About this file
This document contains questions and answers regarding solicitation number 19-100-SOL-00008 for the purchase and distribution of antiviral drugs. The solicitation seeks proposals for the purchase of Oseltamivir 30mg and 75mg capsules as well as Zanamivir 5mg capsules. In addition, proposals are requested for leveraging the current pharmaceutical supply chain to rapidly dispense antiviral drugs during an influenza pandemic. The maximum contract value is estimated at $186 million but is subject to change. Offerors are not bound by CLIN-specific maximum values and it is possible the government may be unable to order the full product quantities listed in the SOW if the maximum value is not increased. All questions were required to be submitted by February 1, 2019 and responses were to be posted by February 8, 2019.

RFP 19-100-SOL-00008
Amendment #3
February 27, 2019
Question 11:
The RFP’s CLIN tables (section B.2) describe some of the unit pricing (and extended pricing) as “to be negotiated.” Is this description meant to indicate only that the Government may negotiate with an offeror over its proposed pricing, raising the possibility that the contractual pricing ultimately may deviate from that proposed? If so, should “to be negotiated” apply to all unit pricing, as opposed to only that for 30mg capsules of Oseltamivir? If not, what is meant by “to be negotiated” as used in this context?
Answer 11:
Yes, “to be negotiated” applies to all of the unit pricing.
Question 12:
The RFP’s CLIN tables (section B.2) include an “Extended Price” column. Given that the RFP contemplates the Government will order CLINs on an indefinite-delivery, indefinite-quantity (IDIQ) basis, as opposed to a firm-fixed-price basis, it would seem that Section B should be limited to unit prices and that any extended prices would be established at the order level. In that case, an Extended Price column would be inappropriate for the RFP and the resulting IDIQ contract. Does the Government agree, and if so, will it remove this Extended Price column from the CLIN tables?
Answer 12:
No, the extended price column will remain.
Question 13:
The relationship between the RFP’s “maximum dollar value” (MDV) for the indefinite-delivery, indefinite-quantity (IDIQ) contract (section B.3.3) and the unit pricing in the CLIN tables (section B.2) is unclear. The RFP states that the MDV, at least at the outset, will be $186 million, but it does not identify any CLIN-specific maximum values/ceilings or suggest that the agency intends to impose such limits on offerors. The Statement of Objectives (SOO) includes the quantities of products the Government may order under the contract (section C.7) and states that an offeror “may propose on one or all requirements” (section C.3), including the product quantities. The way in which the RFP employs the MDV concept is problematic for several reasons. First, the Government apparently is expecting to be able to procure not only the product quantities identified in the RFP but also distribution services under this $186 million MDV. Second, without CLIN-specific maximum values/ceilings, an offeror proposing on less than all requirements would not know how much of the aggregate MDV will be available for the requirements on which it is proposing (e.g., how much it could propose per unit such that the aggregated MDV does not exceed $186 million). Will the Government please clarify the RFP by stating that (a) offerors are not bound to CLIN-specific maximum values/ceilings, and (b) it is possible that if the Government does not increase the MDV, the Government may be unable to order the product quantities provided in the SOO (i.e., 29,374,040 30mg capsules of Oseltamivir, 253,711,090 75mg capsules of Oseltamivir, 9,859,615 5mg capsules of Zanamivir) at the IDIQ unit prices?
Answer 13:
The $186M figure is an estimate based on the Government’s market research and is subject to change.
