Summary of Specifications and Requirements

This is a specifications and requirements document issued by the Broward County Board of County Commissioners Traffic Engineering Division (BCTED) for emergency traffic signal restoration and repair services following declared states of emergency. The contract encompasses repair and replacement of traffic signals, school flashers, and street lights damaged by natural disasters or catastrophic failures throughout Broward County. Services include both Type I repairs (providing one functioning overhead signal indication per approach) and pre-event signal restoration to return systems to pre-storm conditions. The scope of work requires contractors to furnish all labor, equipment, materials, and incidentals necessary for complete installations, including maintenance of traffic operations, documentation, and quality assurance. Contractors must mobilize a minimum of 50 percent of required resources within 48 hours and 100 percent within 96 hours of receiving a Notice to Proceed. Work may be performed 24 hours per day, seven days per week as directed by the County, with no additional compensation for overtime, weekend, or holiday work. All work must comply with current Florida Department of Transportation (FDOT) standards, specifications, and the Manual on Uniform Traffic Control Devices (MUTCD), with the County's more stringent requirements prevailing in cases of conflicting standards.

Compensation is based solely on unit prices for identified pay items, with no guaranteed minimum or maximum quantities. Unit prices must include all associated costs such as mobilization, demobilization, field visits, permit acquisition, travel time, traffic control, restoration, documentation, quality control, inspections, disposal of materials, delivery of removed items to County facilities, a 90-day burn-in period, one-year warranty, and preparation of as-built drawings in multiple formats. The County will not provide price adjustments for quantities exceeding or falling short of estimates, nor will adjustments be made for fuel price fluctuations. Contractors must be pre-qualified with FDOT in traffic signals and maintain current insurance certificates and contact lists prior to May 1st annually. The contract is FEMA-compliant and subject to Federal Highway Administration (FHWA) requirements; contractors must provide documentation ensuring reimbursement eligibility from Federal Disaster Reimbursement Programs. Equipment removed during contract work becomes County property except for specified items (concrete or wood poles, conduit, cabling, power service assemblies, controller cabinet foundations, and associated hardware) that become contractor property for disposal in compliance with applicable regulations.

The Contractor shall ensure that all National and State Standards continue to be adhered to and that any additional requirements identified by BCTED standards and specifications and County’s Minimum Standards are also incorporated into the project work elements. In the event a conflict appears to exist among the standards or specifications, the more stringent and specific requirements shall prevail.

If more than one award is made, such award will be to the lowest bidder, and then to the next lowest bidder(s) based on availability of the bidders and the bidder's ability to satisfy the needs of the County at the time contacted.

The Pay Item unit cost includes the cost of the equipment item and/or required installation costs including all labor, tools, equipment, fuel, incidental and miscellaneous materials necessary for a complete and accepted installation. The Vendor/Contractor shall also factor within the cost of each individual Pay Item unit, the cost for any additional incidentals including, but not limited to, the following:

8.1.1 Field visits

8.1.2 Meetings

8.1.3 Permit Acquisition Time

8.1.4 Travel Time

8.1.5 Loading and unloading

8.1.6 Mobilization

8.3 In the event that the bid items and unit prices in the items attached hereto and made a part hereof, for signal repair services do not adequately address a specific work requirement, the Contractor will abide by Sub- Article 4-3.2.1, sub-sections 1, 2 and 3 of Section 4 (Scope of the Work) of the 2023-24 FDOT Standard Specifications for Road and Bridge Construction for payment of such services.

9. LEGAL REQUIREMENTS AND RESPONSIBILITY TO THE PUBLIC:

The contractor shall comply with all provisions contained in the FHWA- 1273, dated October 23, 2023. The FHWA-1273 Electronic version, may also be obtained on the Florida Department of Transportation’s website at the following URL address https://www.fhwa.dot.gov/programadmin/contracts/1273/1273.pdf

10 Amended FDOT Pay Items:

10.1 This solicitation is principally developed under the FDOT Pay Item structure included with the FDOT Basis of Estimates framework. The corresponding FDOT standards and specifications associated with each Pay Item represent the pre-requisite minimum standard required of the County.

However, due to the fact that this is a general services contract, the County determined that further refinement, and more specificity of the standard FDOT pay item description, would better describe the more detailed and potentially varied requirements of this solicitation, and overall better facilitate the bidding process. Therefore, in cases where it was deemed appropriate by the County to further clarify a particular FDOT pay item number, BCHCED has provided references within pay items of the bid pricing sheets that further clarify the BCHCED-specific project requirements.

10.1.1 The County maintains an Approved Signalization Equipment List which references the FDOT Pay Item numbers. The intent of this list is to inform and provide guidance to contractors of County traffic control equipment requirements. Devices mentioned in the Not Approvable column shall not be accepted. The Broward County Approved Signalization Equipment List is a living document and can be changed within the life of the Contract. Any equipment disapprovals within the life of the contract must be adhered to by the Contractor. The Contractor will have to re-submit new equipment for the pay item with the disapproval if this were to occur. This approved list is available at the following link:

https://www.broward.org/Traffic/Pages/Publications.aspx

10.1.2 Usage of Hourly Labor and Equipment Rates

Specific project requirements may require the utilization of hourly labor and equipment rates to otherwise fulfill work tasks not specifically addressed by a particular pay item. The method for utilizing hourly rates is as follows:

10.1.3 Maximum Limiting/Not-to-Exceed Amount. Under this method, a specific type of work, equipment and the particular personnel classification to be utilized is known with a reasonable degree of certainty, but the extent of the hours required to complete the work is uncertain. An example of this scenario would be the repair of damaged underground interconnect conduit where the type of work is known, but the extent of damage is not immediately known because the damage is underground. Similar to an hourly contract, the Contractor will perform the requested services within a pre-determined maximum which limits the amount of hours, and the Contractor will have to document and report the specific hours actually worked on the Purchase Order (PO). The Contractor shall only be compensated for documented hours; the Contractor shall not be compensated for hours that exceed the PO maximum-limiting amount of hours or for hours performed by other classifications of personnel not included in the PO.

10.1.4 Hourly rates will be pro-rated to the nearest quarter hour increments.

https://www.broward.org/Traffic/Pages/Publications.aspx

10.1.5 The cost of transporting equipment to and from the job site is included in the hourly rate of the applicable pay item. The County will not pay from equipment remaining overnight at the job site, or if the equipment is not operational for four (4) hours or longer.
