About this file

This document is an Amendment (No. 0003) to Solicitation No. 140R2025Q0055 for the Battle Creek Salmon and Steelhead Restoration Project, Phase 2 Environmental Compliance and Support Services. The amendment, issued by the Bureau of Reclamation's Mid-Pacific Region, provides responses to 20 pre-proposal contractor questions and modifies the solicitation details. Key changes include extending the quote due date from August 01, 2025, 3:00 P.M. PST to August 06, 2025, 9:00 A.M. PST, and incorporating a Questions and Answers attachment (Attachment 5).

The amendment clarifies several project-specific details, such as the project's total river mile span (48 miles, with Phase 2 covering approximately 19 river miles), confirmation of protocol-level preconstruction surveys, and environmental monitoring requirements. Notable responses address topics including cultural monitoring (to be conducted by Reclamation archeologists), vegetation clearing expectations, construction contractor arrangements (likely two different contractors), and environmental compliance aspects like fish rescue plan preparation, fencing installation responsibilities, and biological permitting (USFWS and NMFS Biological Opinions have been acquired under the Endangered Species Act Section 7).

Title: Battle Creek Salmon and Steelhead Restoration Project, Phase 2 Environmental Compliance and Support Services

Solicitation No. 140R2025Q0055 Amendment No. 002003

Pre-Proposal Contractor’s Questions

No. Questions and Responses

1. May we review the 404 permit for this project?

Response: A copy of the authorized CWA Section 404, Nationwide Permit for South Diversion Dam/South Canal is included in this amendment.

2. Does the 48 river miles figure refer specifically to the Phase 2 project limits, or does it represent the total length of the overall restoration project, including Phases 1A, 1B, and 2? If it refers to the overall project, what is the river mile length for Phase 2 alone?

Response: The Battle Creek Salmon and Steelhead Restoration Project (Restoration Project) spans a total length of 48 miles, including Phases 1A, 1B, and 2. Phase 2 focuses on the restoration of South Fork Battle Creek, covering approximately 19 river miles from its confluence with main stem Battle Creek to the limit of anadromy at Panther Grade Falls.

3. The scope notes that preconstruction surveys were completed for the South Dam and Canal Removal Project. Were these protocol-level surveys or general clearance surveys?

Response: The completed preconstruction surveys were protocol-level surveys.

For details, refer to the Performance Work Statement (PWS) Attachment 3 – Restoration Project Environmental Implementation Plan, Volume 1.

4. In Attachment No. 2, on page 18 under South Dam and Canal Removal Construction, the boxes under Task 1a Preconstruction Survey are greyed out for Jan–Mar and Apr–Jun. Do these indicate that clearance surveys are not required because preconstruction surveys have already been completed for the dam and canal?

Response: No, preconstruction surveys are separate from clearance surveys, as described in the PWS Task 1A requirements. For more details, refer to the

PWS Attachment 3 – Restoration Project Environmental Implementation Plan. Generally, the greyed-out cells indicate the timeframe to conduct the relevant subtasks in alignment with the expected construction schedule.

5. Is the Environmental Contractor responsible for cultural monitoring under this contract?

Response: The Phase 2 project sites have been surveyed and archeological cleared. Reclamation archeologist will conduct cultural monitoring, if needed.

6. Does the WEAT (Weekly Environmental Awareness Training) require Spanish translation?

Response: No.

7. Are preconstruction or clearance surveys required for the access roads?

Response: Surveys shall encompass all identified project/contractor use areas, including the identified private access roads, but excluding public roads.

8. For biomonitoring purposes, could you please confirm the project limit areas for the South Diversion Dam and South Canal Removal Construction, as well as for the Coleman Diversion Dam Removal Construction, including all associated access roads?

Based on the information provided in the 404 Permit, we have assumed that the project site area for the South Diversion Dam/South Canal project is 59.70 acres.

Please let us know if this assumption is correct and if similar acreage details are available for the Coleman Dam Removal site.

