Q&A - - Questions and Answers

Question #001: AppleCare: Do you require AppleCare protection to be included with the iPhones?

Answer #001: No, extra protection is not included in the specifications of this requirement.

Question #002: Version Specification: You've specified a model of the iPhone 16 Pro that is not available in either the US or Saudi Arabia. This version includes a physical SIM card slot, whereas the local versions here are eSIM-only. Was this choice intentional, or would the US eSIM-only version be acceptable for your needs?

Answer #002: The government is requesting a European version exactly how described in the solicitation’s specifications.

Question #003: Customs Documentation: Aside from the commercial invoice and packing list, are there any additional documents required for Saudi customs clearance?

Answer #003: An airway bill will be required in advance, if it is intended to ship via air. All delivery cost should be included in CLIN 0003. No other additional documents are required.

Question #004: VAT & Duties: Are there any specific VAT or duty exemptions for shipments to the U.S. Embassy in Riyadh?

Answer #004: VAT is a local cost and only applicable to those contractors who are registered in Zakat and supporting tax authorities. The contractor will be reimbursed for VAT only to the extent that the contractor provides documentary proof that VAT has been paid to the host government, and only up to the amount quoted for CLIN 0002.

Question #005: Partial Shipments: If there are unforeseen delays, will partial shipments be accepted, or must all 125 units be delivered at once?

Answer #005: No partial shipments are authorized under this solicitation.

Question #006: Vendor Sanctions Letter: Is there a required format for the letter of guarantee certifying that the vendor is not subject to sanctions under Saudi law?

Answer #006: The Embassy Riyadh Customs & Shipping Office will prepare a custom exemption letter through the Saudi Ministry of Foreign Affairs. The awarded offeror will be required to follow the Shipping Instructions attached and air freight the shipment to the King Khalid International Airport, Riyadh. The vendor must provide a copy of the Air Waybill in advance of shipment by email to ZamoranoD@ptc-atc.org. Embassy Riyadh will arrange for release of the shipment from Saudi Customs and delivery to the end-user.

Question #007: Labeling Requirements: Aside from marking the purchase order number, are there any additional labeling or packaging instructions to follow?

Answer #007: No additional labeling is required.

Question #008: Customs Assistance: In case of customs delays, will the U.S. Embassy in Riyadh assist in facilitating clearance?

Answer #008: GSO Shipping will assist the awardee in facilitating clearance.

Question #009: Technical Compliance Checkpoints: What specific criteria will be evaluated to determine technical compliance before final acceptance of the products?

Answer #009: The technical evaluation team will evaluate technical compliance based on provided technical supporting documents by the offeror and inspect the products delivered. FAR 52.212-4 (a) refers.

Question #010: Inspection Upon Delivery: Will an onsite inspection be conducted by U.S. Embassy staff upon delivery, and if so, what will this entail?

Answer #010: Yes, the delivered items will be inspected on compliance with the specifications in the solicitation document.

Only new items are authorized, no grey market or refurbished products. All items must be in original packaging, never used, and not altered in any way. FAR 52.212-4 (a) refers. The Government may require repair or replacement of nonconforming supplies at no increase in contract price.

Question #011: Warranty & Replacements: In the event defects are identified, what is the required timeline for replacement or refund under the 24-month manufacturer warranty?

Answer #011: In the event of a defect has been identified the contractor will be given two months to replace the defected item.

Question #012: Manuals & Literature: The solicitation requires manuals and literature in both Arabic and English. Are there specific formatting or translation requirements we need to follow?

Answer #012: There are no special or additional formatting or translation requirements needed.

Question #013: Plug Type Compliance: The solicitation mentions both European (Type C) and UK plug chargers. Should both plug types be included in every unit, or will a single plug type suffice?

Answer #013: USB (Type C) may be included in every unit. That is sufficient. As provided by the manufacturer, there should be a USB-C cable included inside the Apple iPhone 16 box. This is sufficient for the government’s needs. A UK power plug is no longer needed as these are not included as accessories within the product box.

