191BWC23R002_0001 (Section F) F.01 Place of Performance - It is stated that the required projects shall be in TX, NM, AZ, and CA, but also within the Republic of Mexico (States of Tamaulipas, Nuevo Leon, Coahuila, Chihuahua, Sonora, and Baja California). Task orders may include work to be performed within Mexico for international projects.
a. Please clarify the USIBWC requirement to have staff and firms that are licensed and registered to practice engineering in Mexico for this solicitation.
For firms performing professional engineering work in Mexico with their staff or through a sub-contractor, it is expected that staff have the necessary qualifications and credentials to perform such work in Mexico.
b. Will Defense Base Act (DBA) insurance be required for work performed by individuals outside the United States and within Mexico on this contract?
Shall comply with the Department of Labor (DOL) requirements. The DOL website states, “Federal law requires all U.S. government contractors and subcontractors to secure workers' compensation insurance for their employees working overseas. The related statutes include the Defense Base Act, 42 U.S.C. §§ 1651-54”
c. Can you provide a general statement about the types of projects that we would be required to perform that are completely located within Mexico?
Work will be close to the border. Example projects include work conducted on the Mexican side of dams such as Amistad Dam and Falcon Dam. There may be LiDAR data collection, river cross section surveys or bathymetric data collection on the Mexican side of the Rio Grande for the development of hydraulic models. Work may include the data collection and development of hydrologic and hydraulic models of tributaries from Mexico into the Rio Grande, Tijuana River, and Nogales Wash, among others. Some of the data for these kinds of projects may be provided by Mexican agencies or may be acquired through Mexican subcontractors.
191BWC23R002_0001 (Section I) Many contract clauses are incorporated by reference. One of the clauses is 52.222 – 54 (Employment Eligibility Verification) Considering that projects may be within the Republic of Mexico (States of Tamaulipas, Nuevo Leon, Coahuila, Chihuahua, Sonora, and Baja California), please clarify your expectation that we must verify the employment of Mexican citizens as part of this contract.
52.222-54 is not applicable to work outside the U.S.