Response: The South Diversion Dam and South Canal Removal Construction Contract covers a total area of approximately 60.54 acres, including the South Diversion Dam/South Canal site (59.70 acres), Soap Creek Feeder Diversion Dam (0.37 acres), and Lower Ripley Creek Feeder Diversion Dam (0.47 acres).

Additionally, a separate construction contract will address the Coleman Dam Removal, which encompasses the Coleman Diversion Dam site (6.00 acres).

Refer to the Performance Work Statement, Attachment 3 – Restoration Project Environmental Implementation Plan, which includes figures of the contractor use areas where environmental monitoring to occur, see pages 136- 144 and 167-193.

9. For scope item 1.E, would the contractor or subcontractors be precluded from providing mitigation (under a separate contract) if determined that wetland (or other) mitigation is required?

Response: Reclamation expects the Coleman Diversion Dam removal work to qualify under the CWA Section 404 Nationwide Permits (NWP) 27 and 33 where compensatory mitigation is not required under NWP 27. However, if consultation with U.S. Corp of Engineers determines that mitigation is required, a bilateral modification to the existing environmental service contract shall be executed to commit the mitigation funds and enabling the Contractor to make the mitigation payment on behalf Reclamation.

10. Are the labor categories listed grouped in a way that one individual would be able to qualify for multiple requirements? For **example**, if we determine that our Wetland Specialist is also able to perform the Botanist/Plant ecologist scope, would the government allow for those task items to be consolidated under one individual in a dual-hatted role when the tasks can be conducted simultaneously?

Response: Yes, if the individual possesses the appropriate education, training, and credentials to fulfill the multiple task requirements.

11. Is the contractor that authored the Environmental Implementation Plan (EIP - Attachment 3) precluded from bidding or subcontracting on this implementation scope due to Organizational Conflict of Interest?

Response: No, the contractor that authored the EIP - Attachment 3 is not precluded from bidding or subcontracting on this implementation scope. The Government ensures that all interested offerors receive the same information, thereby maintaining fairness in the bidding process.

12. Could the potential “discouraging nesting” task item under task 1A be included as an additional line item on Option year 1, or otherwise should task 1A pricing be estimated as if this is expected to occur?

Response: Reclamation expects the "discouraging nesting" task to occur only during the Construction Contractor's first clearing season, which falls within the Environmental Contractor's Base Year.

13. Will a new Fish Rescue Plan need to be prepared for Phase 2 (draft and final)?

Response: Yes, the Environmental Contractor is responsible for preparing the Fish Rescue Plan for Phase 2. Refer the PWS Attachment 3 – Restoration Project Environmental Implementation Plan, Volume 4.2 for example Phase 1A/1B plan.

14. Is the Environmental Contractor responsible for purchasing fencing material?

Response: No.

15. Is the Construction Contractor responsible for the fencing installation? If so, should the Environmental Contractor anticipate being on-site during fencing installation?

Response: Yes, the Construction Contractor is responsible for providing and installing the environmental fences. The Environmental Contractor will coordinate the location and be present during the initial installation but is not required to remain for the entire installation. As part of Task 1D, the Environmental Contractor will monitor the installed fences and report on their maintenance and any necessary adjustments.

16. Will the vegetation clearing be a single event or does BOR anticipate more than one event?

Response: Reclamation expects the South Diversion Dam and South Canal Removal Construction Contractor to carry out clearing in multiple events due to the numerous sites and larger footprint involved. Whereas the Coleman Diversion Dam Removal Construction Contractor can complete clearing in a single event.

17. Is there 10(A)1(A) permitting requirements?

Response: No, the project has acquired USFWS and NMFS Biological Opinions under the Endangered Species Act Section 7.

18. Will we be working with the same Construction Contractor for the duration of construction activities or would there potentially be two different Construction Contractors?

Response: It is likely to be two different Construction Contractors.

19. Will blasting be part of the dam removal process?

Response: Blasting is not permitted.

20. Is there an ability to extend the proposal due date an additional week?

Response: The quote due date is hereby changed from August 01, 2025, 3:00 P.M. PST to August 06, 2025, 9:00 A.M. PST.
