About this file

This is a Specifications and Requirements document for Broward County Transit Temporary Personnel Services, issued by Broward County in Florida for positions supporting the county's public transportation operations, maintenance, information technology, planning, and paratransit functions. The solicitation seeks temporary personnel to support Broward County Transit (BCT), which operates 24 hours daily, 7 days a week, including fixed-route bus services, parattransit services for economically disadvantaged persons and persons with disabilities, and community shuttle services. The contract encompasses multiple job classifications across IT infrastructure, database management, project management, business analysis, office administration, and accounting functions. County-identified services, work locations, and coverage needs will determine specific assignments, with vendors required to propose qualified personnel. Work schedules will vary based on operational needs and may require different shifts, with assignments expected to begin within three business days of county notification. Multiple vendors may be selected under this solicitation, and transition activities will commence upon issuance of the Notice of Intent to Award to ensure operational continuity with incumbent vendors.

Vendor Personnel remain employees solely of the vendor, not the county, with vendors retaining all responsibility for recruiting, hiring, compensation, benefits, supervision, discipline, and employment compliance. All temporary personnel must undergo criminal background checks (including FDLE statewide checks, national sexual offender registry searches, and state sexual offender/predator registry searches conducted within one year of assignment), five-panel drug and alcohol testing at vendor expense, and HIPAA training annually. County may require removal of vendor personnel from assignments at its discretion without constituting employment termination. Vendors must offer health insurance with medical, dental, and vision coverage to personnel working 20 or more hours weekly and must comply with all Federal Transit Administration requirements, immigration verification, nepotism disclosure policies, and county computer and network use policies. Overtime is compensated at 1.5 times the standard hourly rate for hours exceeding 40 per week, and callout support may require on-call rotation with 15-minute minimum compensation increments. Vendors may request price adjustments annually after the first year of performance based on the Consumer Price Index, not to exceed 3 percent annually, subject to county approval. Work locations include multiple BCT facilities in Pompano Beach, Plantation, Dania Beach, and Fort Lauderdale.

SPECIFICATIONS AND REQUIREMENTS

Broward County Transit Temporary Personnel Services (FTA)

1. SCOPE OF WORK:

1.1. Broward County (“County”) seeks temporary personnel services to support the County’s public transportation operations, maintenance, information technology, planning, and paratransit functions. County provides public transportation services through Broward County Transit (“BCT”), including fixed-route bus services, contracted paratransit services for the transportation of economically disadvantaged persons and persons with disabilities, community shuttle services, and partnerships with other entities to provide alternative local public transit services. BCT provides millions of passenger trips annually and operates from Government Center West in Plantation, with major maintenance and operations facilities located at Copans Road in Pompano Beach and Ravenswood Road in Dania Beach.

1.2. BCT operates 24 hours a day, 7 days per week. County will identify the required services, work location(s), and coverage needs for each assignment, and Vendor shall propose qualified personnel capable of meeting those requirements. Work schedules (including hours and days) will be based on operational needs and coordinated through Vendor’s designated supervisor/representative. Multiple Vendors may be selected under this solicitation, and each selected Vendor is responsible for providing qualified temporary personnel consistent with the operational needs described herein. County requires assignments to begin work within three business days after County notifies Vendor that services are required.

1.3. County’s normal business hours are Monday through Friday 8:30 a.m. to 5:00 p.m. Work schedules may vary based on operational needs and specific assignment requirements, and support coverage may be required during different shifts. Overtime shall apply only after Vendor personnel has worked in excess of forty (40) hours in a workweek, regardless of the assigned shift or schedule.

1.4. “Callout Support” refers to after-hours or emergency response services that may be required to support operational needs or critical projects requiring dedicated resources and staffing. Callout Support may be required for assignments supporting the operations, maintenance, information technology, planning, and paratransit, including support for critical systems necessary to deliver safe, reliable, and on-time transit service.

