I. BACKGROUND:

The National Park Service manages paved and gravel roadways within the Stehekin District of North Cascades NPS Complex (NOCA) and Lake Chelan National Recreation Area. They also have occasional needs for heavy equipment operators to perform a variety of tasks and other services. This requirements contract will establish rates and procedures for heavy equipment rental, with or without operator, to assist with NPS operations.

II. SCOPE OF WORK:

A. The work required by this contract represents requirements in excess of the quantities that the government may itself perform.

B. All equipment to be called out and tasks to be performed shall be at the request of the Contracting Officer or a duly authorized Contracting Officer’s Representative (COR). (See Section XIII for ordering procedures.)

C. The Contractor shall operate their own heavy equipment to perform a variety of services including, but not limited to, hauling material, grubbing, establishing rough grade, grading, ditching, demolition projects, loading and transporting rocks, gravel, and other loose materials. Work under this contract may also include work on Lake Chelan in or near creeks and the Stehekin River. Activities may include in-water work for erosion control, other resource projects, and moving backfill (as an example) D. The Contractor shall perform all work in accordance with the terms, conditions, and specifications shown below. For work not specifically described in in this document or subsequent contract modifications, performance of the work will be as directed by the Contracting Officer’s Representative. The Contractor shall perform all work within the times specified for each task.

E. In addition to work performed alone, the operator may occasionally assist NPS crews in establishing reroutes of roads and water crossings following major storm events.

F. All equipment and personnel must be able to respond within 24 hours of a call-out for post-storm clearing activities.

G. Contractor shall provide all needed equipment, fuel, labor, insurance, supervision, and transportation required to do the work.

H. This commercial-item requirements contract will remain in effect for a base period (date of award to 09/01/2026) plus up to two option years. The total contract is not expected to exceed $80,000.00 in the base period or any single option year, nor exceed $240,000 for the entire contract period (base period plus both option years).

I. The Contractor must comply with Washington state licensing requirements regarding Commercial Driver’s License and submit operators’ license(s) for review by COR.

J. This contract does not include regular road grading or snow removal on the Stehekin Valley or Company Creek roads (which is under separate contract administered by North Cascades National Park).

K. This contract does not include construction as defined in the Federal Acquisition Regulation Part 2.101: “Construction means construction, alteration, or repair (including dredging, excavating, and painting) of buildings, structures, or other real property. For purposes of this definition, the terms “buildings, structures, or other real property” include, but are not limited to, improvements of all types, such as bridges, dams, plants, highways, parkways, streets, subways, tunnels, sewers, mains, power lines, cemeteries, pumping stations, railways, airport facilities, terminals, docks, piers, wharves, ways, lighthouses, buoys, jetties, breakwaters, levees, canals, and channels.”

III. LOCATION:

All work required by this contract will be performed in Lake Chelan National Recreation Area, Stehekin District, North Cascades National Park Service Complex. Stehekin is a remote community located at the north end of Lake Chelan, approximately 50 miles from Chelan, Washington. The Stehekin valley is isolated; the roads do not connect with any highway system. Stehekin is accessible from Chelan only by boat, barge, or floatplane; all materials and equipment shall need to be barged. Within the Stehekin valley, the project area can be reached on roads suitable for hauling heavy equipment or near the shoreline via a barge. Lodging and meal services are available on a limited basis. Cellular phones do not work; public phone service at Stehekin is limited to a single telephone requiring credit or calling card; and there is limitedno public Internet access.

All work shall be performed on 1) native or aggregate single-lane roadbeds associated with the Stehekin Valley Road, 2) areas nearby and associated with the Stehekin River and other waterways, or 3) on park lands adjacent to Lake Chelan.

IV. EQUIPMENT:

Contractor will provide equipment of the general kinds listed below, with operator unless requested “bare”.

1. Excavator (with thumb if available):

a. Caterpillar 320 or equal

b. Caterpillar 311 or equal

c. Caterpillar 308 or equal

d. Komatsu PC60 or equal

2. Semi-tractor:

a. Tractor

b. Tractor with 20 cubic yard end up trailer (or equal)

3. 10 cubic yard dump truck

4. 12-14 cubic yard dump truck with high-lift gate

5. Rubber-tired front end loader (CAT 950 or equal)

6. Motor Grader (CAT 140G or equal)

7. Skid-steer loader (such as Case Uniloader, CAT 216 or equal)

8. Water tanker truck

9. Tilt-bed trailer (20 ton capacity or equal)

10. Backhoe/loader (such as Case 580, CAT 436 or equal)

11. Truck mounted rotary snow blower (Osh-Kosh type or equal)

12. Concrete mixer (per-cubic-yard rate includes Skid Steer operator, cement, gravel)

Appropriate equipment shall have bio-preferred hydraulic fluid installed as much as is practicable for work done under this contract; this shall be required for work in or near water sources. Applicable products, information, and sources may be viewed at http://www.biopreferred.gov/BioPreferred/faces/catalog/Catalog.xhtml (search on keyword “hydraulic fluid”).

