c. In Part I, The Schedule, Remove Section 01 33 00 Submittals in its entirety, and substitute therefor with the attached revised Section 01 33 00 Submittals.

4) Submission of Proposals:
In accordance with Section L, WBR 1452.215-81, Proposal Instructions—Bureau of Reclamation, this amendment reiterates proposals shall be emailed to Contracting Officer Darlene Dillon at the following email address: DDillon@usbr.gov. Offerors shall submit one
(1) electronic copy of their proposal with separate Volumes. Due to the potential large electronic file size of proposals, submission of proposals is acceptable with multiple emails, whereby each submission is suggested to be identified as Email 1 of 4 (Volume I), Email 2 of 4 (Volume II), Email 3 of 4 (Volume III), and Email 4 of 4 (Volume IV). Proposals sent via hard copy to the Bureau of Reclamation will not be evaluated or considered for award and will not be returned to the sender/offeror.
5) Closing Date and Time for Submission of Proposals
The closing date for submission of proposals is hereby extended to Thursday, June 5, 2025, at 2:00 PM (Mountain Daylight Time-Denver)/3:00 PM (Central Daylight Time-Oklahoma City).

Questions and Responses:
1. Question: What is the anticipated start date for the project: Is it next Fall or Winter?
Response: The onsite start date for the project is anticipated for late Fall/early Winter 2025 (after Labor Day), however, it is dependent upon the following:
Immediately upon award of the contract, the contractor shall submit Performance and Payment Bonds and a Certificate of Liability to the Contracting Officer.
Upon receipt and acceptance of the Performance and Payment Bonds and Certificate of Liability, a Notice to Proceed will be issued and a Preconstruction meeting will be scheduled/held. The actual on-site start/mobilization date depends upon receipt and acceptance (approval) by the Government of submittals required prior to mobilization.
2. Question: Who will maintain and mow the park area at the project location during the construction?
Response: The Oklahoma Tourism Recreation Department (OTRD) is responsible for maintaining the park during construction.
3. Question: Since this is a State Park as well as the part of the Federal Lands, are there any Department of Environmental Quality (DEQ) or other state permits required?
Response: Please refer to Specification Sections 01 57 20 Environmental Controls, 01 57 30 Water Pollution Controls, and FAR 52.229-3 Federal, State, and Local Taxes.
4. Question: Who has the authority to remove and reinstall the State Park’s parking signage?
Response: The contractor must coordinate with the Contracting Officer Representative (COR) prior to disturbing any item not marked on the drawings for demolition or documented in the specifications.
5. Question: How long of a period of time after this meeting do contractors have to ask questions? When are the answers to the meeting questions going to be posted?
Response: Please refer to Paragraph 3 above/on page 2 of this amendment, which is titled, “Questions and Responses.”
6. Will the existing water hydrant near the Group Shelter be completely removed at the time the new water hydrant at the Group Shelter is installed?
Response: Yes, the contractor is responsible for removing the water hydrant.
7. Can the tree root at the Group Shelter, crossing the future water line for the new water hydrant, be excavated through during the new water line construction?
Response: Yes, but care should be taken to minimize tree root disturbance.
8. Question: In Section 13 34 30 Playgroup there is no spec on the playground mulch. Will it need to be IPEMA Certified Playground Mulch?
Response: Please refer to the revised Section 13 34 30 Playgroup incorporated in this amendment.
9. Questions: Would it be possible to provide a separate PDF of the drawings in a higher quality PDF file on 11x17. The small ones in the RFP when we expand and print are very hard to read.
Response: A pdf file of 11 x 17 drawings is attached as a separate file to this Amendment No. 0001. There are no changes to the drawings provided in the original solicitation.

1.05 SUBMITTALS PROCEDURES
A. Submit only checked submittals. Submittals without evidence of Contractor's approval will be returned for resubmission.
B. Submit complete sets of required materials for each RSN as specified in “Submittals Required” column in Table 01 33 00A - List of Submittals. A complete set includes all listed items for RSNs with multiple parts.
C. Submit number of sets specified in “Sets to be sent to:” columns in Table 01 33 00A - List of Submittals.
1. Electronic submittals:
a. In Portable Document Format (.pdf).
b. Include RSN transmittal letter.
c. Do not include Personally Identifiable Information (PII) in electronic submittals.
d. Submittal method (size based):
1) Government can receive e-mails up to 10 MB. Receipt of e-mails exceeding 10 MB (extra-large) may be possible. E-mailing of extra-large electronic submittals may occur only after size limit for transmittal of extra-large email has been verified.
2) Electronic media for submittals too large for e-mail: CD or DVD.
D. Include the following information in transmittal letters:
1. Contract number and title.
2. RSN for each attached submittal.
3. Responsible code.
4. Number of sets for each RSN.
5. Identify submittal as initial or resubmittal.
E. Resubmittal of submittals not approved:
1. Mark changes such that they are readily identifiable and show revision date.
2. Describe reasons for significant changes in transmittal letter.