1.5. Depending on the operational requirements of the assignment, Vendor personnel may be required to work authorized overtime to address critical business needs of County. Callout may include on-call support as part of a two-week rotation cycle coordinated with BCT IT staff. Vendor shall compensate Vendor personnel for hours actually worked during callouts at one and one-half (1.5) times the standard hourly rate. “Hours actually worked” means hours that were spent responding to and resolving the callout issue. Vendor shall compensate callout time in a minimum increment of 15 minutes for time actually worked while on rotation. The on-call rotation schedule and coverage requirements will be communicated by County to Vendor’s designated supervisor/representative, and Vendor remains responsible for implementation with its personnel.

2. AT-WILL EMPLOYMENT/TRANSITION OF SERVICES:

2.1. All individuals provided by Vendor under this Contract (“Vendor Personnel”) are and shall remain at all times, employees (or, as applicable, agents) of Vendor, and not employees, agents, or servants of County. Nothing in this Contract shall be construed to create any employment relationship, agency relationship, or joint-employment relationship between County and Vendor Personnel. Vendor has and retains sole responsibility and control over recruiting, hiring, onboarding, pre-employment screening and testing, assigning, supervising, evaluating, disciplining, paying wages and benefits to, and discharging Vendor Personnel, and for compliance with all applicable wage-and-hour and employment laws.

County shall have no financial obligation or responsibility for Vendor Personnel’s wages or benefits.

2.2. To protect County operations, safety, security, and service quality, County may, require any Vendor Personnel be removed from County premises and/or assignment when County determines, in its sole discretion, that continued presence or performance is not in County’s best interest (e.g., failure to meet assignment requirements, safety or security concerns, misconduct, or inadequate performance). County’s direction under this section is limited to removal from County site/assignment and does not constitute and shall not be treated as termination of employment. Vendor shall be solely responsible for any employment action, including counseling, discipline, reassignment, or discharge, and shall communicate directly with the affected Vendor Personnel regarding the reason and any subsequent employment action. Upon notice from County that removal from a site/assignment is required, Vendor shall promptly ensure that the individual relinquishes and returns all County property, equipment, credentials, and supplies in the individual’s possession. Vendor must, within 72 hours of County request, provide at least three qualified candidate resumes for replacement personnel, unless County agrees in writing to a different timeframe due to operational needs.

2.3. County may have incumbent temporary personnel performing ongoing or critical assignments that cannot be interrupted. To maintain operational continuity, the newly awarded Vendor must coordinate with County’s incumbent vendor and designated County staff to support an orderly transition, subject to County direction regarding operational priorities and site requirements.

2.4. County may request continuity for certain assignments by asking the newly awarded Vendor to consider incumbent temporary personnel for continued assignment. Any decision to hire, onboard, employ, reassign, discipline, compensate, or terminate any individual remains solely with Vendor. Vendor shall cooperate in good faith to facilitate continuity and transition activities, including reasonable knowledge transfer, documentation exchange, and schedule coordination, consistent with Vendor’s management of its workforce.

2.5. Transition activities shall commence upon issuance of the Notice of Intent to

Award and continue until County determines that critical functions have been transitioned. Vendor shall designate a transition lead and remain responsible for managing its personnel and ensuring uninterrupted service coverage during the transition.

3. NEPOTISM:

3.1. Vendor(s) acknowledges that, consistent with County policy, Vendor Personnel may not be assigned to perform services for County in a manner that would supervise, be supervised by, or influence the employment activity of a relative, domestic partner, or spouse employed by County. Therefore, Vendor is responsible for conducting a written inquiry of its personnel, including personnel already assigned to County, whether the individual has a relative, spouse, or domestic partner employed by Broward County. For purposes of this Section “Relative” means a father, mother, son, daughter, brother, sister, uncle, aunt, first cousin, nephew, niece, husband, wife, father-in-law, mother-in-law, son-in-law, daughter-in-law, brother-in-law, sister-in-law, stepfather, stepmother, stepson, stepdaughter, stepbrother, stepsister, half-brother, half-sister, or other household member. If Vendor’s inquiry identifies such a relationship, Vendor must provide written notice to County’s Contract Administrator identifying the existence of the relationship, and must not assign, or must remove from County assignment, the affected individual unless and until County’s Contract Administrator confirms in writing that the proposed assignment is acceptable from a County conflict of interest operational perspective. County’s role under this Section is limited to determining whether the individual may be present on County premises and/or assigned to perform services under this Contract due to conflict-of-interest considerations and does not constitute hiring, firing, discipline, supervision or control of Vendor Personnel.

