G.4 DOI AAAP-0050 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM
DECEMBER 2015
1) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior
(DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation.
One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.
2) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
3) We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award.
Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official (AO). Information in the report must be protected as source selection sensitive information not releasable to the public.
4) When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.
5) Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.
a) Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment.
b) Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.
c) All information provided should be reviewed for accuracy prior to submission.
d) If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.
e) Your response is due within 60 calendar days after receipt of the CPAR. On day 15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.
f) If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."
6) The following guidelines apply concerning your use of the past performance evaluation:
mailto:mprelle@usbr.gov mailto:ippgroup@bos.frb.org https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2042_15.html https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2042_15.html https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2042_15.html https://www.cpars.gov/ https://www.cpars.csd.disa.mil/ https://www.cpars.gov/
a) Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.
b) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
c) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.
7) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.
8) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.
G.5 WBR 1452.242-80 POST AWARD CONFERENCE BUREAU OF RECLAMATION JULY 1993
(a) Prior to the Contractor starting work, a post award conference (as described in FAR Subpart 42.5), will be convened by the contracting activity or contract administration office. (1) Inspecting and accepting or rejecting work performed under the contract.
(2) Representing the Government in technical phases of the work. The COR is responsible for the technical administration of the contract and will provide instructions and interpretations to the Contractor on all technical matters relating to the contract. The COR will supervise or oversee all Government technical and administrative personnel assigned to assist the COR.
(3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government.
(b) The Contractor will receive a copy of the written COR designation from the Contracting Officer. It will specify the extent of the COR's authority to act on behalf of the Contracting Officer.
(c) Technical direction must be within the scope of work stated in the contract. Only the Contracting Officer is authorized to determine if a change is within the scope of the contract; therefore, the COR does not have the authority to, and may not, issue any technical direction that -

If, in the opinion of the Contractor, any instruction or direction by the COR falls within one of the categories defined in (c)(1) through (c)(5) of this clause, the Contractor must not proceed and must notify the Contracting Officer in writing within five (5) working days after receipt of any such instruction or direction and must request the Contracting Officer to modify the contract accordingly. Upon receiving the notification from the Contractor, the Contracting Officer must -
(1) Advise the Contractor in writing after receipt of the Contractor's letter that the technical direction is within the scope of the contract effort and does not constitute a change under the Changes clause of the contract; or
(2) Advise the Contractor that the Government will issue a written change order.
(f) A failure of the Contractor and Contracting Officer either to agree that the technical direction is within the scope of the contract or to agree upon the contract action to be taken with respect to the technical direction will be subject to the provisions of the clause entitled “Disputes.”

SECTION H -- Special Contract Requirements
H.1 DOI-AAAP-0050 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM
DECEMBER 2015
1) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation.
5) Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at: https://www.cpars.gov/.
a) Contractor Representatives may then provide comments in response to the evaluation or return the evaluation without comment.
b) Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.
c) All information provided should be reviewed for accuracy prior to submission.
d) If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.
e) Your response is due within 60 calendar days after receipt of the CPAR.
6)The following guidelines apply concerning your use of the past performance evaluation:
a) Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.
b) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
c) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.
https://www.cpars.gov/
7) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.
8) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.
H.2 ORDERING PROCEDURES – AVC MATOC FOR REALTY SERVICES JUNE 2022
Ordering Procedures – AVC Multiple Award Task Order Contract (MATOC) For Realty Services
1. General Information: During the ordering period of this MATOC, Task Orders (TO’s) placed under this MATOC will be issued and competed in accordance with (IAW) Federal Acquisition Regulation (FAR) 16.505 and its agency supplements as applicable. Unless otherwise specified in individual Fair Opportunity Proposal Request (FOPRs), the following guidance defines the process by which fair opportunity will be afforded and how TO’s will be evaluated and awarded.
Orders processed under this MATOC will be centralized, meaning only the officially assigned Contracting Officer (CO) or Contract Specialist (CS) for this MATOC may solicit active MATOC holders for requirements and administer the resulting TO’s. Orders may only come from the assigned CO assigned to the cognizant Reclamation Acquisitions Management Division (AMD) office. All contract clauses contained in the MATOC basic awards shall be considered incorporated in each FOPR unless otherwise specified in the individual FOPR, the MATOC language shall take precedence.
The minimum guarantee for the basic MATOC post-award deliverable is $2,500.00.
