The document addresses two primary inquiries from potential offerors. Regarding company registration requirements, foreign contractors must establish an office with a permanent address and telephone listing in Azerbaijan or demonstrate plans to establish one within 30 days of contract award; performance under an existing foreign legal entity without local registration is not acceptable. Concerning on-site safety and health personnel, a dedicated full-time Safety and Health Officer is not mandatory on-site at all times. Q1: Company Registration Requirement: Is a foreign contractor required to establish/register a local corporate entity or branch in Azerbaijan to execute this contract, or is it acceptable for an international company to perform the work directly under its existing foreign legal entity (provided all SAM registration and security clearance requirements are met)?

A1: Offerors/quoters must have an established business with a permanent address and telephone listing in Azerbaijan or plans to establish an office within 30 days of contract award.

Please see Section J on page 47 for QUALIFICATIONS OF OFFERORS.

Q2: On-Site Safety and Health Officer: Is it mandatory to have a full-time, dedicated Safety and Health Manager / Officer continuously present on site during all working hours, or can the required health and safety duties be managed by the English-speaking Field Superintendent / Site Supervisor alongside their primary responsibilities?

A2: We do not require the Safety and Health Officer to be present on site at all times. Our requirement is that all safety requirements specified in the solicitation are fully met throughout the performance of the work. These responsibilities may be performed by a field engineer, provided that the individual is qualified to ensure compliance with the applicable safety requirements.