Contractors shall offer the same or other equipment for “bare” rental (without operator), priced at a monthly, weekly, daily, or hourly rate. Equipment offered for rent shall be in good operating condition and free of leaks. The following provisions shall apply to bare equipment rental:

A. The Contractor hereby leases the equipment listed above to North Cascades National Park Service Complex (otherwise known as the Government) for project work at various locations within the Stehekin valley. The Government intends to lease the equipment for use and operation by Government personnel.

B. The Government assumes the risk for Government-caused loss, damage, or destruction of equipment rented under this contract provided that no reimbursement will be made for loss, damage, or destruction when due to ordinary wear or tear, or negligence of Contractor or Contractor’s employees caused or contributing to loss, damage or destruction, subject to “Availability of Funds” in accordance with the Anti-Deficiency Act, 31 U.S.C. Section 1341, 1350.

C. Equipment furnished shall be in acceptable condition and will be subject to a Government pre-inspection. The government reserves the right to reject equipment that is not in accordance with the specifications contained herein, or which is not in a safe operating condition. All equipment shall be furnished with bio-based hydraulic fluid.

D. The Government agrees to use and care for the equipment in a careful and prudent manner, to pay for all fuel, oil and grease, and to perform needed preventive maintenance while the equipment is in the possession of the Government. Repairs to equipment due to pre-existing conditions or excessive wear and tear shall be made and paid for by the Contractor. The Government may, at its option, elect to make such repairs when necessary to keep the equipment operating. The cost of such repairs will be deducted from payment to the Contractor. The Contractor shall provide operator manuals for the Government’s use during the rental period.

E. The Government will return equipment to the Contractor in as good a condition as received, reasonable wear and tear expected. If, upon its return to the Contractor, the equipment is not in as good condition as described above, the Contractor shall contact the Contracting Officer and discuss the problem(s) before any repairs are made. If in agreement, the Contractor may repair it and the Government may pay the cost of any such repairs at the Contractor’s regular shop rate.

F. The Government will agree to cooperate, to the extent allowed by law, in the submission of claims pursuant to the Federal Tort Claims Act against the United States for personal injuries or property damage resulting from the negligent or wrongful act or omission of any employee of the United States while acting within the scope of his employment, arising out of this agreement.

G. The Government will not, unless with the written consent of the Contractor, install any accessories or devices on the equipment if such installation will impair the originally intended function or use of the equipment. All accessories or devices fixed to the equipment will automatically become the property of the Contractor unless such part or device can be removed without in any way affecting the originally intended function or use of the equipment. Any damage to the equipment caused by the attachment/removal of such accessories or devices shall be repaired at the Contractor’s expense.

H. The Government will comply with, and conform to, all applicable laws and regulations relating to ownership, possession, use and maintenance of the equipment.

I. The Government will, when requested, advise the Contractor of the location of the equipment. The Contractor and its representatives may, for the purpose of inspection, at all reasonable times, enter upon any job, building or place where the equipment is located. The Contractor may remove the equipment without notice to Government if, in the opinion of the Contractor, it is being used beyond its capacity or in any other manner improperly cared for or abused. The removal and transportation of the equipment without prior agreement shall be at the Contractor’s expense.

J. The Government agrees that the Contractor may assign this contract and all rights, title and interest of the Contractor in and to the equipment, and all rents due or to become due to Contractor hereunder and the Government agrees to recognize such assignment K. This is an agreement for rental only and nothing herein shall be construed as conveying to the Government any right, title or interest in or to any item of equipment leased hereunder, except as a lessee.

L. Rental payments shall be made upon the submission of proper invoices or vouchers identifying each item of equipment invoiced for. Rent shall accrue from the beginning of this contract, or from the date each item of equipment is delivered to the Government and shall continue to accrue until equipment is released for return to the Contractor’s place of business. Rent shall not accrue for any equipment that the Contracting Officer determines is not in good operating condition and does not comply with the requirements of this contract, until such time that the defects are corrected or the item of equipment is replaced by the Contractor.

