1.1 Mission: The Statue of Liberty National Monument (SOLNM) is a United States national monument located in the U.S. states of New Jersey and New York comprising Liberty Island and Ellis Island. It includes Liberty Enlightening the World, commonly known as the Statue of Liberty, situated on Liberty

Island, and the former immigration station at Ellis Island which opened in 1892 and closed in 1954. The national monument is located in Upper New York Bay east of Liberty State Park in Jersey City, New

Jersey and southwest of Battery Park at the tip of Manhattan in New York City. The monument is managed by the National Park Service (NPS).

2.0 PERIOD OF PERFORMANCE

The Government anticipates awarding a contract with the following periods of performance, subject to the option period being exercised:

BASE: January 17, 2022 – January 16, 2022

OPTION PERIOD 1: January 17, 2023 – January 16, 2023

3.0 PLACE OF PERFORMANCE:

All work required under this award shall take place at SOLNM. See section 4.0 COVERED

EQUIPMENT for specific equipment locations.

3.1 SOLNM Site Access: All contractor representatives will access SOLNM, through Ellis Island.

Contractor access is available to Ellis Island through the private Ellis Island Bridge, located within

Liberty State Park, Jersey City, NJ 07305. Personnel and associated vehicles will be required to go through a USPP security checkpoint before being allowed to access Ellis Island. Access to Liberty Island is by ferry only. Contractors can use the concession-operated ferry for free. The ferry provides roundtrip service between Battery Park, Ellis Island, and Liberty Island. Ferry times can be found at statuecruises.com. There is also a staff boat which operates before and after the normal visitor ferry. The staff boat schedule changes seasonally and will be provided to the contractor at the time of award.

3.2 Vehicle Parking: Contractor representatives will be allowed to park service vehicles in areas designated by the Contracting Officer Representative (COR). All Contractor vehicles shall have permanent or temporary identification on both sides, of a size sufficient to provide visual identification from at least 20 feet from the vehicle. Vehicles not so identified will not be allowed on premises. All vehicles are subject to search.

Intentionally providing false information in any way will result in denial of the application.

3.3.1.4. Once the application is approved you will be required to arrange an appointment with USPP Administrative

Support to have your photograph taken and ID card issued. You must come in person to Ellis Island Police

Office for this appointment. Digital photographs will not be accepted via email.

3.3.1.5. ID cards will be valid for the anticipated term of the project or for a (1) year period for concessioners and long-term contractors.

3.3.1.6. A replacement ID card will not be issued unless the expired or damaged card is returned. If the ID card is lost or stolen a report must be immediately filed with the U.S Park Police. The USPP case number must be provided to the U.S. Park Police Administrative Secretary prior to issuance of the replacement card.

3.3.1.7 Each mechanic shall display their Park ID, issued by the USPP, on their garment always while on park property.

3.3.1.8 Park ID cards shall be immediately collected and surrendered to the COR in the event an employee leaves the company or is terminated.

EVALUATION METHODOLOGY

Informal Source Selection Procedures will be utilized, and a Technical Evaluation Panel will be convened. An RFQ will be issued IAW FAR Part 13 Simplified Acquisition Procedures and the streamlined solicitation and evaluation procedures allowed in FAR Part 12.6. The Government will award a contract based on the quote that represents the best value to the Government considering price and non-price factors that meet the Government's needs. Best value is defined as the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. Subjective judgment against objective criteria is implicit in the evaluation process. The

Government may award to other than the lowest priced Offerors or other than the highest qualitative rated

Offerors.

Source Selection criteria will be utilized to select a contractor whose quote meets the government's requirements, demonstrating that they have the necessary expertise and positive relevant performance record which gives the government confidence that the contractor will satisfactorily perform the required services at a fair and reasonable price. The successful offeror must meet the Government's technical requirements and all requirements within the statement of work. The factors below are in descending order of importance and when combined, technical and past performance is more important than price. In their technical quote, offerors must demonstrate to the Government that they meet the necessary factors:

1. Technical Capability (NTE 5 pages):

a. Vendor shall demonstrate a full understanding of the maintenance requirements in the Statement of

Work (SOW) and how those requirements will be met during the identified period(s) of performance.

b. Vendor shall demonstrate a full understanding of non-routine response requirements in the SOW and illustrate how those requirements will be addressed in accordance with the applicable response requirements.

