QUESTIONS & ANSWERS (Q&A)

1.

(Q) Who is responsible for paying the DBA insurance: the offeror or the subcontractor?

Alternatively, can the offeror pay the DBA insurance for the subcontractor’s employees?

(A) It is the responsibility of the prime contractor to ensure that all personnel working on the contract have DBA insurance.

(Q) Is it acceptable, if the subcontractor pays the DBA insurance for their employees and then share the document with the offeror, who in turn shares it with the Government? In this case, the DBA insurance document would be under the subcontractor's company name. Would this be acceptable to the government?

(A) The prime contractor is responsible to provide and submit proof to the contracting office that all employees are covered by a DBA insurance regardless if the person is employed by the main contractor or the subcontractor.

The prime contractor is responsible to ensure all subcontracted employees are properly insured as per contract requirements.

(Q) We would like to understand the reimbursement process for DBA insurance

(A) Please refer to the solicitation: Section 1, sub-section III, paragraph D. Defense Base Act

(DBA) Insurance:

The Contractor will be reimbursed for DBA only to the extent the contractor provides documentary proof that DBA has been paid and only to the extent quoted in the Pricing

Schedule.

DBA insurance cost will be evaluated as part of the total evaluated price and included in the price of the contract. Where DBA is applicable, the Contractor will be required to provide evidence of insurance (certification of coverage and a paid invoice) within 15 calendar days from the date of award.

Saudi Arabia is currently not included on the DOL’s active waiver list, therefore DBA insurance is required for all employees performing work on this contract through the period of one base year and four option year periods (if exercised).
