The affirmative action policy is a requirement set forth IAW FAR 52.222.25 where an offeror is affirming they have an affirmative action policy on file with the Department of Labor and have represented that certification on their SAM.gov account or affirming in Section K.4 52.212-3 Offeror Representations and Certifications Commercial Products and Commercial Services (NOV 2021) of the solicitation. The affirmative action requirement is not related to the Authorization to Operate.
The Authorization to Operate (ATO) references meeting government and PBGC compliance. The program officer directs your attention to solicitation references: C.4.1 (Page 19) and C.5.1 (pages 20- 21). Attachment B, Written Questionnaire (page 80) asks detailed questions pertaining to an offeror's ability to meet government/PBGC compliance.