2. Key Personnel (Journeyman Elevator Repair Person) Qualifications:

a. Vendor shall demonstrate, via the submission of resumes, that proposed Journeyman Elevator repair personnel retain sufficient technical experience and qualifications to perform the tasks outlined in the

SOW. Resumes shall not exceed 2 pages each and shall only be provided for the personnel being proposed in accordance with the SOW requirements. Resumes shall demonstrate an understanding of comprehensive elevator inspection procedures, the ability to diagnose and troubleshoot elevator and wheelchair lift issues, and the ability to make the necessary repairs across a broad range of machine manufacturers.

b. Vendor shall supply all applicable, and appropriate, certificates and licenses for the proposed key personnel.

https://sam.gov/wage-determination/2015-4187/18 https://sam.gov/wage-determination/2015/4185/17

3. Relevant Past Performance (NTE 3 pages):

a. An evaluation of offeror’s past performance information will be conducted subsequent to the technical evaluation. The offeror must have demonstrated successful completion of contracts of similar size, scope and complexity to that outlined in the SOW. Preference will be given to quotes that demonstrate past performance on a variety of similar equipment.

b. The Government will assess the relative risks associated with each offeror. Performance risks are those associated with an offeror’s likelihood of success in performing the acquisition requirements as indicated by that offeror’s record of past performance.

c. The assessment of performance risk is not intended to be the product of a mechanical or mathematical analysis of an offeror’s performance on a list of contracts, but rather the product of subjective judgement by the Government after it considers all available and relevant information.

d. When assessing performance risks, the Government will focus on the past performance of the offeror as it relates to all acquisition requirements, such as: 1) the offeror’s record of performing according to specifications, including standards of good workmanship; 2) the offeror’s record of controlling and forecasting costs; 3) the offeror’s adherence to contract schedules including the administrative aspects of performance; 4) the offeror’s reputation for reasonable and cooperative behavior and commitment to customer satisfaction; and 5) the offeror’s business-like concern for the interest of the customer.

e. The Government will consider the currency and relevance of the information, sources of the information, context of the data and general trends in the offeror’s performance. The lack of a relevant performance record may result in an unknown performance risk assessment, which will neither be used to the advantage nor disadvantage of the offeror.

Note: Contractors submitting offers without past performance will receive a neutral rating.

f. Offerors shall provide evidence of comparable past work including a minimum of three years of experience performing routine elevator and wheelchair lift maintenance and responding to and performing non-routine emergency and non-emergency repairs. Work shall demonstrate a similar complexity of working with equipment manufactured by a broad array of manufacturers.

Note: Listing completed projects does not address this criterion. A narrative that articulates past experience and description of successful completion of deliveries should be discussed.

When evaluating quotes against the stated source selection factors, the relative strengths, deficiencies, significant weaknesses, and risks supporting the quote evaluation will be considered and documented in the contract file and selection reports. In the evaluation, all non-price factors, when combined, are approximately equal to price.

Clauses

52.212-4 CONTRACT TERMS AND CONDITIONS –COMMERCIAL ITEMS (OCT 2018)

Alternate I (Nov 2021). When a time-and-materials or labor-hour contract is contemplated, substitute the following paragraphs (a), (e), (i), (l), and (m) for those in the basic clause.

(a) Inspection/Acceptance. (1) The Government has the right to inspect and test all materials furnished and services performed under this contract, to the extent practicable at all places and times, including the period of performance, and in any event before acceptance. The Government may also inspect the plant or plants of the

Contractor or any subcontractor engaged in contract performance. The Government will perform inspections and tests in a manner that will not unduly delay the work.

(2) If the Government performs inspection or tests on the premises of the

Contractor or a subcontractor, the Contractor shall furnish and shall require subcontractors to furnish all reasonable facilities and assistance for the safe and convenient performance of these duties.

(3) Unless otherwise specified in the contract, the Government will accept or reject services and materials at the place of delivery as promptly as practicable after delivery, and they will be presumed accepted 60 days after the date of delivery, unless accepted earlier.

