid and only to the extent quoted in CLIN 0005. Accordingly, any DBA insurance cost exceeding the amount quoted in
CLIN 0005 shall be the Contractor's responsibility and shall be absorbed within the firm-fixed price.
(c) Yes. The Quoter shall include in CLIN 0005 all DBA insurance costs associated with employees of subcontractors at all tiers that are required to maintain DBA coverage under Section B.7.4. The Contractor shall be responsible for ensuring that all subcontractors maintain the required DBA coverage and for maintaining documentation of such coverage. Reimbursement by the Government shall be limited to the amount quoted in CLIN 0005 and subject to the requirements of Section B.7.3.
(d) No. Ethiopia is currently not listed on the U.S. Department of Labor's Active DBA
Waiver List. Accordingly, no DBA waiver under Section 1(a)(6) is applicable to this solicitation for Host Country Nationals (HCNs) or Third Country Nationals (TCNs).
DBA insurance is therefore required for all employees and workers performing under this purchase order, including U.S. citizens, individuals hired in the United States, HCNs, and TCNs. Quoters shall include the applicable DBA insurance costs for all covered employees and workers in CLIN 0005.
TECHNICAL QUESTIONS
Question 8. Transformer or compact substation — option and scope of supply
J.2.1, IV.4(b); J.2.2, pages 20 and 27; J.2.4, 1.2.1; J.2.5 (no Section 262200); J.2.6, drawing 07-EX-006; J.2.8, item 262200.01
The Statement of Work, Bill of Quantities and power riser diagram require a new 800 kVA compact substation, while the assessment and design reports also identify use of the existing idle 1,250 kVA transformer as an alternative. No Section 262200 is included in the technical specification.
(a) Please confirm which option is to be priced.
(b) For the option selected, please provide the transformer or compact substation technical schedule, and define the division of responsibility between the Contractor and the
Ethiopian Electric Utility for the 15 kV connection, medium-voltage cable or overhead termination, ring main unit or HV switchgear, metering, protection, foundation and civil works, earthing, testing and utility approval.
Answer 8 - Transformer or compact substation — option and scope of supply
(a) Price the new 800 kVA compact substation as the base bid, in accordance with the amended electrical design, BOQ, and Drawing 07-EX-006 (new Section 262200). The
800 kVA unit is intended to serve the CDC office and the adjacent buildings included in the project distribution system. The existing idle 1,250 kVA transformer is not part of the base bid and is identified only as an alternative in the assessment/design reports.
Any decision to reuse the 1,250 kVA transformer would require separate written
Government direction.
(b) The Contractor shall provide and install the complete 800 kVA compact substation, including associated foundations/civil works, earthing, cabling, protection, testing, commissioning, and all required coordination and submittals for EEU approval. The minimum transformer requirements are 800 kVA, 15/0.38 kV, 50 Hz, Dyn11, with ±2
× 2.5% taps.
EEU shall be responsible for, or approving, the utility-owned 15 kV connection, utility metering, switching/energization, and any work required by EEU regulations to remain under utility control. The Contractor shall be responsible for all project-side work from the agreed utility demarcation point onward.
The exact MV termination, RMU/HV switchgear, metering, protection, and utility connection requirements shall be coordinated with EPHI and approved by EEU before procurement and installation. The SOW requires transformer data sheets and final commissioning to be subject to EEU approval.
Question 9. Generators — operating philosophy and synchronization
J.2.2, pages 19 and 27; J.2.4, 1.2.7; J.2.5 (no Section 263213); J.2.6, drawing 07-EX- 006; J.2.8, item 263213.02
The design report describes operating the two generating sets at alternating times, while the Bill of Quantities and riser diagram require synchronization through an 800 A panel.
At 380 V the stated maximum demand of 567.49 kVA corresponds to approximately 862
A, and the combined 775 kVA generator capacity to approximately 1,177 A.
(a) Please confirm the intended operating philosophy, that is whether parallel load sharing or duty/standby operation is required.
(b) Please confirm the repair scope required for each existing generating set, the modifications required to their controllers and to the existing automatic transfer arrangement, and the load-shedding sequence to be implemented.
(c) Please confirm the correct current rating and short-circuit rating of the synchronizer bus and its protection.
(d) Please provide the nameplate data and controller model and specifications for both existing generating sets.
Answer 9 - Generators — operating philosophy and synchronization
(a)The intended operating philosophy is parallel load sharing through the new synchronization panel. The existing 500 kVA and 275 kVA Cummins generators shall be synchronized and operated so that generator capacity is matched to the connected load. Under low-load conditions, the 275 kVA generator may operate independently;
as demand increases, the 500 kVA generator shall be brought online, and the two sets shall operate in parallel with automatic load sharing. The final start/stop thresholds, load-sharing sequence, protections, and controls shall be established in the Contractor’s approved synchronization shop drawings and commissioning plan.