3.2. Vendor Personnel have a continuing duty to disclose if a relative, domestic partner, or spouse is a County employee to Vendor, and Vendor must maintain ongoing compliance with these disclosure requirements. If Vendor knowingly fails to make the required inquiry of Vendor Personnel or knowingly fails to disclose such a relationship to County or otherwise fails to follow the disclosure procedures set forth in this Section, such failure is a material breach of the

Contract and may result in termination of the Contract and possible debarment or suspension proceedings. Such proceedings will be consistent with Chapter 21 of the Broward County Administrative Code.

4. DRUG TESTING:

4.1. Vendor must not assign any Vendor Personnel for a County assignment unless the individual has completed a drug and alcohol test administered by Vendor at Vendor’s sole cost and responsibility. The drug screen must be consistent with a Five Panel Test, including tests for amphetamines, marijuana, opiates, cocaine, and phencyclidine. All testing must be performed by a qualified laboratory and conducted in a professional manner to produce accurate and complete results.

The laboratory must follow guidelines for procedures and standards established by The Omnibus Transportation Employee Testing Act of 1991 and applicable Florida law. Any Vendor Personnel that test positive are not eligible for placement on any County assignment. Vendor shall be solely responsible for communicating test requirements and outcomes to its personnel. Upon County request, Vendor must, within 24 hours, certify that a drug and alcohol test was conducted on Vendor Personnel and the temporary employee is eligible for assignment to County. Any Vendor Personnel supplied by Vendor must have been subjected to drug and alcohol testing no earlier than one year before the date on which the individual will start the assignment with County.

5. CRIMINAL HISTORY BACKGROUND CHECKS:

5.1.3. Searching the FDLE Sexual Offender/Predator Registry for Florida. The criminal background check must include any alias or former names utilized at any time by the temporary employee.

5.2. If the individual has lived in Florida less than 10 years, then a criminal background check must be performed in all jurisdictions where the temporary employee lived prior to residing in Florida.

5.3. Any Vendor Personnel supplied by Vendor must have been subjected to background check screening procedures no earlier than one year before the date https://web.fdle.state.fl.us/search/app/default on which that individual will start their assignment with County. Vendor must maintain copies of the results of the criminal background check for at least three years after the termination of this Contract and within 48 hours forward copies of same to County upon request.

5.4. Prior to submission of any Vendor Personnel for an assignment, Vendor must disclose to County all criminal information discovered in that temporary employee’s background check to be reviewed for job related purposes. In the event Vendor obtains or is provided with supplemental criminal background information, after submission of any individual for an assignment, Vendor must immediately notify County of the new information. Additionally, Vendor must require that any individual submitted for an assignment to County notify County and Vendor within 48 hours of any finding of guilt, plea of guilty, or plea of no contest to a felony, misdemeanor, or criminal infraction, whether or not adjudication was withheld, which occurred after submission of a temporary employee for assignment.

5.5. County may terminate the contract resulting from this bid within 10 days after written notice for cause, with notice provided to Vendor for a violation related to Vendor’s failure to perform the required background screening of all Vendor Personnel supplied by Vendor to County or for failure to disclose to County all criminal information discovered in Vendor Personnel’s background check.

Vendor will not be subject to immediate termination in the event County determines a violation of the requirements for criminal background checks was outside the reasonable control of Vendor and Vendor has demonstrated current compliance with the background check requirement described herein.

6. DRUG SCREENING/BACKGROUND CHECK ADDITIONAL INFORMATION:

6.1. County reserves the right to request, at Vendor’s expense, a background check/drug screen for any Vendor Personnel whose background check/drug screening was conducted more than 12 months prior to the initial background check/drug screening.

6.2. Per County policies, annual criminal background checks, drug testing, and substance testing may be required for Vendor Personnel’s identification badge/ID renewal for safety sensitive positions or any contracted position.

7. HIPAA COMPLIANCE:

7.1. Vendor is subject to the Federal Health Insurance Portability and Accountability

Act of 1996 (“HIPAA”), and the requirements of HIPAA mandate certain responsibilities of Vendor with access to Protected Health Information (“PHI”).

