PRICES, BLOCK 23
A. GENERAL
A.1 The U.S. Embassy in Brussels, Belgium, requires mobile telephone and data services for the U.S. Mission to Belgium. This includes services for the U.S. Embassy to Belgium, the U.S. Mission to the European Union, the U.S. Mission to NATO, the Customs and Border Protection office in Antwerp, the European Logistics Support Office in Antwerp, and any other agencies officially recognized as part of the Tri-Mission Brussels. The Contractor shall deliver these services in compliance with the specifications outlined in the Statement of Work (SOW).
A.2 This is a firm-fixed price Indefinite-Delivery Indefinite-Quantity (IDIQ) contract. The firm-fixed price shall include all labor, materials, equipment, overhead, profit, insurance (see FAR 52.228-4 and 52.228-5), and transportation necessary to deliver the required services. No additional sums will be payable on account of any escalation in the cost of transportation, general liability insurance or labor, or because of the Contractor's failure to properly estimate or accurately predict the cost, or difficulty in achieving the results required by this contract. The contract price will not be adjusted because of fluctuations in currency exchange rates.
Changes in the contract price, or time to complete, will be made only for changes made by the Government in the work to be performed, or by delays caused by the Government. Any costs not priced will be considered to be included in the overhead and other indirect costs.
A.3 This is an IDIQ type of contract against which task orders may be placed. The quantities set forth in the pricing section are estimates; the Government does not guarantee that such quantities will be ordered. The contract will be for a one-year period from the date of the Notice to Proceed (NTP), with four (4) one-year options. The performance period is set to commence on December 1, 2024.
A.4 The general liability policy required of the Contractor shall name “the United States of America” as additional insured. The general liability insurance shall be as required by law or as ordinarily obtained in the location of the work. The limit of such insurance shall be as provided by law or sufficient to meet normal and customary claims. The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to Government’s property in Contractor’s custody, any property of the Contractor, its officers, agents, servants, and employees, or any other person, arising from, and incident to, the Contractor's performance of the work detailed herein. The Contractor shall hold harmless and indemnify the Government from any and all claims arising therefrom, except in the instance of gross negligence on the part of the Government. The Contractor shall submit evidence of general liability insurance within 15 calendar days after award.
A.5 Minimum and Maximum Amounts: During life of this contract, the Government shall place orders totaling a minimum of $500.00 or local currency equivalent. This reflects the contract minimum for this period of performance. The amount of all orders shall not exceed $2,500,000.00 or local currency equivalent, which reflects the contract maximum.
B. PRICING
B.1 The currency shall be fixed and cannot be changed by modification to the contract.

Additionally, the Contractor shall ensure access to 3G, 4G, and 5G (when available) mobile networks within the EU, EES, and UK, and provide the capability to share data across multiple devices from a single account.
The Contractor shall ensure that the connection through its network is of the highest quality possible and shall be uninterrupted, clear, and with no static. Network problems shall be remedied immediately, and the COR must be immediately informed of any problems and their resolution.

A list of all U.S. Government Facilities will be furnished to the Contractor upon request.
C.9 OVERAGE NOTIFICATIONS
In accordance with U.S. procurement law, strict penalties are imposed on embassy personnel who create unauthorized commitments of U.S. Government funds. To mitigate this risk, the Contracting Officer’s Representative (COR) assigned to this contract must have timely access to data to control and prevent overage fees or other unauthorized costs.
The Contracting Officer and their designated Representative shall be the sole individuals authorized by the Contractor to request the activation or deactivation of any services rendered under this contract. Similarly, only these individuals may request the addition or removal of features that incur costs, such as adjustments to a user’s base tariff, modifications to monthly service commitments, or the activation and deactivation of roaming services.
Should an embassy employee utilize services under this contract resulting in potential unauthorized costs, the Contractor is required to provide prompt notification to both the employee and the COR(s). The notice must be clear enough to help the employee minimize the risk of their actions and assist the COR in quickly identifying the employee and/or devices that triggered the report.
The Contractor must provide at least one example of such notifications, demonstrating how they would be received by both the end-user and the COR.
Additionally, the Contractor shall issue a clear notification to both the cellular services end-user and the COR before any overage fees are incurred.
Example Scenario 1: If an embassy-issued iPhone user is allotted 60 minutes of free call time to the U.S., they should receive an alert via SMS or another method both before and after exceeding that amount. A simultaneous notification should also be sent to the Embassy’s COR overseeing this contract.
Example Scenario 2: For a data-only SIM used in an Internet of Things (IoT) device with a 25GB data limit, notifications should be sent before and after exceeding the allotted data. In cases where the device cannot receive or properly interpret SMS messages, the Contractor must ensure that notifications are sent concurrently to the Embassy’s COR.
The Contractor must also provide clear warnings to both the end-user and the COR if a cellular device is used with roaming enabled and the following occur:
• Roaming fees begin to accrue;
• Roaming fees are approaching a specified limit (e.g., the typical $50.00 cut-off); or
• Roaming fees exceed that limit.
Example Scenario: If a user with an embassy-issued SIM in their iPhone travels to the United States and neglects to select a data roaming package, the Contractor must ensure that proper notifications are sent accordingly.