V. GRADING and DITCHING:

These services shall not exceed $2,000 with operator each order. Work shall consist of reconditioning the surface of existing and new roadways and routine maintenance on various types of drainage ditches to provide a waterway which is unobstructed. This work is not associated with routine maintenance of the Stehekin Valley or Company Creek roads, but would potentially be necessary on other roadways or after storm damage or re-routes. General tasks include grading unpaved roads, replacing base materials and riprap, repairing asphalt surfaces, and clearing ditches.

A. Surface grading shall be performed during timeframes acceptable to the Contracting Officer or the Contracting Officer’s Representative. Contractor shall commence work within five (5) days after receiving a verbal request by the CO, COR, or other ordering official designated by the Contracting Officer.

B. All roads shall remain open to traffic with no more than 15 minutes maximum delay time, unless longer delays are approved in advance by the COR for a specific project or location.

C. The existing traveled way, including turnouts, shall be bladed and shaped to produce a surface which is uniform, consistent to grade, and crowned or cross-sloped as indicated by the quarter inch per foot of width. Surface materials shall be thoroughly loosened to no less than two-inch depth or the depth of potholes or corrugations. Scarification to facilitate cutting to the full depth of potholes or corrugations may be elected by the Contractor but will be considered incidental to grading. Scarification shall not go deep enough to cause contamination of the surfacing. The road will be maintained at an average width of 14 feet.

D. Surface grading shall be performed only when sufficient moisture is present to prevent segregation.

E. Existing native, rock, or aggregate surface drainage dips shall be shaped incidental to grading to divert surface runoff to existing outlet devices, ditches, and discharge locations.

F. The Contractor shall establish a grading pattern which provides a uniform driving surface, retains the surfacing on the roadbed and provides a thorough mixing of the materials within the completed surface width. Upon final grading, no disturbed rock shall protrude more than two-inches above the adjacent surface unless otherwise provided in the contract. Material not meeting this dimension shall be removed and placed outside the roadbed so as to not obstruct drainage ways or structures. This material may be scattered off the roadbed if there is free drainage. Removal of oversized materials may require hand labor to meet specifications.

G. Roadway slopes shall not be undercut. At intersections, the roadbeds of side roads, which are not closed or restricted from vehicular use, shall be bladed to assure smooth transitions.

H. Materials resulting from work under this section shall not be allowed to remain on or in structures, such as bridges, culverts, cattle guards, or drainage dips. All road drainage structures 36” in diameter and smaller shall be hand cleaned, including cutting of brush within a six-foot radius of the culvert inlet.

I. Ditches shall be maintained by removing rock, soil, wood, and other materials. Upon completion, the maintained ditch shall be of the same character as abutting segments that we not required to be maintained.

J. Suitable material removed from the drainage ditch may be blended into existing native road surface and shoulder or placed in designated berm. Material from ditch pulling operations may be blended into and across aggregate surfaced roads unless staked or marked otherwise on the ground. No material shall be pulled and bladed across bituminous surfaced roads. With advanced approval of the COR, excess materials shall be deposited outside the roadbed, along the fill slope, so as not to obstruct drainage structures.

K. Furrow ditches shall be reshaped and blockage removed except that blockages previously placed to divert water from the ditch into culverts or other drainage structures shall remain.

L. Limbs and wood chunks in excess of one-foot in length or three-inches in diameter shall be removed from ditches and placed outside the roadway.

M. Paved surfaces shall be cleaned of all materials resulting from Contractor’s ditch maintenance work.

N. Lead-off ditches shall be shaped to drain away from the traveled way.

O. Drainage ditch maintenance is limited to materials contained within the ditch and not on the shoulder or travel way, but may extend three feet above the flow line on the back slope.

VI. MISCELLANEOUS SERVICES:

NPS may require the contractor to perform a variety of services within the Stehekin valley and along the shores of Lake Chelan within the national recreation area. Examples of miscellaneous services if the price does not exceed $2,000 per order and may include but are not limited to:

A. Hauling materials including but not limited to riprap, base material, stumps, logs, and culverts to or from identified locations.

B. Clearing stumps and vegetation debris from specific areas.

C. Digging holes or trenches for projects performed by NPS employees, i.e. not associated with construction performed under separate contract, not to exceed $2,000 per order.

