Questions for Solicitation 15M50019QA4400005
1. Please confirm that unless and until a contractor bids and submits an operational plan for any particular sub-task order (STO) and is then selected as the vendor of choice for such STO, neither party would be obligated under this Statement of Work to provide services for any particular operation. In other words, if a party signs this agreement but does not bid on a particular case, the party is under no obligation to respond to that case.
This is a requirements contract, so the way orders will be issued is on a randomly selected rotational basis each year where if a vendor is unavailable we will go to the next vendor. So you are correct in saying if the current vendor is unable to take the case we then go to the next vendor.
2. In the case of chickens that are listed in a criminal warrant, would USMS consent to contractor providing care to the chickens and not participating in or facilitating humane euthanasia if contractor were to bear the expenses of such care? If so, would contractor be required to receive consent from USMS on a case-by-case basis to provide such care?
No, the USMS would not consent to this, and would not consider it on a case-by-case basis.
3. Will USMS advise the contractor if it has reason to believe that animals other than those listed in the warrant will be present at the scene?
If information is known prior to execution of the seizure warrant.
4. In the case of chickens present on scene that are not listed in a warrant, would USMS object to contractor collaborating with local law enforcement to remove the chickens?
This would only be considered on a case-by-case basis and only after approval is provided by USMS and DOJ. The services ordered by the USMS must be delivered first in any situation like this.
5. Do the limitations placed on on-scene communications with third parties extend to contractor’s volunteers, contractors, and/or third-party animal welfare organizations that may assist contractor and with which contractor has entered into an agreement to provide such services?
No, that is not the intent of the limitations place on on-scene communications.
6. Throughout the agreement, there are specified time periods for deliverables. Are those time periods subject to any other dates being agreed upon with the Department of Justice attorney assigned to the matter?
Time frames and expectations will be assigned at issuance of STO.
7. With respect to veterinary care or special veterinary care, if the contractor makes every available attempt to contact the COR prior to procuring emergency veterinary services as a result of a serious illness or injury, but the COR is not available and the Contractor determines, in its sole discretion, that veterinary care must be provided immediately, may the Contractor provide and/or obtain such care without the COR’s consent and provide prompt notice to the COR of such care?
Only in extreme circumstances.
8. Item 1: In the provided Excel Pricing Schedule for CLIN 0024 (Chickens) and CLIN 1024, the total price formula has an error that prevents it from functioning (corrected formula appears to be C48*E48).
a. Corrected See updated pricing sheet.
9. Item 2: In the provided Excel Pricing Schedule, there is no EST Quantity placed in the locked cell for large animals (CLIN 0025 – CLIN 4025) which prevents the total from calculating.
10. Item 3: In the provided Excel Pricing Schedule, the unit price cell for CLIN 3025 is locked preventing price input.