Question #014: We would like to ask if we can also provide a version that is international and is also working in Riyadh as a guarantee? For sure we are referring to the original, brand new and sealed with manufacturer warranty Answer #014: Based on the government’s latest research model A3293 and A3292 are both sufficient.

Question #015: The solicitation specifies the Apple iPhone Pro 16, version A3293. I would like to inquire whether an alternative model, A3292, may be considered as a substitute, given its broader network compatibility. A3292 provides expanded LTE and 5G band compatibility while maintaining all functionalities of A3293. Would this alternative model be considered an acceptable equivalent under the solicitation’s Lowest-Priced, Technically Acceptable (LPTA) criteria?

Answer #015: Model A3292 or A3293 will work for the government’s current needs. The physical SIM slots are the primary requirement for the use in the Kingdom.

Question #016: We want to bring to your attention an issue regarding the availability of the iPhone 16 Pro model SKU MYNK3QN/ A you requested. This particular SKU is intended for the UK market, which, as you know, is outside the European Union. Importing this model into the EU could lead to additional customs duties and associated costs, which may impact the overall pricing and delivery timeline.

As an alternative, we can offer the MYNK3HX/A model, which is specifically designed for the European market (A3293). Could you please confirm if this alternative model is acceptable to you?

Answer #016: MYNK3HX/A (A3293) model is acceptable, since the physical SIM slot is exactly what the government is requesting.

Question #017: Regarding warranty requirements, AppleCare+ (required a 2-year guarantee) is only available in selected EU countries, including France, Italy, and Spain, as well as the UK. Unfortunately, AppleCare+ is not available in Poland, which may impact extended coverage options. However, if You already utilize AppleCare for Enterprise (ACE), we could explore extending the warranty through this program. Please note that ACE requires a minimum purchase volume of 200 units, so this option would only be viable if your organization already has an active AppleCare for Enterprise subscription.

Answer #017: No AppleCare+ is required and is also not part of the solicitation.

Question #018: In reference to the subject solicitation, we are planning to ship the phones from our U.S. office. To ensure a competitive proposal, we would like to confirm whether the embassy can provide the AK-302 / duty exemption letter upon submission of all original shipping documents.

Answer #018: The awarded vendor must arrange for air freight shipment per the attached shipping instructions from the point of origin to the designated port in Riyadh. See answer for question #006.

Question #019: Does the US government have a tax exemption for this type of order so that we can set the correct price for this product and make the offer?

Answer #019: There is no tax exemption for this requirement. See answer for question #004.

Question #020: Local/Middle east version, is that acceptable?

Answer #020: No. The specified model in the solicitation is the only acceptable model type.

Question #021: What is the required delivery timeline?

Answer #021: Delivery shall be made F.O.B. Destination as soon as possible but not later than sixty (60) days from the date of contract award.

Question #022: Are there specific shipping instructions or restrictions for delivery to Riyadh, Saudi Arabia?

Answer #022: The awardee will be provided with shipping instruction within the award package which will contain all necessary information and POC’s for delivery.

Question #023: Will customs clearance be handled by the U.S. Embassy, or is that the responsibility of the supplier?

Answer #023: It is the responsibility of the supplier to handle custom clearance procedures. The U.S Embassy will provide documentation if needed.

Question #024: Are there any brand authorization requirements (e.g., must we be an Apple-authorized reseller)?

Answer #024: No authorized reseller certification is requested by the solicitation document.

Question #025: What are the payment terms and conditions for this contract?

Answer #025: Payment will be made via Electronic Fund Transfer (EFT) in accordance with Federal Acquisition Regulation FAR32.9 “Prompt Payment”.

Question #026: Are there any specific invoicing requirements or electronic payment systems that need to be used?

Answer #026: No special system needs to be used by the awardee. Please see answer to question #025.
