About this file
This is a Questions and Answers document addressing clarifications on Solicitation 191NLE26Q0094 for surreptitious equipment procurement by the Department of State Office of Acquisition Management for Ukraine's National Police and State Border Guard Services counternarcotics operations. The Q&A document provides critical guidance on six substantive issues raised by potential offerors regarding contract requirements and delivery logistics.
Key clarifications include: (1) English and Ukrainian language maintenance, operation, and handling manuals shall be delivered for all items if available, with Material Safety Data Sheets (MSDS) provided when applicable; (2) FOB Origin means the Government (INL Kyiv) covers all overseas freight, customs, and duties from the vendor's warehouse to the final destination, with the vendor responsible for delivering equipment to the USG freight forwarder location in Baltimore, Maryland; (3) all items shall be covered by standard manufacturer warranty, with the Statement of Work to be updated accordingly; (4) no contract line items are anticipated to be controlled by the Department of Commerce Bureau of Industry and Security (BIS) or State Department Directorate of Defense Trade Controls (DDTC) under ITAR; (5) for CONUS deliveries, vendors coordinate with the Contracting Officer's Representative (COR) for pickup at vendor location with delivery required within 270 days of contract award, while OCONUS deliveries from Europe require vendor consolidation at a single location for INL Kyiv coordination with the freight forwarder; and (6) offerors shall provide compliance with RFP terms and required technical information, with evaluation based on Lowest Price, Technically Acceptable (LPTA) methodology, meaning separate logistical costs, travel expenses, and ancillary charges should be incorporated into the technical and pricing proposals.
