DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Denver Acquisition Operations Branch (AOB)
2. Name and Address of Single Source: Garmin brand name.
3. Description of Supplies/Services and Estimated Cost. The Bureau of Reclamation, Pacific Northwest Region requires a communication tool to ensure the safety of its employees traveling in remote areas. Reclamation will centrally purchase and manage a pool of Satellite Emergency Notification Devices (SEND) based on the Iridium satellite constellation. The plan is for the funding and procurement to be completed by the Regional Office as a safety service offering. The devices will also require an ongoing service agreement, which supports various communications and tracking specifications.
4. Description of Circumstances, including why only one source is reasonably available.
Safety protocols exist, for which only the GPSMAP® 66i GPS Handheld and Satellite Communicator meets the protocols. The units will be used to share location and trip details, including tracking and GPS information in case of an emergency. Due to the rigorous and rural nature of the work that is being conducted it is imperative that Reclamation have a device that meets its specifications.
When comparing other SEND devices, the Garmin device is the only one that meets the needs of mapsharing, bluetooth, wide network for emergency service with the most accurate employee tracking. Also, the employees use the devices to track waypoints and down load maps and receive emergency updates for weather and text communications with each other.
The Garmin devices are the only devices that meet all the needs of the employees using them in the field.
5. Determination of Fair and Reasonable Price. The Contracting Officer will perform the necessary price analysis of all responses to the solicitation based on adequate price competition to ensure that the awarded price is fair and reasonable. However, additional price analysis techniques such as market analysis for similar items in the industry and review of current price lists or catalogs will be employed, if deemed necessary, in further assuring that the Government will receive the best value for its dollars.