D. Placing concrete in NPS-constructed forms.

E. Placing rocks, logs, or other materials to prevent or reduce erosion, only if price does not exceed $2,000 per order.

VII. WATER:

The work of this section consists of providing labor and equipment to furnish an adequate water supply, hauling, and applying water.

A. Suitable and adequate water sources are available in the contract area. The Contractor may determine appropriate water source(s) and submit them to the COR for approval. B. Mobile watering equipment shall have watertight tanks of known capacity.

C. Positive control of water application is required. Equipment shall provide for uniform application of water without ponding or washing.

D. An air gap or positive anti-siphon device shall be provided between the water source and the vehicle being loaded if the vehicle has been used for other than water haul, the source is a domestic potable water supply, or the water is used for tank mixing with any other materials.

E. The Contractor shall furnish all pumps and appurtenances necessary to fill their water truck from the selected water source(s).

VIII. ROCK AND MATERIALS HANDLING:

At times the Contractor shall be hired to assist with transporting rocks (up to boulder size), gravel, and other loose materials.

A. When materials are being transported from Chelan to Stehekin, the Contractor may be required to load materials onto the barge in Chelan, barge equipment to Stehekin , transfer materials into Contractor-owned or NPS-owned trucks, transport to job sites (which may be within the Stehekin valley or along the shores of Lake Chelan within the national recreation area), and unload.

B. When materials are being moved between locations within the Stehekin valley, the Contractor shall load, transport, and unload them as directed by the COR.

IX. ACCIDENT AND SPILL PREVENTION:

A. The Contractor is required to establish an effective accident and spill prevention program and shall provide a safe environment for all employees, visitors, and park personnel. A site specific Accident Prevention Plan (APP) covering on-site work to be performed by the contractor and all subcontractors shall be required. The prime contractor shall be responsible for development, implementation, and oversight of the plan. The plan shall address site specific safety and spill prevention requirements and procedures based upon specific anticipated conditions, and address anticipated tasks, their related hazards, and anticipated control measures. No work may occur on site until the APP is approved by NPS.

B. As work proceeds, the APP shall be adapted to new situations and new conditions. Changes and modifications to the accepted APP shall be made with the knowledge and concurrence of the Contracting Officer's Representative (COR).

C. Should any unforeseen hazards become evident during the performance of work, the contractor shall bring such hazard to the attention of the COR, both verbally and in writing for resolution as soon as possible. In the interim necessary action shall be taken to re-establish and maintain safe working conditions in order to safeguard on-site personnel, visitors, the public, and the environment.

D. In addition, work performed under this contract shall comply with applicable federal, state, and local safety and occupational health laws and regulations. This includes, but is not limited to, Occupational Safety and Health Administration (OSHA) standards, 29 CFR, and FAR clause 52.236-13, Alt 1.

E. The Contractor shall hold regular safety meetings and provide notification to the COR of the day and time of the meetings so that he/she may attend.

F. Upon request, Contractor shall submit proof of employees’ qualifications to perform assigned duties in a safe manner.

G. In the event of conflicts between Federal, State, and Local safety and health requirements, the most stringent shall apply.

H. Equipment or tools must meet OSHA requirements. Failure to comply with the requirements of this section may result in suspension of work.

I. All accidents must be reported to the COR immediately. A reportable accident is defined as death, occupational disease, traumatic injury to an employee or the public, property damage in excess of $100, and fires. Form DI-134 must be completed and submitted to the COR within three days of an accident. Forms are available from the COR.

J. Personal protective equipment shall be maintained in a serviceable condition and checked daily. Clean, sanitize, and repair equipment as appropriate.

K. Contractor is required to provide all necessary traffic barriers, traffic control signs, markers, and flaggers when required during operations. Traffic control for occupied work areas shall be in accordance with National Standards contained in the Manual of Uniform Traffic Control Devices (MUTCD).

L. Contractor’s vehicles and machinery operating on or from the travel way or road shoulder shall have flashing lights, strobes, or rotary beacons operated continuously while work is in progress. Truck headlights shall be on while operating. Backup horns shall be required on all self-propelled equipment in excess of 8000 lbs. gross weight.

M. Contractor shall furnish, and locate at the work sites, fluid spill kits appropriate to the types and quantities of fluids present.

