Amendment 2 incorporates Wage Determination "General Decision Number: NM20210032 02/26/2021” as attached, provides answers to questions, and provides pictures.
Questions / Answers
1. Has a Hazardous/Biological Materials survey be conducted on the facility for the area of work? If so, can bidders get a copy of this report? No survey conducted.
2. If a Hazardous/Biological survey has not been conducted, are we to include the cost in our bid proposal? It is not anticipated that a survey is necessary.
3. If Hazardous/Biological materials such as asbestos, lead, bat guano, bird droppings or rodent feces/urine(Hantavirus) are discovered, will this be done as a modification? If hazardous or biological material is discovered, we think it would be best to treat as a contract modification.
4. Section B.-Price Schedule states “For items 1 through 2, please provide a detailed listing for each to include labor categories, labor rates, material and equipment listing and associated rates.” Could you please provide a guidance example format template? Provide enough detail to support prices for items 1 and 2, such that the government can establish fair and reasonable pricing.
5. Section 2.6 Scope item states “Clean and remove all debris from the attic.” The attic space between the roof and sheetrock attic envelope was not accessible during site visit. Is debris implying existing insulation in the attic? All debris created during removal of the shingles, underlayment and sheathing. Wood, nails, underlayment, etc. that falls on the attic envelope.
6. Section 2.6 Scope item states “Insulation: Furnish and install R-30 rolls of Owens Corning fiberglass insulation in the attic.”
a. Is the intention to insulate between the rafters (Underneath roof deck sheeting)?
or
b. Is the intention to insulate between the in the ceiling joists and over/around the sheetrock attic enclosure?
c. In ether case of a or b above, assuming the insulation is craft faced, its industry practice to install craft face to the heated/cooled side, but for cost reduction of installation, would BOR consider allowing craft face to be installed on the non-heated/cooled side?
When the SOW was written, I was not known that there was existing insulation between the ceiling and the attic space. It is not known if the existing insulation is damaged by leaks in the roof. Insulation can easily be replaced on the north and south sides of the building at anytime. We do not think it is necessary to insulate between the attic envelope and sheathing. This SOW item may want to be removed by the Project Manager.
7. Will the flashings and ridge vents remain factory galvanized finish or will it need to be painted to match adjacent surface color? Flashings and ridge vents should be painted to match adjacent surface color.
8. Are we to assume no work required for gutters? The existing require no work and care should be taken not to damage.
9. Section 5.0 Scope item states “Contractor is responsible for the security of all equipment and materials on site.” What is the location of contractor laydown area to erect a security fence? The PM can coordinate with the management company where the contractor may erect a security fence.
10. Section 5.1 Scope items states “Remove existing roof system and replace deteriorated roof structural members.” Does BOR have a quantity for Contractor to bid this unknown item?
There is not anticipated damage. If structural members are discovered to be damaged then BOR will need to access and a general contractor may need to be brought in to complete the work.
11. Section 6.1 Scope item states “If Reclamation personnel are not available during the contract period of performance or access by contractor’s employee(s) are required in sensitive or restricted facilities or data, the Contractor shall have background checks on all employees required in the performance of work task.” This is a general section in the boilerplate SOW.
a. Are there and if there is, where are the sensitive or restricted facilities or data on this project? No sensitive or restricted facilities or data
b. Will Reclamation personnel be available for the entire duration of the project to escort the contractor personnel? Escort not required
c. If contractor is to get personnel background check, can it be one-two cleared employee watch non-cleared employees or does entire employees need background check? No background checks necessary.
d. What level security clearance of background check will be required? Level 1-Non Sensitive, Level 5-Public Trust, etc.? No background checks necessary.
e. Will the submission and cost of background checks be by BOR or Contractor? No background checks necessary.
12. Section 7.2 Scope item states “The use of water closet(s) will be at the discretion of the Facility Manager.” Can these facilities be used? Project manager should coordinate with Management company.
13. Section 7.3 Scope item states “Contractor shall submit As-Built drawing according to the United States National CAD Standards-Version 6.0” There are no drawings with this solicitation to As-Built, what is require of this section? This is a general section in the boilerplate SOW. No as built drawings will be required.
14. Is the project considered Federal Property exempt from New Mexico Construction Industries Division (NMCID) and a permit to reroof is not required? A permit will be required in accordance with state and local guidelines.
15. There is no roofing wage rate in the wage rates solicitation – Amendment 2 incorporates Building Wage Determination "General Decision Number: NM20210032 02/26/2021” which list’s wage rate for roofer - see attached.
16. Is 3/4'' plywood to be used or 7/16'' OSB. ¾” plywood is what is specified in the SOW and what is to be used.
17. Does the R-30 batt insulation need to be OC or equal? Owens Corning brand R-30 insulation is specified in the SOW but an equal may be used if the equal is approved by the COR as a submittal
18. Is the any LD? If LD stands for lead, it is anticipated that there is no lead or any other hazardous materials. If LD stand for liquidated damages, there are no liquidated damages for this requirement.
19. Does it take a new facia board around perimeter? There is not one in place Facia board is not specified in the SOW and not required as of now.
20. Does it take new gutter and downspouts or reuse existing? If new will it be pre-finished and what gauge? The existing gutters are to be used and care is to be taken if/when handling so as not to damage.
21. In the solicitation pg 7 under 2.6-Scope, the roofing underlayment ''Dupont Tyvek Protec 22 is not a Owens Corning brand. Is this what to be used? And is it a self-adhering Dupont Tyvek Protect 200 is what is specified in the SOW and is what is to be used. It is not self-adhering, the ASTM1970/D1970M standard in the SOW is for steep slope roof which this roof does not meet the requirements of. Installation will be as per the manufacturer’s recommendations.
22. Is it just a standard 30 yr shingle warranty? Yes, warranty information should be submitted as specified in the Submittal Table in the statement of work. (RSN - S8)
23. Are ridge vents to be continuous. Ridge vent decisions should be made by PM or EB staff. Being that the attic is finished it may not be beneficial to install continuous or box vents. There are gable shutter vents on N and S of the building that vent the attic.
24. Are there any pictures you can share? See attached pictures.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this https://sam.gov/wage-determination/NM20210032/2 5/6 classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests https://sam.gov/wage-determination/NM20210032/2 6/6 for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
