The purpose of this amendment is to provide the Government's responses to questions posed by prospective quoters and to extend the solicitation closing date and time to Thursday, September 19, 2019 at 3:00 p.m. central time.

Q-1: Would the government approve the use of large steel-tracked mulchers/masticators as long as the equipment has a ground pressure of less than 11 lbs. per square inch?

R-1: Steel-track equipment may be used as long as the ground disturbance does not exceed that which is specified in Attachment 1 - SOW and

Specifications. No bulldozers will be allowed.

The CO reserves the right to suspend Contractor's use of any equipment or tools, at no cost to the

Government, which are causing damage to, or having a negative impact on the Park's resources or surrounding areas, regardless of its previous approval by the Park to be used in the performance of the contract.

Q-2: Would the government approve the use of large rubber tired mulchers/masticators as long as the equipment has a ground pressure of less than 11 lbs. per square inch?

R-2: Rubber tire equipment may be used as long as the ground disturbance does not exceed that which is specified in Attachment 1 - SOW and

Specifications. No bulldozers will be allowed.

The CO reserves the right to suspend Contractor's use of any equipment or tools, at no cost to the

Government, which are causing damage to, or having a negative impact on the Park's resources or surrounding areas, regardless of its previous approval by the Park to be used in the performance of the contract.

Q-3: Would the Government allow the mulching/chipping/mastication of the existing pile of logs and spread the chips/mulch over the forest floor in either the area closest to the logs (previously mulched area), or for mulch?

R-3: Logs can be moved to locations outlined in this contract and mulched, but must meet specs for mulch.

Q-4: Would the Government allow the mulching/chipping/mastication of other non target trees of less than 6" DBH to allow easier access and mulching/mastication of the target trees?

R-4: If the Contractor needs to remove non-target trees to make access easier, Contractor is to first receive approval from appropriate Park authority. If approved, this shall occur at no additional cost to the

Government. The Park individuals with that authority will be named after a contract has been awarded.

Q-5: Will the government allow the mulching/chipping/mastication of dead and downed trees, logs, regardless of the size to allow easier access to the target trees?

R-5: If the Contractor needs to remove dead and downed trees to make access easier, it will be allowed; however, at no additional cost to the

Government.

Q-6: Would the Government approve after-hours and weekend work on rare occasions when the weather and ground conditions are favorable and prior to future forecasted weather events that could possibly shut project down?

R-6: After-hours and weekend work will not be allowed as this would cause overtime of relevant

Park personnel.

Q-7: Will Contractor be able to move locations if the area was too wet to work?

R-7: First, "too wet to work" means that ground conditions are as such that damages to the resources are, or would be, occurring greater than that which is allowed in the

SOW/Specifications. The grounds may be wet but if resource damage is not occurring, then work can continue in that area. If it is deemed "too wet to work", then Contractor can move to a different area within that unit, or the Park

Q-8: Does Honey Locust need to be removed?

R-8: Honey Locust is not mentioned in the Scope of Work; therefore, Contractor will not be asked to remove it.

Q-9: Is there any requirement on chip size?

R-9: No requirement on chip size, just chip depth.

Q-10: Will UTV's or ATV's be allowed on job site?

R-10: No.

Q-11: Asked to clarify, pulling mulch away from base of trees 4' radius.

R-11: All mulch compiled at the base of the tree must be raked back 4'. Raking should only be mulch. No leaf litter or duff layer.

Q-12: Was asked if several different types of equipment would be allowed?

R-12: Yes, if meeting the requirements set forth in the SOW and Specifications. Submit the equipment you would plan to use in your Technical

Approach (Item 2.) of your quote submission.

Q-13: It was asked if they could get a copy of the past contract SOW?

R-13: As the CO, I am of the opinion this is not relevant for the purposes of submitting a quote for the requirement under this solicitation. If you feel you need this documentation, you may search for it at www.fbo.gov, and is archived under 140P6219Q0003.

Q-14: Clarify the 3% damage to trees within the unit.

R-14: This is referring to mortality of trees, not damage. For instance, a broken limb from a tree would not be considered as part of the 3%, but a tree that has been scarred and damaged to a point that it will die, will be part of the 3%.

Q-15: Are there any areas to stay away from?

R-15: Yes, within Unit #1, there is a historic house site and wetland area. Those areas will be flagged before work starts and Contractor is to stay outside of the flagging.

Q-16: Are there any target trees that will be left?

R-16: Yes. Before Contractor starts work in those areas, the Park will mark the target trees that are to be taken. If you were to remove all the target trees in a couple of the areas, it will look like a clear cut.

Q-20: Scope of Work and Specifications, para.

B.2 - Removal of approximately 1,500 pre-cut eastern red cedar logs to an authorized off-site location.

Q-20a: What is an authorized off-site location?

R-20a: Somewhere other than the Park where disposal or receipt of the logs are authorized by the property or business owner of the location where logs will be dropped.