X. NOXIOUS WEED PREVENTION:

To prevent the introduction of the seeds from noxious weeks into Stehekin valley or onto NPS land, the Contractor shall wash all mechanized equipment thoroughly before transport via barge. This includes the removal of all soil, seeds, vegetative matter or other debris that could contain or hold seeds. Diffuse or spotted knapweed, Japanese knotweed, and rush skeleton weed are the primary noxious weeds of concern. The Contractor shall employ whatever cleaning methods are necessary to ensure compliance with the terms of this provision, and shall notify the NPS prior to moving each piece of mechanized equipment into Stehekin valley. Cleaning of equipment shall not occur on NPS land. Notification will include identifying the location of the equipment’s most recent operation. The NPS will inspect each piece of equipment prior to its being placed into service. If a piece of equipment fails the inspection, the Contractor will be responsible to perform whatever methods are necessary to pass upon re-inspection and will bear all costs.

XI. OPERATOR WAGES:

The wages paid to the operator(s) of this equipment are subject to the Service Contract Act.

Required minimum wages are in Attachment B. According to the SCA Directory of Occupations, “The Heavy Equipment Operator operates heavy equipment such as cranes, clamshells, power shovels, motor graders, heavy loaders, carryalls, bulldozers, rollers, scrapers, and large industrial tractors with pan or scrapper attachments. Equipment is used to excavate, load, or move dirt, gravel, or other materials. Operator may read and interpret grade and slope stakes and simple plans, and may grease, adjust and make emergency repairs to equipment.”

XII. ORDERING PROCEDURES:

Delivery or performance shall be made only as authorized by orders issued and approved by the CO; the Contractor shall not commence work on any project without an executed task order. The Contractor shall furnish to the Government all equipment or services specified in the task orders issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

All with operator task orders will be performed at a “wet rate”. NPS will have the option to provide or purchase fuel under bar rental task orders.

When work is contemplated under this contract, NPS will prepare a statement of work using the format in Attachment A. The contractor shall provide a price quote and brief description of their approach. NPS will review it and will ensure that appropriate funding authorizations are in place. Once the dollar value and approach are agreed-upon, NPS will submit the submit the package to the CO for review/acceptance; the CO will execute the task order and send it to the Contractor and COR and work may begin.

Task order work may be clearly defined and quantified or may be difficult to define or quantify in advance. The price format will vary for each type of work as shown below.

Clearly Defined Project: Overall project and contractor tasks are definable, quantifiable, and typically will be planned and scheduled in advance. Price will be firm-fixed lump sum for completion of the work, Example, loading and transporting known quantities of rock or gravel on a defined schedule.

Indeterminate Projects: Overall project and/or contractor tasks are not easily defined or quantified, and/or work may be urgent or require swift response. Task order price will be based on hourly equipment rates and proposed approach and include a not-to-exceed dollar value, Contactor shall not perform any additional work in excess of the approved task order amount without prior written approval from the CO on a Standard Form (SF) 30 in a bilateral modification. Example: clearing storm debris from roadways, culverts, or drainage ditches.

XIII. INVOICES and PAYMENT:

A. Payment for clearly defined projects will be at the agreed-upon lump-sum firm fixed price. Payment for undefined projects will be made at the awarded rates for the actual number of hours for each equipment item used to the nearest quarter hour.

B. Invoices will document all fuel costs by providing at price per gallon and total gallons used.

C. Payment will be monthly, or more often as agreed to by the Contracting Officer, upon receipt of proper invoice and accepted by the COR.

D. Invoices should be submitted to the U.S. Department of the Treasury's Internet Payment Platform System (IPP; https://www.ipp.gov) in accordance with the clause in the RFQ. It is strongly recommended to route a draft invoice to the COR and CO for review prior to uploading it to IPP.

E. The IPP invoice should be submitted as a lump sum total representing all work performed against each contract line in the billing period. Note that each NPS project may be on its own contract line and it will be critical for the contractor to submit their invoices to the correct line(s). Failure to do so may result in delayed payment.

F. The “vendor’s standard invoice” to be uploaded in support of the IPP invoice shall contain the following information:

a. Contractor’s name and address

b. Contract number

c. Task order number

d. Date of event and/or description of work

e. Number of hours for each piece of equipment rented with operator for undefined projects.

f. Rental period (e.g. hour, day, week, month) for bare rentals

g. Total amount of invoice

h. Payment will be by electronic funds transfer into the contractor’s bank account identified in their SAM record (www.SAM.gov).
