SOLE SOURCE JUSTIFICATION FOR SIMPLFIED ACQUISITIONS
FAR Part 13.501(a)(1)(ii)
1. Identification of the agency and the contracting activity:
In accordance with Federal Acquisition Regulation (FAR) 13.501(a)(1) and 41 U.S.C.
1901, the Office of Acquisition Management proposes to award a purchase order on the basis of other than full and open competition with Hewlett-Packard (HP) for procurement of IT equipment on behalf of the American Embassy in Tashkent, Uzbekistan, Office of Export Control and related Border Security (EXBS) Program.
2. The nature and/or description of the action being approved.
Award of a new firm-fixed price purchase order.
3. A description of the supplies or services required to meet the Department’s needs.
The requirement is to donate HP IT Equipment to the Uzbekistan National Border Guards (BG). The procurement of the HP IT Equipment will allow EXBS to accomplish its mission objective of providing the Uzbekistan’s Border Guards (BG) the necessary technical capabilities to conduct training on a computer-based platform. Ultimately, this capability will help prevent the trafficking of weapons of mass destruction and illicit weapons transfers.
4. An identification of the statutory authority permitting other than full and open competition:
41 U.S.C.1901 and FAR 13.501(a) - Brand Name Acquisition.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the action require use of the authority cited.
The HP computers, monitors, laptops, keyboards and mouse have been proven compatible with the current IT infrastructure that BG uses. BG specifically requested HP equipment after conducting their own internal review and analysis. Additionally, HP vendors in Uzbekistan are able to provide real-time, Uzbek and Russian language support to BG if needed.
Additionally, this is Part 2 of 2 of a project to procure computers for BG. In Part 1 of the project, HP computers and monitors were purchased. In order for Part 2 of the project to be successful and prevent any unforeseen costs to the USG or technical compatibility issues for BG, HP only, and no other brand will meet EXBS’ needs.
6. A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable, include whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
This JOFOC and Combined Synopsis & Solicitation document will be posted on
FedBizOpps. In addition, a reference note will be posted on Post’s local and the RPSO’s website.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Fair and reasonable price will be determined by competition.
8. A description of the market research conducted (per FAR Part 10) and the results or a statement of the reason market research was not conducted.
BG, is part of the National Security Services of Uzbekistan. Their facilities are closed to foreign citizens. EXBS can confirm that BG indicated to the EXBS Advisor, that HP equipment was the only brand name that BG specified would be compatible with their current system. BG indicted that they currently have HP equipment, which is serviced by in-country certified HP vendors. BG stated that a different brand might require a different service provider and thus add unsustainable cost to maintain.
However, this procurement would be the 2nd HP brand name procurement that EXBS will do for BG, and thus, would support BG’s claims that HP equipment is only equipment that their system currently supports.
9. Any other facts supporting the use of other than full and open competition such as:

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.)
