About this file
This is a Justification for Other Than Full and Open Competition (J&A) document from the U.S. Department of State's Office of the Procurement Executive. The document seeks approval to award a sole-source contract to LEIDOS, INC. for a 12-month maintenance contract for a VACIS IP6500 non-intrusive inspection scanner located at the Corinto border crossing in Honduras. The scanner is critical for Honduras's border security operations, enabling efficient screening of cargo and vehicles to detect contraband, narcotics, and weapons.
The justification emphasizes LEIDOS's unique qualifications as the original equipment manufacturer (OEM), possessing proprietary technical knowledge, certified personnel, and exclusive access to components necessary for servicing the specialized system. The contract is urgent due to the scanner currently being non-operational, which increases risks of undetected contraband and compromises border security. The maintenance contract includes 24/7 help desk support, problem resolution, preventive maintenance, hardware replacement, software updates, and remote monitoring. Market research conducted on SAM.gov confirmed LEIDOS as the sole qualified vendor, and the contract is structured as a Firm-Fixed-Price (FFP) award.

SECTION 6. DESCRIPTION OF EFFORTS TO ENSURE THAT OFFERS WERE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR
WILL BE PUBLICIZED AS REQUIRED BY FAR SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION
UNDER FAR 5.202 APPLIES
A synopsis was not published under FAR 5.202(a)(2).
The market research identified two potential vendors: LEIDOS and one additional company. However, further analysis determined that contracting with the alternative vendor would pose significant technical and operational risks due to the proprietary nature of the VACIS scanner systems. These risks are as follows:
1. Technical Risks: The VACIS scanner's proprietary systems require specialized expertise and support that the alternative vendor may lack. This deficiency could result in equipment malfunctions, voided warranties, and compromised system calibration.
2. Operational Risks: The alternative vendor's unfamiliarity with the VACIS scanner systems could lead to delays in restoring operational capability, jeopardizing critical border security operations.
The VACIS IP6500 scanner is currently non-operational, and its continued outage significantly increases the risk of undetected contraband, including illicit drugs and weapons, at a major border crossing. The scanner is essential for maintaining inspection integrity, and further delays in restoring functionality directly compromise security and border enforcement effectiveness. Given the unique and proprietary nature of the equipment, qualified service providers are limited to the original manufacturer, LEIDOS, INC. This situation meets the criteria for not publishing a synopsis under the stated regulatory exception.
SECTION 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST
TO THE GOVERNMENT IS FAIR AND REASONABLE
The Contracting Officer has determined that the anticipated price(s) will be fair and reasonable based on historical prices and an independent estimate. By signing the justification, the Contracting Officer makes a determination that the to the Government is expected to be fair and reasonable.
SECTION 8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE
RESULTS OR A STATEMENT OF THE REASON A MARKET RESEARCH WAS NOT CONDUCTED
A market research review conducted on SAM.gov confirmed that Leidos, Inc. is the sole contractor qualified to provide maintenance and support for VACIS scanners, including the IP6500 model. The review found no other vendors with the necessary qualifications, certifications, or access to proprietary components required to service this highly specialized system.
Leidos, Inc., as the original equipment manufacturer (OEM), holds exclusive rights to the VACIS IP6500’s proprietary technology, software, diagnostic tools, and replacement parts. No third-party vendor is authorized or technically capable of servicing the scanner to OEM standards without risking equipment failure, safety