2. Scope & Pricing: See main PWS section 4.0 for full possible scope of individual TO’s. TO’s may include any number of parcels, any stage of tasks (1-18 in PWS section 4.0) identified in PWS section 4.0, and any mix of tasks identified in PWS section 4.0. Meaning, TO’s may include different parcels all at different stages, and the contractor should expect to perform any range of tasks in PWS section
4.0 for multiple properties/easements/Right of Way’s (ROW’s). Ensure Certified Federal Surveyors (CFedS) are employed when applicable as identified in PWS paragraph 4.3.3, and MATOC evaluation factor 1.b.
Pricing Arrangements: TO’s may be awarded as Firm-Fixed-Price (FFP), Fixed Price (FP) with Economic Price Adjustment (EPA), FP with Time & Materials (T&M) or Labor Hours mixed (FP w/ T&M for portions), and multiple mixes of the pricing arrangements listed as needed per TO. T&M is not expected often and shall not be a majority of each TO. It is intended for items that cannot be accurately estimated. TO’s will be a majority FFP or FP w/ EPA. When a FP w/EPA TO is issued, clause I.4 shall be included in the TO. The portion of each CLIN subject to EPA adjustment will be identified upon solicitation of the TO. For example, Task 001 - $100,000.00, fuel is 10% of the CLIN estimate, therefore $10,000.00 (10% of $100,00.00) would be subject to the EPA adjustment and the fuel price per gallon will be documented at time of award. A separate fuel only CLIN will not be established.
3. Fair Opportunity Process: For each order, the CO or CS will initiate the FOPR process by providing a FOPR letter and associated attachments to each prime contractor that holds a current MATOC. The contractor shall evaluate the FOPR and submit a proposal in response to the request. Formats of the FOPRs and contents are subject to change based on the requirements of the TO.
The FOPR will include, at a minimum, the following information (unless the CO determines that an exception to fair opportunity processes exists, as set forth in para. 4 below):
a. Date of Announcement
b. Proposal due date
c. Instructions for proposal submissions
d. Performance Work Statement (PWS) or Statement of Objectives (SOO)
e. Anticipated contract type/pricing structure of the resultant TO
f. Anticipated CLIN structure
g. Contact information for proposal submittal
h. Evaluation criteria and factors for award
i. Associated attachments, Government Furnished Information, and Drawings as applicable
4. Selection Criteria for Awarding Orders: The government intends to award to the contractor(s) based on the following methodologies depending on the individual order details: Lowest Price Technically Acceptable (LPTA), Trade-Off process, price and past performance only, or in rare situations oral quotes may be utilized due to urgency but are not foreseen, and any other reasonable method allowable based on the TO details. The government will evaluate the proposals against the established selection criteria in each individual FOPR.
5. Market Research/Outreach and Draft Packages: The government may draft packages and PWS’ for contractor comments before a formal FOPR is issued. Contractors are encouraged to review and respond to the draft packages as the comments are what will be used to tailor the FOPRs to the MATOC holders. Responses to drafts are not required but are helpful in ensuring that a complete FOPR is issued by the agency to the contractors. If used, the government will state that the notice is a draft seeking comments for future FOPR issuance and that it is requesting comments from industry. Details will be included in each individual draft notice.
6. Proposal Process: The CO or CS will issue a FOPR to all contractors holding a current MATOC. The amount of time for proposal submission will be based on the complexity and urgency of the requirements. The Contractor’s proposal shall be submitted to the ordering CO or CS on or before the time and date specified in the FOPR letter. Pricing on order proposals shall be valid for a minimum of 90 calendar days after the required submission date unless specified otherwise in the individual FOPR.
General Proposal Process Description: Each FOPR should clearly describe all the services and tasks to be performed so the contractor can accurately estimate the cost of the project. If the contractors are unsure of the requirements, please contact the CO/CS to ask for clarifications and information and if possible, the missing information will be provided. The government shall use performance-based work statements to the maximum extent practicable describing the end results desired vs. the methodology of work to allow the contractor to describe how best to perform the tasks. Contractor proposal requirements/submission requirements shall be kept to a minimum as much as practicable. Minimum order amount will be no less than $2,500.00 and no more than $500,000.00 estimated.
Orders under or over these amounts may be agreed to but are not required. FOPRs may be sent out for varying amounts of time, more time will be given for more complex orders. However, generally FOPRs will be out for a minimum of 30 days, unless urgent circumstances exist that would justify shorter response times, including the potential use of oral quotes though it is not expected to use this method if avoidable.
