The RFP states, “one or more of the items under this acquisition is subject to the World Trade

Organization Government

Procurement Agreement and Free

Trade Agreements.” Please confirm which items are subject to these agreements as Georgia is not listed in FAR 52.225-5 Trade

Agreements.

It is FAR 25 rather than the cited clause or country, which should be used to determine applicability of WTO GPA, designated country end products or designated country services.

All services under this solicitation are subject to WTO

GPA.

Synopsis/Solicitation Contract Type 2

The RFP states, “the Firm-Fixed part of the contract shall include all labor…Defense Base Act

(DBA) insurance…”, however the

RFP provides for a separate CLIN.

Please confirm DBA insurance is to be priced outside of the Fixed

Price for this effort.

While DBA insurance is reimbursable, and must be priced on a separate CLIN, its reimbursement shall not exceed the firm-fixed DBA insurance price proposed by the offeror.

The DBA insurance is therefore part of the firm-fixed contract price. Only CLIN 0009, Travel

Cost, is outside the firm-fixed-price arrangement and will be determined during contract performance.

The last paragraph of this clause refences DBA under CLIN 0008, however it is reflected as CLIN

0010 on page 9. Please confirm which CLIN number is accurate.

52.225-5, Trade Agreements, however Georgia is not listed in this clause. Request removal of this clause from the RFP.

The Contracting Officer has determined that this solicitation is subject to WTO GPA. See also FAR 25.403 (c) for information on purchase restrictions. This clause will not be removed from the solicitation.

Synopsis/Solicitation Basis for Award 13

This paragraph states that award will be made to the offeror whose award “conforms to the solicitation and is determined to be the most advantageous solution to the

Government, price and other factors considered”. However, page 2 of the RFP denotes that evaluation of offers will be based on LTPA. Under LPTA, proposals are only evaluated to determine if they are technically acceptable not on the basis of the best solution and then awarded to the lowest priced offer. Please confirm if this effort will be awarded on a best-value/trade-off or LPTA basis.

For this solicitation, the most

“advantageous solution to the

Government” is represented by the “best value to the

Government”, which the

Contracting Officer expects to result from selection of the technically acceptable proposal with the lowest evaluated price

(LPTA). The solicitation is not using trade-off: see the provision at FAR 52.212-2 (a) where Price is just as important as Technical

Capability.

Will the Government please provide the name of the private contractor who provided the training of the units and instructors course in 2010, 2013, 2015 and

2018?

Previous training was provided by The Densus Group, LLC.

Yes.

Will the Government provide the previous training materials to the awardee upon contract award?

No, these are proprietary materials and the GOG was not given the training materials; only the student notebooks, which are in possession of the students.

The SOW denotes that all training must occur by 8/1/2020. With

RFP responses due 5/27/20, materials to be translated/printed provided to the Embassy 6 weeks prior to training date and the need to get the training/personnel in place, is it feasible to have the training completed by 8/1/20.

Please confirm that the training must be completed by 8/1/20.

This is an oversight and will be corrected to reflect the new completion date of September 1, 2020.

Recruitment of

This paragraph advises that

Offerors are to determine the number of trainers necessary to implement the project. As this effort is LTPA, it is Offeror’s belief that the number of trainers shall be provided by the

Government so all Offerors can price the same number of trainers.

Please advise the number of trainers to support this effort. If the Government is unable to do that, request effort be awarded based on a best value basis in lieu of LPTA.

The solicitation is calling for proposals that address the stated needs. Since offerors may have different approaches to developing the curriculum and delivering the expected results, the determination of adequate number of trainers to deliver offeror’s curriculum and expected results is assigned to the offeror. The LPTA approach will look at technically acceptable proposals and award on the lowest evaluated price amongst them.

This paragraph states “Currently, less than 20 instructors from the

2015 class remain at Special

Tasks; while none of the leadership of the unit have attended or witnessed a class.”

How many of the “Instructors” will take part in the re-training course?

And, will they be available as

“Instructors/Trainers” during the practical drills/exercise or taking part in the practical drills/exercise?

The 20 instructors that remain will be available to assist;

however, the intent is to provide the GOG with a cadre of 45 instructors (20 retrained and 25 new).

Question: Will the USG provide a copy of the previous training curriculum or at least a high level overview of the courses/instruction now, so

Offerors can review and ensure the proposed curriculum and necessary curriculum development is consistent with the previously conducted training?

Previous training material will not be provided. The contractor is required to coordinate with the COR. The

COR and his/her team will be around to resolve any issues of tactics and institutional doctrine.

The SOW states “Evaluating the current inventory of less lethal options available to the Ministry of Internal Affairs for crowd management response.”

Question: Can the USG provide a copy of the currently inventory of less lethal options now?

The inventory consists of:

Will the USG adjust the qualifications of trainers with respect to the Media Relations

Course? This course requires different skill sets and qualifications in order to provide proper instructions to achieve course objectives.

Due to terminology, they will have to have a background in critical incident management or crowd management.

Would the Government confirm if offerors will be evaluated based on the Lowest-Priced, Technically Acceptable (LPTA) approach as stipulated in the cover letter (page 2) or at described in Addendum to

52.212 basis for award (page 13) where Technical Capability is equal to Price.

The reference to “evaluation” on page 2 of the solicitation document is indeed misleading and will be replaced with

“award” in amendment 0001 to avoid confusion. Please note that there are two distinct processes involved with evaluation preceding selection for award. Award will be made on the Lowest

(evaluated) Priced offer, having been determined to be

Technically Acceptable

(LPTA) offer. While relative importance of evaluation factors is not required in solicitations that are using the procedures at FAR 13, the addendum has been provided to advise that there will be no trade-off; i.e. price and technical capability are equally important.