Q-20b: Must they be removed from the Park or can they be mulched or burned in place or at a location within the Park if it is not economically feasible to remove them? If chipped, how and where can the chips be disposed of if not in-place?

R-20b: No burning is allowed. Logs cannot be chipped in place. Logs can be moved to locations outlined in the SOW and Specifications, and be mulched in accordance with the specifications.

Q-20c: Are these logs from the most recent contract?

R-20c: Contracting Officer has determined this question is not relevant for the purposes of submitting a quote for the requirement under this solicitation.

Q-21: SOW and Specifications, para. C.13 - the

Contractor shall have a written safety and communications plan in place for the type of work, conditions, and hazards expected to be encountered in the performance of this contract.

A copy of the contractor's Safety Plan and

Communications Plan shall be submitted and accepted by the Contracting Officer prior to start of work under this contract.

Q-21a: Is there a requirement to maintain or display this or other compliance information?

R-21a: In addition to providing a copy of this to the Contracting Officer prior to start of work, the Safety Plan and Communications Plan is information that Contractor's personnel should be acquainted with. Although not required to be posted, it should be in a location where

Contractor's employees may have access to while working on the contract site.

Q-21b: The RFQ does not specify mandatory safety equipment, fire mitigation planning or equipment, specialized fuel containers, spill mitigation, water quality assurance, etc. Is there a requirement to have any specialized equipment not specified in the contract?

R-21b: OSHA Part Number 1910 contains the standards for Logging operations, which also includes tree thinning operations. Safety specific information and mitigation thereto should be addressed in the Contractor's Safety

Plan, at a minimum, those that are applicable to the tasks being performed under a resultant contract from this solicitation.

Q-22: SOW and Specs, para D.3 - dependent upon terrain and ground moisture content, any low impact rubber tracked

R-22a: The primary criteria is PSI; however, even though the Contractor's equipment meets the

PSI criteria, if damage to the grounds or a negative impact on the Park's resources is occurring in excess of that which is stated in the SOW and Specs, Pea Ridge National Military

Park reserves the right to suspend Contractor's use of any equipment or tools, at no cost to the

Government, regardless of its previous approval by the Park to be used in the performance of the contract.

Q-22b: Equipment?

R-22b: Questions asked by this prospective quoter regarding equipment have been posed and answered elsewhere in this amendment.

Q-23: SOW and Specs, para. F.1.g - After completion of a project area, Contractor is to pull mulch 4 feet away from around the base of all hardwood, saved, and understory trees, and 4 feet away from fences. What is the standard of performance beyond distance; bare ground?

R-23: These answers were previously asked and answered elsewhere in this amendment.

Q-24: Attachment 3, Wage Determination:

Q-24a: Which rate is applicable to this contract?

R-24a: The rate applicable depends on the position classification of the work being performed. For instance, if the worker is filling an Occupation Code of 08340, Tree

Climber, than the hourly rate would be $13.17 per hour plus the benefits as stated, beginning on

Page 2 of the Wage Determination, and as applicable. There may be several of the occupations listed on the Wage Determination that are utilized for contract performance. That is determined by the Contractor.

Q-24b: Is this considered an SCA-covered contract?

R-24b: Yes

Q-24c: Are there any payroll reporting requirements:

R-24c: There are no payroll reporting requirements to the Contracting Officer.

However, accurate records should be maintained in the event the Department of Labor, Wage and Hour

Division conducts an audit of the wages and benefits paid under this federal contract.

Q-25: Is bonding required.

R-25: Bonding is not required, but a Certificate of Insurance in the liability limits cited in the

Q-26: Does this contract contain a liquidated damages clauses?

R-26: No it does not; however, consideration to the Government will be provided by the Contractor in the event of nonconformance or delay by the

Contractor. Such consideration will be that which has been negotiated between both parties and determined to be fair and reasonable.

Consideration will not be provided if the

Government determines the nonconformance or delay is through no fault of the Contractor.

Q-27: Will a work suspension letter be issued when Contractor cannot perform as a result of the

Government's actions; i.e, prescribed burn, special event, etc..?

R-27: That is dependent upon the length of the shutdown. Shutdowns will be determined on a case by case basis; however, the known or typical shutdowns are cited in the SOW and Specs. As long as there is no damage to the Park's resources or unacceptable ground disturbance, work can continue; i.e., use of hand equipment, chipping and spreading of mulch, etc.

2. Potential Quoters are to consider the information furnished in this Amendment 0001 in the preparation of his/her quote.

3. Should any of the information in this

Amendment 0001 contradict, change, add, or delete any instructions, information, or work specifications provided in the original solicitation documents or its attachments, the information contained in Amendment 0001 is deemed to take precedence and will supersede that specific information found to be contrary to, or lacking from the original solicitation documents and its attachments, except when a subsequent amendment has been issued for clarification or
