About this file
This document is a Justification & Approval for Other Than Full and Open Competition for Simplified Acquisitions, specifically for emergency HVAC repairs at Death Valley National Park. The urgent procurement is for repairing HVAC systems at the Visitor's Center Office and a home unit in Cow Creek #328, with an anticipated cost not to exceed $16,527.00. The justification is based on extreme heat conditions, with temperatures recently over 120 degrees and forecasted to remain over 115 degrees, creating potential safety risks for employees and the public if immediate repairs are not made. The Contracting Officer determined that any delay in contract award could result in serious injury, thereby justifying the urgent and compelling circumstances for a non-competitive procurement. Market research conducted on FPDS NG confirmed pricing for similar work ranges from $15,000 to $18,000, supporting the fair and reasonable pricing of the proposed repairs.

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
_These are emergency HVAC repairs at Death Valley and the anticipated cost is NTE $16,527.00. Temperatures for the next few weeks are forecasted to be over 115 and close to 118 degrees. The locations are the Visitor’s Center Office (Quote number 52792487) and a home unit located in Cow Creek #328 (Quote:

2. Sole Source Justification rationale (Check one and explain below):

______ Other _____________________________________________________
Explain: _Due to the extreme heat at Death Valley National Park, any malfunction due to HVAC systems and units pose serious injury to employees that work at Death Valley and to the public. Therefore, HVAC repairs are crucial to people’s immediate safety and the Contracting Officer has determined that repairs need to be made immediately because any delay of award of a contract would result in serious injury to the employees and the public in which the Government serves.

Market research conducted on FPDS NG for similar work to support fair and reasonable prices. These prices range from $15k to 18k for similar work (See A14 Market Research Pricing F&R).