(b) The 500 kVA generator is currently operational, while the 275 kVA generator is out of service due to maintenance issues and, or lack of spare parts. The exact condition and required repair scope for the 275 kVA unit shall be confirmed through on-site inspection and testing by the Contractor. The Contractor shall inspect and test both
Cummins generator sets, complete the necessary repairs to the 275 kVA unit, verify the condition of the new 500 kVA unit, and modify or upgrade the generator controllers as required for synchronization and parallel load sharing. Both generators shall be integrated with the new 1250 A, 3-pole ATS and synchronization panel specified in the drawings and BOQ. The Contractor shall also develop and submit the final operating sequence, synchronization logic, ATS interface, and load-shedding sequence for approval as deliverable submittal.
(c) The generator feeder ratings shown on the riser diagram—approximately 800 A for the 500 kVA generator and 500 A for the 275 kVA generator—are acceptable for the individual generator connections. However, the 800 A synchronization-panel bus rating is insufficient for the combined generator capacity and shall be revised to not less than 1,250 A. The synchronizer bus and its incoming/outgoing protective devices shall be sized for the combined generator load and coordinated with the new
1,250 A, 3-pole ATS. The final short-circuit withstand/interrupting rating shall be based on the approved short-circuit and coordination study and shall not be less than the calculated available fault current at the synchronization bus.
(d) The available information identifies both existing units as Cummins generators:
• 500 kVA generator: Cummins silent-type diesel generator, 3-phase, 400 V, 50
Hz, 500 kVA prime / 550 kVA standby, engine model QSZ13-G2, alternator
WP354D, with built-in ATS and approximately 1,200 L fuel tank.
• 275 kVA generator: Existing Cummins generator, identified in the available equipment information as C330/C300SD5.
• The complete nameplate data, engine/alternator details, and controller model/specifications shall be confirmed from the unit on site.
The Contractor shall field-verify and submit the complete nameplate and controller data for both generators, including model and serial numbers, rated kVA/kW, voltage, current, frequency, power factor, engine and alternator models, controller manufacturer/model, governor/AVR details, and communication capability, before finalizing the synchronization-system design.
Question 10. Recommendation — replacement of the 275 kVA generating set
J.2.2, page 19; J.2.4, 1.2.7; J.2.6, drawing 07-EX-006; J.2.8, item 263213.02;
Attachment 4, L.5.5.2(C)
Universal Construction PLC has inspected the existing 275 kVA generating set. We confirm that the set is not in working condition, that its control unit is not a Cummins-compatible controller but a generic unit, and that it does not natively support the isochronous load sharing required for parallel operation. Synchronization therefore cannot be achieved by the addition of a synchronizing panel alone. Following consultation with the engineers of Cummins-authorized suppliers, we recommend that the Government consider replacing the set in its entirety with a new, genuine Cummins 500 kVA set matched to the existing 500 kVA unit, providing a manufacturer-supported paralleling scheme, full redundancy at the stated maximum demand, and a materially longer service life for a facility requiring uninterrupted supply.
(a) Please advise whether the Government wishes this option to be considered.
(b) We intend to price the base scope exactly as issued so that our quotation remains fully responsive and, unless the Government directs otherwise, to carry the replacement as a clearly and separately identified priced option forming no part of our base price. Please confirm that a separately identified option of this kind is acceptable and will not prejudice the evaluation of our base quotation and advise whether it should be placed as an annex to the Price Quotation or as a separate line beneath the CLIN schedule.
(c) If the existing set is replaced, please confirm the disposal or hand back arrangement for the set removed, and whether any residual value is to be credited to the Government.
Answer 10 - Recommendation — replacement of the 275 kVA generating set
(a) Continue in accordance with the issued Scope of Work. The base requirement is to retain the existing 500 kVA and 275 kVA generators, correct the identified deficiencies, and provide the required synchronization arrangement. Replacement of the 275 kVA generator is not part of the base scope unless formally directed by the
Contracting Officer/RPSO.
(b) The quotation shall be based on the issued Scope of Work and BOQ. The proposed replacement of the 275 kVA generator shall not be included in the base price unless specifically requested by the Contracting Officer/RPSO. Any separately priced alternative may be considered only if authorized by the solicitation instructions or subsequently requested by the Government.
(c) If replacement is later authorized, the removed 275 kVA generator shall remain
Government property and be handed over to the designated CDC-Ethiopia representative in accordance with the project handover requirements. The Contractor shall not dispose of the generator or apply any residual/salvage value credit unless specifically directed in writing by the Government.
