(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

A-10 and written or oral communications) that the Contractor regards as exceeding the scope of the contract. Based on the most accurate information available to the Contractor, the notice shall state:

(1) The date, nature, and circumstances of the conduct regarded as a change in scope;

(2) The name, function, and activity of each Government individual and Contractor official or employee involved in, or knowledgeable about, such conduct;

(3) The identification of any documents and substance of any oral communication involved in such conduct;

(b) Following submission of this notice, the Contractor shall continue performance in accordance with the contract terms and conditions, unless notified otherwise by the Contracting Officer.

SOLAR ARRAY STUDY

RAMEY JOB CORPS CENTER

AGUADILLA, PUERTO RICO

I. GENERAL

The work includes a site assessment and a feasibility study for constructing a solar array and storage and other backup power alternatives on the main campus of the Ramey Job Corps Center to provide a range of practical alternatives for its electrical requirements.

This new project will also characterize the condition of the existing Solar Array system in detail and produce recommendations and a basis of design for a follow-on project to reduce or eliminate dependence on the Electrical Utility. Included recommendations will fully satisfy related Puerto Rico Electric Power Authority (PREPA) requirements. In addition, the report will include an estimate of probable costs of construction to install all identified systems and locations. The extent of work is described further in Section III.

II. SPECIFIC REQUIREMENTS/INSTRUCTIONS

A. PROJECT APPROACH

The Contractor is to describe its understanding of the project and propose process for successful execution. The study will address the following parameters:

• Proposed size of the solar array for each alternative

• Optimum mix of backup supply for each alternative (batteries, generator, utility)

• Optimum location for each alternative (rooftop, ground, over parking area)

• Necessary electrical upgrades, if any

• Battery housing/storage requirements

• Estimated cost of construction alternatives (Definitive estimate, -5% to +10%)

B. CODES

Use codes, ordinances, and regulations as enforced by city, county and Commonwealth agencies. Where such codes, ordinances, and regulations are not in effect, use the most current National code generally used in the area. ASTM, IEEE and NEC regulations shall also apply. Where regulations of the Commonwealth are more stringent than the Federal Government’s, the regulations of the Commonwealth shall prevail.

C. SPECIFIC INSTRUCTIONS

1. Center Operation

The center shall remain in operation throughout the Study and Evaluation phase of the project.

2. Contractor Responsibilities

Although this scope of work may identify specific elements of the investigation, analysis and reporting requirements, it is the Contractor's responsibility to provide any services which are incidental to these tasks.

3. Submittal Requirements

The following report submissions are required:

a) Preliminary Report and cost estimate

b) Final Report and cost estimate

c) Final Contract Submittal and cost estimate

4. Project Meetings

The Contractor shall participate in a kickoff meeting one week following award of contract notification. The meeting will be conducted using a videoconferencing site as provided by the ESC.

The objectives are to discuss the site constraints, evaluation of available information and to introduce key stakeholders.

The Contractor shall submit the Preliminary Report to DOL for review and acceptance within sixty

(60) calendar days of receipt of the Notice to Proceed. One week following the preliminary report submittal, an onboard review will be conducted via videoconferencing, where the selected firm will present their preliminary report and concepts to the stakeholders.

The Contractor shall provide a Final Report based on the schedule as noted in Section “V”. The Final Report shall incorporate all corrections and responses to the DOL Preliminary Report review comments. One week following the final report submittal, an onboard review will be conducted via videoconferencing, to review and present the study by the selected firm.

The Contractor will develop a final report based on the outcome of the stakeholders’ meeting convened to discuss the preliminary report comments.

The Final Report, to include all corrections, shall be submitted two weeks after the approval letter for the Final Report review has been received from the Contracting Officer. The Final Contract Submittal shall incorporate all corrections and responses to the DOL Final Report review comments.

5. Permits and Licenses

The Ramey Job Corps Center is a leased facility.

The A/E contractor shall research, and be responsible for outlining, all regulatory, permitting and licensing requirements required to perform this work in Aguadilla, Puerto Rico and in accordance with JCH-814, 2013 Section 1.7. No drawings or specifications shall be submitted for building permits unless express notification in writing is received from the CO.

6. Submittals for Review

The Contractor shall submit three (3) copies of the preliminary and final report along with three (3) sets of estimates of probable cost of construction to the Department of Labor for review and approval.

The Contractor shall submit three (3) sets of the Final Contract Submittal report documents and estimate of probable costs to the Department of Labor.

Each submittal of drawings shall be incorporated into an “AutoCAD” (version 2018 or earlier) DWG compatible electronic CD or thumb drive, and be delivered to DOL by the A/E Contractor in addition to the drawing/specification sets required. Drawings to be in “AutoCAD” and “PDF” format.

