About this file

This is a Questions and Answers document for Solicitation #140P8426Q0068 regarding fuel supply and delivery services at Lassen Volcanic National Park. The document addresses two key inquiries from potential contractors regarding pricing and tax treatment.

The solicitation contemplates a firm-fixed-price purchase order with pricing quoted per gallon for each CLIN (Contract Line Item Number). Quoted unit prices will remain firm through the full period of performance ending November 30, 2026, with no economic price adjustment provisions or equitable adjustments tied to fuel market indices such as EIA. The Government anticipates one delivery immediately following contract award and one additional gasoline delivery to Manzanita during the performance period. Regarding tax treatment, contractors may pass on all fees, including federal excise tax on diesel and gasoline, except California sales and use tax, which is exempt as a sale to the United States. The National Park Service, a Federal agency within the U.S. Department of the Interior, is exempt from Federal and most state, local, and city taxes, with tax exempt numbers provided for reference (Federal tax ID 140001849, State exempt number 050329, and Federal tax identification number 53-0197094).

Questions and Answers

Supply and Deliver Fuel 2, Lassen Volcanic National Park

Solicitation #140P8426Q0068

1. Price firmness. Section I.A contemplates a firm-fixed-price purchase order, and

Attachment 1 requests a price per gallon for each CLIN. Please confirm that quoted unit prices are expected to remain firm through the full period of performance ending

November 30, 2026, and that no economic price adjustment provision applies.

1a. Would you all be willing to do equitable price adjustments tied to a fuel market index like EIA if prices fluctuate between the due date of Aug 14 and the final delivery date in November?

ANSWER: No, this will remain a firm fixed price contract with no price adjustment, and the period of performance will end on November 30, 2026. The park anticipates one delivery right after award and an additional delivery of gasoline to Manzanita during the period of performance. It is anticipated that everything else will be just the one delivery.

2. Tax treatment. Please confirm whether quoted unit prices should include federal excise tax on diesel and gasoline, and whether California sales and use tax applies to this purchase or is exempt as a sale to the United States. If the Government requires an exemption certificate or specific documentation at delivery, please advise.

ANSWER: The contractor can pass on all fees except sales tax.
