About this file
This is a Special Instructions to Vendors document for Broward County, Florida, establishing an open-end/indefinite quantity contract for emergency traffic signal restoration and repair services with the Broward County Traffic Engineering Division (BCTED) and other county agencies following natural disasters or state of emergency declarations. The contract is structured as a one-year term beginning from the date of award with no renewal options. The solicitation does not specify a guaranteed minimum quantity, as purchase orders will be issued as-needed by the county. Vendors must be prepared to fulfill all quantities ordered during the contract period. Award will be made to the three lowest responsive and responsible bidders, with a Primary Vendor receiving the initial contract, a Secondary Vendor serving as backup if the Primary Vendor cannot perform or reaches maximum service capacity, and a Tertiary Vendor available under the same circumstances. The county reserves the right to award on a group, item-by-item, or total bid price basis, whichever serves the county's best interest.
Vendors must possess either a State of Florida Certified Electrical Contractor or Certified General Contractor license, or a Broward County Master Electrical Contractor or General Building Contractor Class "A" license at the time of submittal. The contract includes annual pass-through allowances totaling $345,000 for permits and inspection fees ($45,000), repair and replacement parts ($150,000), and equipment rental ($150,000), with no markup or additional fees permitted on allowance items. Vendors must perform at least 60 percent of the total contract price themselves without subcontracting. Liquidated damages are assessed at $100 per day for failure to complete work within specified timeframes. The solicitation is subject to Federal Emergency Management Agency (FEMA) compliance requirements and various Florida statutory provisions regarding state-appropriated funding, including restrictions on certain local preferences and programs. All vendors must submit responses electronically through BPRO and receive a submission receipt by the closing deadline.

B. Contract Type
Open-End/Indefinite Quantity Contracts. This solicitation is not for a definite quantity of goods or services and is for an open-end/indefinite quantity contract. The County shall purchase the guaranteed minimum quantity of goods or services (if any) stated in the solicitation but may exceed that minimum amount, and the Contractor shall provide all amounts ordered by the County, limited only by any maximum quantity stated in the solicitation. Such order will contain the quantity, time of delivery, and other pertinent data. If the County requires delivery within a shorter period than the delivery time specified in the solicitation (if any), and if the Vendor is unable to deliver by that time at the contracted price, the County may obtain such delivery from other sources, without penalty or prejudice to the County, and such shall not be a violation of the contract.
There is no guaranteed minimum quantity of goods or services. Any quantities stated are estimates only.
Contract Term/Period: The initial contract period shall start on date of award, or upon expiration of the current contract, whichever is later, and shall terminate one (1) year from that date with no renwals. The Vendor must complete delivery, and the County will receive delivery, on any orders issued by the County to the Vendor prior to the date of expiration.