Complete specifications shall also be furnished on electronic “CD” media that is Microsoft Office Word 2010 compatible. Specifications shall be in MS Word and PDF format.

The Contractor is required to maintain the schedule per the contract, and must indicate to the Department of Labor ways and means to recover lost time due to any delays. No additional time will be given to the Contractor unless it is determined by the Department of Labor that the delay is legitimate and unavoidable and that the Contractor has prudently exercised all options within its authority and ability to avert such delays.

7. Availability of Existing Documents

Site verification of the existing conditions is required. As-built or record construction documents are not available. Contractor will be responsible for verification of all the dimensions and existing system types and conditions.

III. EXTENT OF WORK

A. SITE IMPROVEMENTS AND UTILITIES

1. Objectives

Some of the benefits that the Department Of Labor wishes to realize from this project include but are not limited to: determine the feasibility, consider options that will provide the best values, produce at least forty percent (40%) of site annual consumption of 57,245 kWh as averaged over the past year, and reduce operating costs of the buildings and decrease reliance on the existing local utility provider.

The contractor shall evaluate the following options for installation of the solar array as outlined below:

• Option 1: Provide maximum solar power based on available space (canopy, ground or roof mounted systems) tied to the electrical grid.

• Option 2: Provide maximum solar power based on available space (canopy, ground or roof mounted systems) and provide storage capacity to power minimal mission critical items such as food storage, medical supply storage, and AC for an area of refuge (Building 759A) for the students and staff. Electrical power may be supplemented using generated power with a fuel capacity for 48 hours of operation.

• Option 3: Provide 100% power and storage for the main campus.

The design to budget shall not exceed $5M including design and construction

The study shall include a map of the solar intensity within the Center boundary of the solar array installation site based on an on‐site visit, as well an analysis of the operational, facility, geological, and environmental challenges specific to the Center that may require further detailed assessment or that may limit the range of options for solar electricity generation.

2. The Contractor shall prepare a Site Suitability Assessment that includes, but is not limited to, the following:

a. Ambient Conditions

i. Site location (address, latitude, longitude, azimuth [degrees])

ii. Building Type (Commercial, Multifamily, Office, etc.)

iii. Size and geography of site

b. Building Conditions

i. Location for solar energy system: Roof-top / Ground / Parking canopy

ii. Solar energy system support/foundation description

c. Roof-top

i. Roof dimensions (identifying usable PV panel space)

ii. Roof pitch

iii. Roof materials of construction

iv. PV mounting system / Roof penetrations

v. Obstruction/shading analysis in planned PV panel area (including methodology in the shading determination)

vi. Roof condition (remaining useful life) or replacement design, if required

vii. Structural adequacy to support installed solar system (including recommendations if insufficient)

d. Ground

i. Description and condition of area (paved surface vs. open ground)

ii. Obstruction/shading analysis in planned PV panel area (including methodology utilized in the shading determination)

iii. Description of necessary work to support solar array rack(s)

iv. Deed or plot plan showing area is contiguous with facility to be served

e. Parking Canopy

a. Description and condition of parking area

b. Obstruction/shading analysis in planned PV panel area (including methodology used in

c. Description of necessary work to support solar array rack(s)

d. Deed or plot plan showing area is contiguous with facility to be served

3. The Contractor shall prepare a Building Energy Use and Cost Analysis for each alternative that includes, but is not limited to, the following:

a. Brief description of major building energy-use systems

b. Description of electricity metering (number of meters, location, etc.)

c. At least one year of monthly electricity usage data and estimates for any proposed construction

d. Summary of Building Energy Simulations

4. The Contractor shall specify a PV System for each alternative that includes, but is not limited to, the following:

a. Metering specifications and plan

b. Solar module orientation and tilt

c. PV cell specifications, including cell efficiency

d. Module and array description, including module and array efficiency

e. System size (kW) and projected performance - specify model used including input parameters, assumptions (such as soiling, degradation, etc.) and limitations.

f. Software used for analysis (PVWatts; PowerClerk; SolarAnywhere; RETScreen; SAM, etc.)

g. Model de-rate factor used

h. Inverter information (capacity, manufacturer, warranty, etc.)

i. PV project site plan, including point of electrical connection

j. If battery storage is included, specify installation location, model, and capacity

k. Solar vendor guaranteed performance, including product warranty, decrease of power output warranty

l. Manufacturer’s Statement of Guaranteed Useful Life

m. Maintenance requirements (for maintaining peak efficiency)