Vendor will ensure that all Vendor Personnel assigned to County are fully trained and updated annually on the requirements of HIPAA and client confidentiality.

Vendor must not assign any Vendor Personnel for a County assignment without such individual having completed HIPAA training within the past year. County reserves the right to request proof thereof.

7.2. Code of Federal Regulations, Title 42 - Vendor and Vendor Personnel must not disclose to anyone, directly or indirectly, any such personally identifiable information or other confidential information gained from the agency, unless the individual who is the subject of the information consents to the disclosure in writing, or the disclosure is made pursuant to the agency’s policies, procedures and rules.

7.3. Temporary employee must respect and maintain the confidentiality of the client at all times as required under HIPAA Privacy and Security Rules, 45 CFR Parts 160, 162, 164 and 42 U.S.C. § 17921.

7.4. Vendor must be solely responsible and liable for any violation of HIPAA or other applicable confidentiality requirements by its employees, including any resulting fines, penalties, damages, or costs incurred by County.

8. FEDERAL TRANSIT ADMINISTRATION SUPPLEMENT REQUIREMENTS

8.1. Vendor must comply with the Federal Transit Administration Supplement posted with this solicitation and with any updated version issued by County. The Supplement is incorporated into this Contract by reference and has the same force and effect as if fully set out in this Contract.

8.2. Vendor must ensure that all Vendor Personnel and all subcontractors comply with every applicable federal requirement contained in the Supplement. Vendor must apply all applicable Supplement requirements to any subcontracted work.

8.3. Vendor must maintain all records necessary to demonstrate compliance with the

Supplement and must provide such records to County upon request.

8.4. County may direct Vendor to take any action necessary to maintain compliance with the Supplement as a condition of continued performance under this Contract.

9. QUANTITIES:

9.1. The Initial Term Minimum Quantity for each bid item is considered to be zero.

The Initial Term Maximum Quantity is listed for each bid item and must not be exceeded per year.

10. ADDITIONAL JOB CLASSIFICATIONS MAY BE ADDED OR DELETED:

10.1. Although this Contract identifies specific job classifications, the Parties acknowledge that County’s temporary staffing needs may change over time.

Accordingly, County may request that Vendor propose additional job classifications or discontinue use of existing classifications based on operational requirements. Vendor must, upon written request, provide a written quote for any proposed additional job classifications to be added. The primary and/or secondary and tertiary award for any new classification, including applicable rates and any position-specific requirements, will be designated through the amendment. Any addition or deletion of a job classification shall be effective only through a written amendment to this Contract executed by County. Unless otherwise provided in the applicable amendment, pricing for any newly added classification shall be awarded in accordance with the solicitation’s pricing methodology (including award tiering based on the lowest responsive quote).

Newly added classifications shall not be inserted into existing classification groups unless expressly stated in the amendment.

10.2. County retains discretion to: (a) decline to add a requested classification, (b) discontinue use of any classification under this Contract, or (c) procure staffing for classifications not listed herein through a separate solicitation or other lawful procurement method, including where Vendor does not timely provide a responsive quote or is unable to provide acceptable service. For clarity, County’s decisions under this Section relate solely to the scope of services and procurement of classifications and do not constitute hiring, supervision, discipline, or other employment control over Vendor personnel, all of which remain Vendor’s sole responsibility.

11. OVERTIME:

11.1. Overtime shall be calculated with the Fair Labor Standards Act and applicable law. Vendor is solely responsible for ensuring proper overtime classification, calculation and payment to Vendor Personnel. Unless otherwise stated in this Contract, overtime hours worked on a County assignment shall be compensated at the rate of one and a half (1.5) times the regular hourly wage quoted by Vendor on the Bid Table. To manage operational needs and budget, County may specify whether a particular assignment permits overtime and requires advance written authorization for overtime work. All overtime hours must be approved by County before any overtime hours are worked.

12. HOLIDAY PAY:

12.1. County may request that Vendor Personnel perform services on County-recognized holidays based on operational needs. When holiday work is authorized, Vendor shall compensate its personnel at one and one-half (1.5) times the applicable regular hourly rate for actual hours worked on the holiday only. No additional or duplicative holiday compensation shall be paid. Vendor is solely responsible for calculating and paying all wages and premiums due, and for compliance with all applicable wage-and-hour laws.