1.06 REVIEW OF SUBMITTALS
A. Time Required:
1. Submittal review will require 28 days for review of each submittal or resubmittal, unless otherwise specified.
2. Time required for review of each submittal or resubmittal begins when complete sets of materials required for a particular RSN are received and extends through return mailing postmark date.
B. Time in Excess of Specified:
1. CO may extend contract completion date to allow additional time for completing work affected by excess review time.
a. Time extension will be to extent that excess review time caused delay to contract completion date.
b. Time extension will not exceed time used in excess of specified number of days for review of submittals or resubmittals.
c. Concurrent days of excess review time resulting from review of 2 or more separate submittals or resubmittals will be counted only once in extending contract completion date.
2. No time extension will be allowed if Contractor fails to make complete action submittals in sequence and within time periods specified.
3. Adjustment for delay will be made only to extent that:
a. Approval was required under contract,
b. Requests for approval were properly and timely submitted and were approved.
4. Adjustment will be subject to terms of paragraphs (b) and (c) of the clause at FAR 52.242-14, Suspension of Work; however, no such delay shall be deemed to be a “suspension order” as the term is used in that clause.
C. Submittal response:
1. Response letter will indicate whether submittal is approved, approved subject to identified changes, or not approved.

1.03 SUBMITTALS
A. Submit the following in accordance with Section 01 33 00 - Submittals.
B. RSN 13 34 30-1, Approval Drawings and Data:
1. Project-specific shop drawings.
a. Show building layout and dimensions; type, grade, size, and thickness of materials.
b. Include an anchor bolt plan which shows size, location, and projection of anchor bolts.
c. Manufacturer’s standard or typical drawings may be included to show details. Mark standard or typical drawings to indicate relevant details.
d. Sign and seal by design engineer.
2. Manufacturer’s product data. Include complete descriptions of and specifications for building system and materials.
3. Design data showing magnitude and direction of column reactions at base of each column. Sign and seal by design engineer.

1.04 DELIVERY, STORAGE, AND HANDLING
A. Handle, store, and protect equipment and materials to prevent damage before and during installation in accordance with the manufacturer’s recommendations.

PART 2 PRODUCTS
2.01 Playgroup
A. Playgroup with the following essential characteristics and as provided in Section 01 33 00 - Submittals:
1. To have playgroup border as shown in drawing 763-514-1459.
2. Footings, anchoring and placement to account for electrical utility line crossing the playgroup site and tree locations surrounding the playgroup site.
3. To have proper separation between underlying sloped grade and chip fill.
4. To have proper thickness of chip fill.
5. Features to match and be positioned in relation to Concrete Fan Access installed by Contractor.
6. To allow for drainage off site.
7. Color pallet shall match the playgroup at Breakwater Bay Day Use area which is shown in the photo below.
8. Fabrication:

a. Support posts shall be designed such that the posts will receive and secure the support beams.
b. Structural welds performed by welders certified to AWS D1.1. Welding inspector on staff.
c. All welding is to be done in accordance with latest AWS standards. If welds are not specified, all welds are to develop full strength of all component parts.
d. Decking shall be designed with interlocking members with mechanical fasteners.
e. Water shall drain from all surfaces.
f. All structural components fully fabricated to eliminate the need for drilling, cutting, or welding on site.

B. Playgroup Mulch
1. Material Requirements:
a. Type: The mulch shall be made from natural wood, free from harmful chemicals, and shall not contain any treated wood or materials that could pose a risk to children.

b. Certification: The mulch must be certified by IPEMA, indicating it meets the ASTM F1292 standard for impact attenuation and ASTM F2075 for wood fiber products.
c. Color: The mulch shall be natural in color or dyed with non-toxic, environmentally friendly dyes. The color should be consistent throughout the material.
2. Physical Properties:
a. Particle Size: The mulch shall consist of particles ranging from 1 inch to 3 inches in length, with a thickness of approximately 1/2 inch to 1 inch.
b. Moisture Content: The moisture content of the mulch shall not exceed 15% at the time of delivery.
c. Weight: The mulch shall have a minimum weight of 600 pounds per cubic yard when dry.
3. Performance Requirements:
a. Impact Attenuation: The mulch must provide adequate impact attenuation to reduce the risk of injury from falls. The material shall be tested in accordance with ASTM F1292 and must demonstrate a critical fall height rating suitable for the intended playground equipment.
b. Decomposition Resistance: The mulch shall be resistant to decomposition and should maintain its integrity and performance characteristics for a minimum of 5 years under normal usage conditions.
PART 3 EXECUTION
3.01 INSPECTION
A. Confirm that the surrounding area is ready for the shelter installation.
B. Installer shall confirm dimensions and elevations to be as shown on drawings provided by manufacturer.
C. Erection shall be scheduled after all concrete and masonry in the area is completed.
3.02 INSTALLATION
A. Installation shall be in strict accordance with manufacturer’s shop drawings.
B. Concrete anchors shall be cut flush with top of nut and tack welded.

