Questions and Answers Solicitation No. 140P8125B0011

LAKE Replace & Construct Fencing Parkwide July 11, 2025

Questions Group 1

1. Will mods be accepted for lengths of fencing repairs that were not estimated in the specs?

• This is a firm-fixed price requirement. Therefore, the contractor bears the responsibility of their own cost experience. Request for change orders will need to be submitted to the contracting officer post award and a scope analysis will need to be conducted before the contracting officer decides whether the change was within scope or out of scope of the contract.

2. Can work start later in the year to avoid the heat?

• Yes, the onsite work can be started later; however, all work must be completed within the period of performance

3. Can you provide the specific length of fence at the Cottonwood lagoons that is proposed as new?

• 412 ft.

4. Does the soil from excavation for new fence posts need to be removed from site?

• No, can be distributed evenly around site.

5. Vegetation inside of and along fencing, will this need to be removed and hauled off site?

• If absolutely necessary, vegetation may only be removed along fence line and no more than 5’ from either side of fence. Any removed vegetation will need to be hauled off site and properly disposed of. Unless causing damage to existing fence, Vegetation along existing fence lines that need repair are not to be disturbed. All endangered plants are not to be disturbed.

Questions Group 2

1. Can you provide as-builts of the sites to clear any potential conflicts in fence foundations with underground utilities.

• As-builts, if available, can be provided to awarded contractor.

2. Please confirm the fence type is chain-link with top tension wire, bottom rail, and double barbed wire. Please confirm the required fabric width.

• Chain link detail has been added to the specifications. See page 83 of 85 for the requested detail.

3. Where existing fences are being removed and replaced, is there a requirement to provide overnight site security or temporary fence?

• There is no requirement to provide overnight site security or temporary fence. All project locations are signed as off-limits to the public.

4. There are discrepancies between the specifications, layout drawings, and the schedule of values. Which document takes precedence?

• The order of precedence in sealed bidding is located in FAR 52.214-29.

5. When evaluating existing fence conditions, what qualifies as damage requiring repair for fence posts, fabric, gates, mechanisms, and accessories? Additionally, how is a repair defined, does it constitute full replacement of the damaged component, or are partial or in-place repairs acceptable?

• Damage to gates is constituted as any portion of fencing that is bent, broken, disassembled, or any otherwise section of fence that is not in a new or like-new condition excluding weathering. A repair is any sufficient repair or replacement of existing fence to return it to new or like-new condition. In addition, see FAR 52.236-5 Material and Workmanship for additional details.

6. Clarification on section 017419-3.2 Salvaging demolition waste, is the expectation to reuse as much of the removed material as possible? Please clarify the intent regarding salvaged items.

• No removed fencing is expected to be reused. Section has been revised to provide clarification. All waste/damaged fence to be removed properly off site. In addition, see FAR 52.236-7 Permits and Responsibilities for additional details.

7. Are ground rods required for new fence install? Please provide specifications for ground rods frequency, including any required testing or certification procedures.

• No.

8. Are there required sequences for site work?

• No.

9. Can crews work simultaneously at multiple locations?

• Yes.

10. Any upcoming events or closures that affect access?

• None other than regular federal holidays.

11. Are there any geotechnical reports that show existing site conditions?

• No.

12. Are erosion control or backfill measures needed? The bid documents state there is areas to be filled with granular, can this be quantified prior to bid day? Where are these located?

• No erosion control during construction is required. Backfill measures are required as well as a new corrugated metal culvert. Design, location, and materials have been added to the specifications. See page 80-82 for associated details.

13. Are there any access restrictions for trucks or equipment?

• No.

14. Is there a detail sheet for the vehicle and pedestrian gates?

• Detail sheet for gates has been added to specifications. See page 84 of 85 for requested details.

Question Group 3

1. Will the use of ProjectTeam be required for submittals and administration of the project (QC Daily’s, submittals, RFI’s, etc…) ?

• ProjectTeam will not be a requirement for this project.

2. If so, will the contractor be required to purchase their own license for ProjectTeam and then invite the NPS staff or will the NPS license be used instead and with invitations issued to the Contractor user(s)?

• Contractor is not required to offer ProjectTeam or other similar administration service.

3. At the Las Vegas Bay sewage Treatment lagoons it was noted that in order to adequately repair the perimeter fence it would be necessary to place and recompact fill at/under the fence line to make effective repairs and it was noted that in order to prevent it from re-occurring replacement of the fully plugged culvert running under the fence would also be required. What size culvert and how many feet will be required and can existing native earthen material from inside the fence perimeter be utilized for salvage, placement and compaction of the eroded area(s) or will imported material be required?

• Please see pages 80-82 of the amended specifications for the details regarding the addition of a culvert to pass under the fencing at the Las Vegas Bay sewage lagoons.

4. Since it was unfeasible to visit all noted repair sites and hence determine the extent of the required repairs it was noted by Lake Mead personnel that photographs of all required fence line requiring repairs could be made available prior to the bid date in order for bidders to make a proper evaluation of the extent of fence and gate repairs at each location. Will the Government make these photos available prior to the bid date? No such amendment has been forthcoming since the site visit.

• Photos will be made available prior to the bid due date.

5. If the photographs cannot be provided are there specific arrangements to be made in order for prospective bidders to be able to access all required repair footage since some of these locations areas are behind locked NPS gates?