13. VACATION PAY:

13.1. Vendor shall administer its own leave policies and remains solely responsible for determining eligibility for and payment of any vacation benefits to Vendor Personnel. Vendor Personnel assigned to County shall provide Vendor with at least two weeks’ advance notice of planned vacation, and Vendor shall coordinate with County’s designated point of contact regarding anticipated coverage impacts.

13.2. If an assignment is ongoing during an individual’s approved vacation, County may request that Vendor provide a qualified replacement to maintain continuity of services. County’s role is limited to confirming assignment coverage needs and the acceptability of proposed replacement personnel for site-access and assignment suitability purposes; all leave approval, scheduling, and employment decisions remain Vendor’s sole responsibility.

14. EMPLOYEE BENEFITS FOR ASSIGNED TEMPORARY EMPLOYEE:

14.1. Vendor shall be solely responsible for determining eligibility for, administering, and providing employee benefits for Vendor Personnel assigned under this Contract. Vendor shall provide such benefits at no additional cost to County, and nothing in this Section creates any obligation on the part of County to sponsor, contribute to, administer, or provide benefits to Vendor Personnel.

15. PRICING CONSUMER PRICE INDEX (CPI) ADJUSTMENT REQUEST:

15.1. Vendor may request a price adjustment after one year of performance and not more than once in any twelve-month period. Any request must be in writing, must be submitted to the Contract Administrator at least ninety days before the proposed effective date, and must include documentation supporting the need for the adjustment. Any approved adjustment will be based on the Consumer Price Index for All Urban Consumers for the Miami Fort Lauderdale West Palm Beach region. If that index is no longer available, County will identify a comparable index.

15.2. County will determine whether any requested adjustment is in the best interest of County. When multiple Vendors are awarded under this Contract, County will make any pricing decision in a manner that County determines to be equitable for all awarded Vendors. No adjustment will take effect without written approval from the Contract Administrator. County may also initiate an adjustment based on the same index and Vendor must provide written approval before such an adjustment takes effect unless this Contract states otherwise.

15.3. Any approved adjustment will not exceed three percent in any year. If County does not approve a requested adjustment, Vendor must continue performance at the existing rates for the Term.

16. MINIMUM QUALIFICATIONS OF TEMPORARY EMPLOYEE:

16.1. County may evaluate proposed Vendor Personnel solely to determine whether an individual meets the assignment-specific qualifications and site requirements under this Contract. Such evaluation may include a review of credentials and, where appropriate, an interview and/or a demonstration of proficiency (e.g., a user application demonstration) relevant to the requested assignment.

16.2. Any County decision following this evaluation is limited to acceptance or rejection of the individual for placement on a County assignment and, where applicable, continued site access. County’s evaluation and acceptance decisions do not create and shall not be construed as creating any employment, agency, or joint-employment relationship, nor as constituting supervision, discipline, or control of Vendor Personnel. Vendor remains solely responsible for recruiting, hiring, onboarding, assigning, supervising, directing, evaluating, disciplining, compensating, providing benefits to, and discharging its employees and for all other aspects of the employment relationship.

17. ADDITIONAL VENDOR REQUIREMENTS:

17.2. Vendor is responsible for compensating Vendor Personnel for training required by Vendor or undertaken at Vendor’s direction, including training completed during scheduled work hours. If County requests assignment-specific training in writing for operational or safety reasons, the Parties will document in writing whether such time is billable under this Contract. Any County-provided or County-requested training is limited to site rules, safety, security, and assignment requirements and shall not be construed as County supervision or control of

Vendor Personnel.

17.3. Vendor should provide at no charge to County, at least three resumes for each of the positions listed on the Bid Table staffed by their company within the last three years. Vendor must submit within three business days of County’s request.

Vendor may be deemed non-responsive for failure to fully comply with these timeframes.

17.4. Prior to submission of any temporary employee for an assignment, Vendor is responsible for confirming the temporary employee’s work experience, education related diplomas, and certificates listed on the temporary employee’s Resume.

Vendor must bear all costs associated with the confirmation of work experience, education related diplomas and certificates.
