SECTION A – SUPPLIES/SERVICES AND PRICING
A.1 BACKGROUND
The United States Government (USG) requires a contractor to replace window glazing and refurbish select aluminum window frames and hardware at the U.S. Embassy chancery building in Copenhagen, Denmark. The building, completed in 1954, is inscribed on the Bureau of Overseas Building’s List of Significant Properties, as an example of postwar Modernism and the U.S. Department of State’s use of the architectural style as a symbol of American societal values of openness and democratic exchange. The glazing, over 70 years old, has reached the end of its service life and must be replaced while retaining the original frames. Due to the historic character of the building, this scope aims to take a restoration approach, and the original aluminum frames must remain in place during the glazing replacement.
A.2 TYPE OF CONTRACT
This contract is an indefinite-delivery indefinite-quantity contract with firm-fixed prices. Task orders will be priced and payable entirely in the currency indicated in the SF1442. The Government will not pay any additional sums due to any escalation in the cost of materials, equipment or labor, or because of the Contractor's failure to properly estimate or accurately predict the cost or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted due to fluctuations in the currency exchange rates. The Government will make changes in the contract price or time to complete only due to changes made by the Government in the work to be performed, or by delays caused by the Government.
The Government will make payments based on quantities and unit prices only to the extent specifically provided in the contract. The estimated quantities listed in A.3 below are estimates only and the Government does not guarantee that such quantities will be ordered.
A.3 CONTRACT PRICE
A.3.1 General. The Contractor shall complete all work, including furnishing all labor, material, equipment, and services required under this purchase order for the following firm fixed price and within the time specified. This price shall include all labor, materials, all insurance, overhead and profit.
A.3.2 Payment. All prices are in Danish Kroner (DKK), and the Government will make payment in Danish Kroner (DKK).
A.3.2 (a) VALUE ADDED TAX (VAT). The Contractor shall include VAT as a separate charge on the Invoice and as a separate line item in Section A.
A.3.2 (b) DEFENSE BASE ACT INSURANCE. Defense Base Act Insurance (DBA) requirement will only apply to employees working on this contract. The U.S. Department of Labor has issued a geographic waiver of the DBA Insurance requirement for employees covered under compulsory workers’ compensation laws of Denmark. The waiver does not apply to any employees working under this contract who are: (a) citizens of the United States of America; or
(b) lawful resident(s) of the United States of America; or (c) were hired in the United States of America. If the above waiver does not apply, the Contractor shall include Defense Base Act (DBA) insurance premium costs covering employees. The offeror may obtain DBA insurance directly from any Department of Labor approved providers at the DOL website at http://www.dol.gov/owcp/dlhwc/lscarrier.htm.