Question 11. System voltage, altitude and derating basis
J.2.4, 1.2.3; J.2.5, Sections 262416 (1.6), 265119 and 265219; J.2.6, drawings 07-EX- 003, 005 and 006
The technical documents variously use 380/220 V, 400/220 V, 400/230 V, 220 V and 240
V. Section 262416 states an altitude assumption not exceeding 750 meters, whereas the
EPHI compound is at approximately 2,355 meters above sea level.
(a) Please confirm the governing nominal low-voltage system voltage and frequency, together with the allowable input and output voltage ranges.
(b) Please confirm the design altitude and ambient conditions to be applied, and confirm that all transformers, stabilizers, transfer switch, synchronizer, generator, cable and panel ratings are to be stated after the required altitude and temperature derating.
Answer 11 - System voltage, altitude and derating basis
(a) The governing nominal low-voltage system voltage shall be 380/220 V, 3-phase, 4-wire, 50 Hz. References to other utilization voltages shall be coordinated with this system voltage. The altitude stated in Section 262416 as 750 m is a typographical error and has been corrected to the project site altitude of approximately 2,530 m above sea level. Refer to the amended J.2.5, Section 262416 for the revised project altitude and require applicable equipment derating.
(b) The electrical design and equipment selection is based on a site altitude of approximately 2,530 m above sea level. All transformers, stabilizers, ATS, synchronization equipment, generators, cables, breakers, and panelboards shall be suitable for the actual site altitude and ambient conditions and shall be derated as required by the respective equipment manufacturers. The final submitted equipment ratings shall reflect the applicable altitude and temperature derating.
Question 12. Short-circuit withstand and protection coordination
J.2.4, SKM Fault Analysis Summary; J.2.5, Sections 262416 (2.1) and 263600 (2.1);
J.2.6, drawing 07-EX-005; J.2.8, transfer switch and stabilizer items
The SKM analysis gives an available three-phase fault current of 62.827 kA at B. CMDB.
Drawing 07-EX-005 assigns the CMDB an AIC rating of 36 kA, and the Bill of Quantities specifies a 35-kA short-time withstand rating for the automatic transfer switch and 25 kA moulded case circuit breakers in the stabilizer bypass.
(a) Please issue the final short-circuit and protection coordination basis, together with the minimum SCCR, AIC, Icw, Icu and Ics ratings required for the transformer low-voltage assembly, stabilizer and bypass, transfer switch, synchronizer, CMDB and associated breakers.
(b) Please confirm whether the low-voltage assemblies are to be fully rated or series rated for the confirmed fault level.
(c) The riser diagram shows the CMDB with a 1,250 A busbar and a 1,600 A main device, and the MDB with an 800 A busbar and a 1,000 A main device. Please confirm the intended busbar and main device ratings for each board, and the basis on which the busbar is protected.
Answer 12 - Short-circuit withstand and protection coordination
(a) The short-circuit and protection-coordination requirements will be updated and issued by amendment, including the required SCCR, AIC, Icw, Icu, and Ics ratings for the affected equipment. CMDB AIC rating is 50 kA and the AVS also with 50 kA. It is amended on the riser diagram and BOQ.
(b) The low-voltage assemblies shall be based on a series-rated assembly/system. The final series-rated combinations shall be coordinated and supported by the applicable manufacturer’s tested/listed data and the approved protection-coordination study.
(c) No, the ratings per the drawing are the reverse of those stated in the question. The
CMDB shall have a 1,600 A busbar with a 1,250 A main breaker, and the MDB shall have a 1,000 A busbar with an 800 A main breaker. The busbar rating per the standard practice shall be equal to or greater than the continuous current rating of the associated main protective device.
Question 13. Earthing system, neutral topology and transfer switch configuration
J.2.4, 1.2.3 and 1.2.4; J.2.5, Sections 260526 and 263600 (2.1); J.2.6, drawing 07-EX- 006; J.2.1, III(j) to (l)
The design adopts a TN-S system, while the riser diagram and Bill of Quantities identify a
1,250 A three-pole automatic transfer switch and Section 263600 requires a fully rated neutral terminal.
(a) Please confirm whether the transfer switch is to be three-pole with a solid neutral or four-pole with a switched neutral.
(b) Please identify the neutral-to-earth bonding point or points at the transformer and at each generating set, define the separately derived system and ground fault protection arrangement, and issue a coordinated one-line diagram showing the complete neutral and protective earth topology.
(c) Please confirm whether open-transition or closed-transition switching is required, having regard to the life-safety and laboratory loads served and to the requirement that the facility remain in operation throughout the works.
Answer 13 - Earthing system, neutral topology and transfer switch configuration
(a) The transfer switch shall be 3-pole with a solid, unswitched, half rated neutral. Refer
BOQ identifies a 1,250 A, 3-pole ATS, and Section 263600.
(b) The distribution system shall remain TN-S, as indicated on the riser diagram Refer
