COMPLIANCE WITH THE LOCAL LABOR LAWS

The following information is provided with the intention of providing general guidance but is in no way a comprehensive guide to labor laws and wage agreements in France. It is the responsibility of each offeror to thoroughly acquaint themselves with the pertinent business laws and regulations affecting company operations in France.

In France the provision of janitorial services is strictly controlled by law and falls under the “Convention Collective” No 3343 (Convention collective nationale des entreprises de propreté et services associés).

The ‘Convention Collective’ is a bargaining agreement between the Department of Labor, Employers Organizations and Labor Unions, which provides information on minimum basic salaries by professional category and their salary coefficients, premium pay, benefits, etc.

In accordance with the “Accord 1990-03-29 en vigueur le 23 juin 1989 étendu par arrêté du 6 juin 1990 JORF 9 juin 1990” detailed in Article 7 of the bargaining agreement “Convention Collective Nationale des Entreprises de propreté et services associés”, 100 % of the cleaning personnel allocated to the contract shall be maintained by the incoming contractor.

Therefore, if the contract award entails a change in Contractor, French labor laws require the incoming Contractor to take over 100% of the incumbent workforce falling under article 7.2 conditions.

It is advisable for Offerors to acquaint themselves with the exact details of these labor laws before submitting their offers. Also take note of H.9, Right of First Refusal. Exhibit E contains a list of incumbent employees and their employment history.

Full details of the “Convention Collective Nationale des Entreprises de propreté et services associes” No 3343 can be found in French on www.legifrance.gouv.fr

RIGHT OF FIRST REFUSAL OF EMPLOYMENT

In accordance with the Janitorial French Collective Convention, the new contractor shall provide an amended employment contract showing the change of employer while keeping the initial clauses identical.

An employee may stay employed by the outgoing contractor after agreement with both parties and the incoming contractor shall be informed of this agreement after contract award and prior to the transfer of all employees to the new contractor.
