5. AUTHORIZED BUYERS. The Individuals listed below are the only authorized

Olympic National Park employees to place orders under this BPA. No other employee of Olympic National Park is authorized to place orders under this BPA or otherwise commit the Government. Vendor acceptance of an order from an employee not listed below is at the vendor's own risk. Authorized Buyer List: will be provided in each BPA awarded that will include the names, job titles, phone numbers, and email addresses of all authorized buyers. The National Park Service (NPS) reserves the right to change the primary point of contact, as necessary, and will notify all contractors in writing in the event that such a change occurs.

6. CONTRACTING OFFICER POINT-OF-CONTACT: Phaedra Fuller is the

Contracting Officer for this BPA. Direct questions or concerns to her at office phone number 360-565-3009, or send email to Phaedra_Fuller@nps.gov.

7. ORDERING PROCEDURE: The Government will place orders by e-mail, on an on-call basis only. The Government anticipates placing orders at various times throughout the performance period. Each order will be competed among BPA vendors. One of the authorized buyers listed above will contact each vendor, obtain prices for each material type needed for delivery. It is in the best interest of the government to maximize use of available funds by basing the award decision of each BPA Call on the basis of lowest prices quoted for each material type. For example, if more than one type of material is requested, then multiple BPA Calls may be awarded to vendors who quoted the lowest prices. In other words, a vendor who quoted all material types may receive a BPA Call for none or only some or all of the material types, based on prices quoted.

8. PERIOD OF PERFORMANCE.

8.1 This BPA will remain in effect for a period of 5 years (actual period of performance will be stated on the BPA award form). The government anticipates the first year starting July 1, 2018 and year five ending June 30, 2023.

b) Confirmation that materials ordered were delivered within the two week timeframe and properly invoiced,

c) Confirmation that the pits/quarries were maintained to continue to supply weed-free materials.

8.3 The government reserves the right to cancel/terminate any BPA for a contractor’s/vendor’s non-conformance with BPA terms that includes quality control.

9. INVOICE & PAYMENT. The federal government will only be obligated to the extent of authorized purchases actually made in accordance with the BPA, and shall only pay for actual quantities received. Each individual order shall not exceed $50,000, and the maximum authorized limit of the BPA shall not exceed $1,000,000.

8.1 VENDOR SHALL SUBMIT AN INVOICE FOR EACH BPA CALL. Invoices shall identify the invoice number, invoice date, BPA number, vendor name with address and phone number, and itemized list of delivery tickets covered therein, stating the material types, quantities, unit prices and extended prices, and a total invoice amount. 10. QUALITY CONTROL.

9.1 Quarries being submitted for award must have been inspected by the National Park Service (NPS), or a partner of the NPS, and documentation must be provided that identifies the date of last inspection. Quarries that do not have current inspection documentation may be considered for award at the discretion of the NPS Vegetation Branch Chief. Quarries may require repeated inspection during the performance period, as required by the NPS Vegetation Branch Chief.

The presence of noxious seeds and weeds shall be part of the determination of “responsiveness” at time of award of the BPA, and then may be considered for each competed BPA Call. The intent of quarry inspections of potential aggregate sources is to avoid contamination with seeds or other plant parts capable or reproducing for the following species:

Cheatgrass, Bromus tectorum

Potted knapweed, Centaurea biebersteinii

Brown knapweed, Centaurea jacea

Tumble knapweed, Centaurea diffusa

Canada thistle, Cirsium arvense

Scot's broom, Cytisus scoparius

Herb Robert, Geranium robertianum

English ivy, Hedera helix

Orange hawkweed, Hieracium aurantiacum

Common St. John's-wort, Hypericum perforatum

English holly/Ilex aquifolium

Yellow iris, Iris pseudacorus

Everlasting peavine, Lathyrus latifolius

Small everlasting peavine, Lathyrus sylvestris

Reed canarygrass, Phalaris arundinacea

Japanese knotweed, Polygonum cuspidatum

Sulphur cinquefoil, Potentilla recta

Laurel cherry, Prunus laurocerasus

Himalayan blackberry, Rubus discolor

Evergreen blackberry, Rubus laciniatus

Tansy ragwort, Senecio jacobaea.

9.2 For a proposed source to be accepted, the aggregate product in question has to have been mined from an intact layer, processed, and stored since the end of the previous seed-dispersal season. Olympic National Park botanist considers the end of the seed-dispersal season to be November 1st. Ideally, material for delivery to the park is fresh quarried and processed without stockpiling for more than a few days. In addition, the areas surrounding the mining, processing, and stockpiling locations need to be free of the above species for 100 feet in all directions. The Olympic National Park botanists do exercise judgment when inspecting. For example, if some limited presence of the above species are found, they may be acceptable if the plants observed show no evidence of flowers or fruits.
