About this file

This document is a Justification and Approval for Other than Full and Open Competition for a federal contract with Yosemite National Park. AviatCare provides 24/7 technical support and parts warranty support for Yosemite National Park's critical Microwave Communications Data Network, which transports emergency and routine communications, network connectivity, and public internet between nine park locations. Aviat is the sole manufacturer and provider of technical support and warranty services for this network, which includes dishes, towers, radios, switches, and other proprietary equipment. Procuring a new network would not be cost effective given the existing infrastructure investment. The contract value was not specified but is estimated under $250,000.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $10,000 ($2,000/$2500 for Construction/Services) AND UP TO $250,000 (See FAR 13.106-1)

Date: ____11/1/2023_________________ PR Number: 40644409

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

AviatCare provides 24/7 technical support and parts warranty support for the Park’s Microwave Communications Data Network (CDN). The CDN is critical communications infrastructure that links El Portal, Crane Flat, Hodgdon Meadows, Wawona, and Yosemite Valley together with bandwidth used to transport critical services for government business purposes including, but not limited to, the NPS Network, Public Internet, VoIP phone (911), and Land Mobile Ratio connectivity throughout the Park. The CDN Microwave system is comprised of nine different sites linked together forming one system transporting emergency and routine communications, network connectivity, and public internet and is expected to be operational as close to 100% of the time as possible. Without Aviat Networks service and warranty contract, when the system experiences an issue, it could be in-operable for an extended period of time resulting in complete system failure.

2. Sole Source Justification rationale (Check one and explain below):

___X__ Only one responsible source.

______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other _____________________________________________________

Explain: Aviat is the manufacturer and the only source for technical and warranty services for this system (see attached letter). This system was chosen and installed through a park project to provide reliable connectivity for Park functions. It includes dishes on towers, radios, site bosses, nodes, switches, DACs (digital to analog converters) and a battery power back up system at nine Park locations. It is how internet, phone and radio communications are transported through the park. For example, if this system goes down the Valley administrative building would not be able to access any part of the internet or make a phone call. The system transports routine and emergency communications and needs to be operational as close to 100% of the time as possible. Aviat Care has been instrumental in restoring service when a site has gone down. The technical assistance provided keeps this investment in communications infrastructure functioning properly. The warranty repair allows the Park to get parts such as radios, DACs, site bosses repaired and returned to prevent system down time. Per the warranty with Aviat the park is not able to obtain or install parts from other vendors as this would null and void the warranty with Aviat. While there are other systems available in the marketplace it would be a large cost to change to a new system and not financially in the best interest of the government.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: This system was chosen and installed through a park project to provide reliable connectivity for Park functions. It includes dishes on towers, radios, site bosses, nodes, switches, DACs (digital to analog converters) and a battery power back up system at nine Park locations. It is a critical communications infrastructure system that took many years to research, design, fund and have installed. It is how internet, phone and radio communications are transported through the park, for routine and emergency communications. It is not only, not cost effective to procure a whole new system, it is not feasible. Aviat was selected as the system, and this is the warranty and technical support service available for that system. Aviat IDU600 Eclipse microwave radios are not the only microwave radios on the market that could have been used when building the Yosemite Communications Data Network (CDN) microwave system a few years ago, but it was the radio and Aviat was the vendor that was selected (through proper government contracting processes) to be installed. The CDN microwave system is a highly complex network of microwave radios (17) that work together to deliver the services where Yosemite needs them. Replacing these radios would be exceptionally expensive and extremely time consuming that could take several years to complete. Keeping the Aviat microwave platform simply makes sense fiscally and overall, for the integrity of the system, and as a result, the AviatCare Maintenance support package is the option selected to assist in 24/7/365 maintenance support and equipment repair.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