C. After installation, shelter and playgroup shall be left in a clean condition.
D. Playground mulch shall be installed to a minimum depth of 12 inches.
3.03 REPAIR
A. Prefinished Materials:
1. Touch-up paint minor scratches and abrasions to finish in accordance with manufacturer’s instructions. Use matching paint furnished by manufacturer.
Replace materials with damaged finish detrimental to appearance.
B. Playground Mulch shall be regularly maintained to ensure it remains at the specified depth and is free from debris, weeds, and other contaminants by the contractor until the contractor receives the substantially complete letter.

Section E – Inspection and Acceptance
E.1 52.246-12 Inspection of Construction Aug 1996
(a) Definition."Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.
(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.
(c) Government inspections and tests are for the sole benefit of the Government and do not-
(1) Relieve the Contractor of responsibility for providing adequate quality control measures;
(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;
(3) Constitute or imply acceptance; or
(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this- section.
(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer’s written authorization.
(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary.
The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.
(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.
(g) If the Contractor does not promptly replace or correct rejected work, the Government may-

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or
(2) Terminate for default the Contractor’s right to proceed.
(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction.
However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.
(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government’s rights under any warranty or guarantee.
E.2 52.246-13 Inspection-Dismantling, Demolition, Aug 1996 or Removal of Improvements
(a) Unless otherwise designated by the specifications, all workmanship performed under the contract is subject to Government inspection at all times and places where dismantling or demolition work is being performed. The Contractor shall furnish promptly, and at no increase in contract price, all reasonable facilities, labor, and materials necessary for safe and convenient inspection by the Government. The Government shall perform inspections in a manner that will not unduly delay the work.
(b) The Contractor is responsible for damage to property caused by defective workmanship.
The Contractor shall promptly segregate and remove from the premises any unsatisfactory facilities, materials, and equipment used in contract performance, and promptly replace them with satisfactory items. If the Contractor fails to proceed at once in a workmanlike manner with performance of the work or with the correction of defective workmanship, the Government may-
(1) By contract or otherwise, replace the facilities, materials, and equipment or correct the workmanship and charge the cost to the Contractor; and
(2) Terminate for default the Contractor’s right to proceed. The Contractor and any surety shall be liable, to the extent specified in the contract for any damage or cost of repair or replacement.

Section F – Deliveries or Performance
F.1 52.211-10 Commencement, Prosecution, and Completion of Work Apr 1984 The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed,
(b) prosecute the work diligently, and
(c) complete the entire work ready for use not later than 365 calendar days. The time stated for completion shall include final cleanup of the premises.
F.2 52.211-18 Variation in Estimated Quantity Apr 1984 If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
F.3 52.242-14 Suspension of Work Apr 1984
(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.
(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1)by an act of the Contracting Officer in the administration of this contract, or (2)by the Contracting Officer’s failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.
(c) A claim under this clause shall not be allowed-

(1) For any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and
(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

G – Contract Administration Section Data
G.1 1452.201-70 Authorities and delegations Sep 2011
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.
G.2 WBR 1452.201-80 Contracting Officer’s Representative’s Authorities May 2018 and Limitations
a) Performance of the work under this contract shall be subject to the technical direction of the Reclamation Contracting Officer's Representative (COR). The term “technical direction” is defined to include, without limitation:
(1) Inspecting and accepting or rejecting work performed under the contract.
(2) Representing the Government in technical phases of the work. The COR is responsible for the technical administration of the contract and will provide instructions and interpretations to the Contractor on all technical matters relating to the contract. The COR will supervise or oversee all Government technical and administrative personnel assigned to assist the COR.
(3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government.
(b) The Contractor will receive a copy of the written COR designation from the Contracting Officer. It will specify the extent of the COR's authority to act on behalf of the Contracting Officer.
(c) Technical direction must be within the scope of work stated in the contract. Only the Contracting Officer is authorized to determine if a change is within the scope of the contract;
therefore, the COR does not have the authority to, and may not, issue any technical direction that
(1) Constitutes a direction of additional work outside the Contract requirements;
(2) Constitutes a change as defined in the contract clause entitled “Changes;”
(3) In any manner causes an increase or decrease in the total contract cost, or the time required for contract performance;
(4) Changes any of the expressed terms, conditions or specifications of the contract; or
(5) Interferes with the Contractor's right to perform the terms and conditions of the contract.
(d) All technical direction shall be issued in writing by the COR.

(e) The Contractor must proceed promptly with the performance of technical direction duly issued by the COR in the manner prescribed by this clause and within its authority under the provisions of this clause. If, in the opinion of the Contractor, any instruction or direction by the COR falls within one of the categories defined in (c)(1) through (c)(5) of this clause, the Contractor must not proceed and must notify the Contracting Officer in writing within five (5) working days after receipt of any such instruction or direction and must request the Contracting Officer to modify the contract accordingly. Upon receiving the notification from the Contractor, the Contracting Officer must -
(1) Advise the Contractor in writing after receipt of the Contractor's letter that the technical direction is within the scope of the contract effort and does not constitute a change under the Changes clause of the contract; or
(2) Advise the Contractor that the Government will issue a written change order.
(f) A failure of the Contractor and Contracting Officer either to agree that the technical direction is within the scope of the contract or to agree upon the contract action to be taken with respect to the technical direction will be…