The individual FOPR will stipulate the response times, include all pertinent attachments and performance criteria, state the selection criteria and evaluation methodologies, state any evaluation weighting if used, the minimum proposal contents, estimated period of performance, the tasks needing completed and expected timeframe of completion, and any information the government has for the requirements. Proposals will generally be expected within 30-60 days of FOPR issuance unless otherwise stated in the individual FOPR.
The proposals will be sent to the technical team that will evaluate the proposals IAW the evaluation criteria sent in the FOPR. The CO/CS will select the awardee based on the technical evaluation results.
Selection of the successful awardee will generally be announced within 15 calendar days from receipt of final proposals. If negotiations are entered into the negotiation phase should generally be complete within 15 days and require submittal of a ‘best and final offer’ (BAFO) if requested. Debriefings will generally not be held but the government team will make notifications and give feedback if able on how to improve FOPR proposals and potentially improve the likelihood of receiving future awards. Successful awardee shall start performance as stipulated in the TO received with the award notification.
7. Proposal Costs: Costs for the preparation of task order proposals and pre-award task order activities shall be the sole responsibility of the offeror. Offerors will not be reimbursed for any task order proposal costs, site visits if ever required, negotiation attendance if ever used, or any other pre-award task order activities or expenses.
8. Cancelling FOPR: The ordering CO or CS reserves the right to withdraw or cancel the proposed FOPR package. In such event, offerors will be notified via letter or email of the ordering CO’s or CS’ decision.
9. Participation & ‘No-Bid’: MATOC holders are expected, in good faith, to participate in FOPR competitions.
The government’s intent is to maintain a pool of interested contractors to propose on its requirements for realty services through positive incentives and not negative consequences, and for each contractor in the pool of MATOC holders to receive a meaningful amount of work. If a contractor chooses to ‘no-bid,’ the contractor must prepare a ‘no-bid’ letter and submit it to the CO and CS. The purpose of the requested ‘no-bid’ letter is to allow the government to better prepare its FOPR requirements in a way that allows all contractors to receive meaningful work and remain engaged throughout the life of the MATOC. The government will also consistently strive to improve the process, if possible, based on contractor provided feedback, to allow proposals to be streamlined and as low a burden as possible to the contractors, while still allowing the government to ensure the task is fully understood.
‘No-Bid Letter’ Contents: 1) Contractor Name & Address, 2) FOPR Project Title, 3) Rationale for ‘no-bid’, 4) Suggestions to improve FOPR process to allow thorough competition (without steering to one contractor – recommendations cannot purposely eliminate other contractors in the MATOC pool), and 5) List of items that could have been changed in the FOPR that may have led to the contractor proposing on the project.
10. Only One Proposal Received: In the event only one proposal is received, the government may revalidate the FOPR requirement. The validation process may include exchanges with offerors to determine whether there are concerns with the requirements, this process should include review of any ‘no-bid’ letters received. Should the requirement be validated, the ordering CO/CS may reissue the FOPR package to the pool of MATOC holders. After the government revalidates the FOPR requirement and if only one proposal is still received, the government reserves the right to cancel the FOPR or award the TO to the offeror that proposed, at the government’s discretion based on the circumstances of the FOPR.
11. Unauthorized Work: The contractor is not authorized at any time to commence TO performance prior to issuance of a signed TO, or other written approval provided by the CO/CS to begin work.
12. Initial Order: Each awardee will receive an initial order to provide a post-award presentation to the ECAO customer office. The successful offeror of the seed task shall include the briefing in its performance of the initial Task Order. The unsuccessful offerors shall present its capabilities to the government as its first task. The presentation may be in-person if allowed, using Microsoft Teams, or the use of an otherwise approved remote delivery method that allows government personnel attendance. Presentation shall be in accordance with the Seed Task section of the solicitations section L&M.
13. Protest: IAW FAR 16.505(a)(10)(i) and (ii) no protest under FAR subpart 33.1 is authorized in connection with the issuance or proposed issuance of an order under a task-order contract or delivery-order contract, except for a protest on the grounds that the order increases the scope, period, or maximum value of the contract; or a protest of an order valued in excess of $25 million (10 U.S.C.
2304c(e)). Protests of orders in excess of the thresholds stated in FAR 16.505(a)(10)(i)(B) may only be filed with the Government Accountability Office, in accordance with the procedures at FAR 33.104.
