June 17, 2024, Clarification 19FR6324Q0036- French teaching services

Clarification request) We have some concerns regarding the required two-year relationship between the company and teachers/subcontractors. We are seeking further clarification as FAR parts 12 and 52 referenced in the RFQ do not mention anything about a previous working relationship between the contractor and subcontractors. This requirement may prejudice small businesses that may not have previously operated in France nor had the opportunity to develop these two-year relationships with subcontractors. In the interest of fairness, especially to U.S.-based small businesses, can you please clarify?

Clarification answer) The two-year relationship between the prime contractor and the subcontractor(s)/ freelance teachers is addressed in the scope of work, block 20- 2.3- Instructor/teacher requirements, page 10 of the RFQ. It is also required as part of the solicitation provisions in section 3- A.2 (8-2) in page 38.

As expressed in the Q&A N2 – Question 18b and 25, the two-year relationship between the prime contractor and the subcontractor(s) is required to ensure integrity of the relationship and to demonstrate the subcontractors were assessed and proved to perform well. While such a relationship between a prime contractor and a subcontractor may be necessary for performance, there is no privity of relationship between the USG and any subcontractors. The prime contractor remains totally responsible for performance regardless of any subcontractor relationships.

Also, as part of an overseas acquisition above the SAT, please note that the solicitation was not set aside for small businesses. Indeed, in accordance with DOSAR 619.000(b), this is not mandatory for contracts that are both awarded and performed overseas.