• if the photographs provided are insufficient, submit an RFI by 7/9/2025, providing rationale on why the photos are insufficient and the contracting officer may decide to hold a second site visit date. If the contracting officer decides to hold a second site visit date, it will be advertised via an amendment.

6. Based on the premise that the above questions all require answers to adequately prepare a properly responsive bid, can the due date for bids be extended accordingly with the answers to the above questions?

• Yes, bid due date will be extended.

Question Group 4

1. On all new install is there a set distance that’s needed between the new fence line and present building, control panel, transformers etc for appropriate NPS access?

• There is no existing set distance.

2. Echo Bay lift station: 20 ft gate opening. One of the vehicle gates will open into parking lot. Is that okay or would a 2-gate system 10ft wide each be feasible for this area? The same with the second vehicle 20 ft. This gate would open into the driving lane. Would a 2-gate system 10ft wide each be feasible for this area?

• A 2-gate system with total opening of 20 feet would be acceptable.

3. Las Vegas Bay Lift Station: Can the trees behind this lift station be trimmed or removed in order to install new fence?

• Tree may be trimmed so long as it doesn’t cause permanent damage to tree. Fence may be routed outside of tree to avoid.

4. Willow Beach Electric Control: Calls for vehicle gate which would be on top of the wall.

Is this correct? The fence that presently surrounds the electric controls need to be removed? The present fence has a pedestrian gate opening. The fence does not surround the transformer to the side of it?

• The existing Willow Beach Electric Control fencing is satisfactory, only an inspect and repair if necessary is requested.

5. Cotton Wood Lagoons: New fence install shows the fence line being moved to an area that has not been washed out. The alinement moves it to an area that is going to need some dirt work to install new fence line. Approximately two to three feet of fill. Are we to fill this area in? Are we able to go around the stockpile of material and reconnect into present fence line? More of a U shape rather than a L shape?

• Rerouting around stockpile material is acceptable.

6. Cottonwood Cove Well 1: I believe on the southside of this building is a block wall that shows no fencing. On the front of this building where the block wall meets the building is approximately 8ft tall. As this wall goes around to the back side it drops to approximately 4.5ft tall. This still allows access to the back area. Is this an area that needs to be fenced in also?

• That area does not need to be fenced in.

7. Callville Bay Water Treatment plant: The location for the 20ft vehicle gate is on a slop so the opening of this gate will leave the open end when open approximately 2.5ft in the air.

Would a 2-gate system 10ft wide each be feasible for this area?

• A 2-gate system with total opening of 20 feet would be acceptable.

All endangered plants are not to be disturbed

Just for clarification on the above:

(1) If vegetation is growing through the fence line and not causing damage it is to stay?

(2) Who will shoe the contractor all the endangered plants on each site?

• If existing vegetation is not causing damage, it is to stay. NPS resource management will be performing site visits to each location and compile a markup on what is to not be disturbed.

Question Group 5

RFI #1 – Conformance of Fence Repairs to Drawings Several existing fences differ from the contract drawings (e.g., missing barbed wire). Please confirm whether repairs should match existing field conditions or be brought into compliance with the detail shown in the plans.

• Any existing fencing that is missing barbed wire will need to be brought into compliance. Any repairs to damaged fence will match existing fence.

RFI #2 – Scope Clarification for Site Repairs To minimize scope risk, we request that either (a) repairs be described and clearly annotated per site, or (b) a follow-up site walk be conducted with Government personnel to confirm expectations.

• Once contract is awarded, at request of contractor, COR will go to each site with contractor to confirm repair and replacements. Photos of all sites have been posted and a site walk was performed 6/24 showing an existing fence at 2 sites and examples of repairs required. The amount of fencing to be repaired has been estimated by the COR at approximately 12,000 linear feet.

RFI #3 – Quality Control and Testing Responsibility Please confirm whether the contractor is responsible for quality control testing (e.g., post embedment depth, backfill compaction), and whether any third-party certification or formal documentation is required for acceptance.

• COR will perform quality control during construction to ensure fencing is built matching specifications.

RFI #4 – Survey and Staking Responsibility The contract documents do not specify staking or layout responsibilities. Please confirm whether the contractor must perform survey and staking for new and replacement fence segments, or if this will be provided by the Government.

• Survey and staking is not required for the layout of this project. If requested by contractor, COR may verify on site proposed layout before construction.

Question Group 6

• In lieu of a bid bond, can we submit a check for the amount of bid, to be returned if not selected?

• This is allowable. FAR 52.228-1 requires “a bid guarantee in the form of a firm commitment e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.”

Please note that the check must be certified or a cashier’s check.

Additionally, per the solicitation clause, “The amount of the bid guarantee shall be twenty (20) percent of the bid price or $3 million, whichever is less.”

A check can be mailed to 601 Nevada Way, Boulder City, NV 89005 Attention:

Mark Fiorina. If any check is mailed, please inform Caleb Overbaugh and Mark Fiorina via email to caleb_overbaugh@nps.gov and mark_fiorina@nps.gov.

• Is this solicitation still set-aside for Indian Small Business Economic Enterprises (ISBEEs)?

• Yes.

***Note. Some clause references are provided above. However, the contractor shall adhere to all clauses and provisions in the contract. In this Q&A, referencing the regulation does not indemnify a contractor from liability to follow all the required clauses in the contract.