(4) At any time during contract performance, but not later than 6 months (or such other time as may be specified in the contract) after acceptance of the services or materials last delivered under this contract, the Government may require the

Contractor to replace or correct services or materials that at time of delivery failed to meet contract requirements. Except as otherwise specified in paragraph (a)(6) of this clause, the cost of replacement or correction shall be determined under paragraph (i) of this clause, but the "hourly rate" for labor hours incurred in the replacement or correction shall be reduced to exclude that portion of the rate attributable to profit.

Unless otherwise specified below, the portion of the "hourly rate" attributable to profit shall be 10 percent. The Contractor shall not tender for acceptance materials and services required to be replaced or corrected without disclosing the former requirement for replacement or correction, and, when required, shall disclose the corrective action taken.

(5)(i) If the Contractor fails to proceed with reasonable promptness to perform required replacement or correction, and if the replacement or correction can be performed within the ceiling price (or the ceiling price as increased by the

Government), the Government may-

(A) By contract or otherwise, perform the replacement or correction, charge to the Contractor any increased cost, or deduct such increased cost from any amounts paid or due under this contract; or

(B) Terminate this contract for cause.

(ii) Failure to agree to the amount of increased cost to be charged to the

Contractor shall be a dispute under the Disputes clause of the contract.

(6) Notwithstanding paragraphs (a)(4) and (5) above, the Government may at any time require the Contractor to remedy by correction or replacement, without cost to the Government, any failure by the Contractor to comply with the requirements of this contract, if the failure is due to-

(i) Fraud, lack of good faith, or willful misconduct on the part of the

Contractor's managerial personnel; or

(ii) The conduct of one or more of the Contractor’s employees selected or retained by the Contractor after any of the Contractor’s managerial personnel has reasonable grounds to believe that the employee is habitually careless or unqualified.

(7) This clause applies in the same manner and to the same extent to corrected or replacement materials or services as to materials and services originally delivered under this contract.

(8) The Contractor has no obligation or liability under this contract to correct or replace materials and services that at time of delivery do not meet contract requirements, except as provided in this clause or as may be otherwise specified in the contract.

(9) Unless otherwise specified in the contract, the Contractor's obligation to correct or replace Government-furnished property shall be governed by the clause pertaining to Government property.

(e) Definitions. (1) The clause at FAR 52.202-1, Definitions, is incorporated herein by reference. As used in this clause-

(i) "Direct materials" means those materials that enter directly into the end product, or that are used or consumed directly in connection with the furnishing of the end product or service.

(ii) "Hourly rate" means the rate(s) prescribed in the contract for payment for labor that meets the labor category qualifications of a labor category specified in the contract that are-

(A) Performed by the contractor;

(B) Performed by the subcontractors; or

(C) Transferred between divisions, subsidiaries, or affiliates of the contractor under a common control.

(iii) "Materials" means-

Fractional parts of an hour shall be payable on a prorated basis.

(B) The rates shall be paid for all labor performed on the contract that meets the labor qualifications specified in the contract. (E) Unless the Schedule prescribes otherwise, the hourly rates in the

Schedule shall not be varied by virtue of the Contractor having performed work on an overtime basis.

(1) If no overtime rates are provided in the Schedule and the Contracting

Officer approves overtime work in advance, overtime rates shall be negotiated.

(2) Failure to agree upon these overtime rates shall be treated as a dispute under the Disputes clause of this contract.

(3) If the Schedule provides rates for overtime, the premium portion of those rates will be reimbursable only to the extent the overtime is approved by the

Contracting Officer.

(ii) Materials.

(1) Quantities being acquired; and

(2) Any modifications necessary because of contract requirements.

(B) Except as provided for in paragraph (i)(1)(ii)(A) and (D)(2) of this clause, the Government will reimburse the Contractor the actual cost of materials (less any rebates, refunds, or discounts received by the contractor that are identifiable to the contract) provided the Contractor-

(1) Has made payments for materials in accordance with the terms and conditions of the agreement or invoice; or

(2) Makes these payments within 30 days of the submission of the

Contractor’s payment request to the Government and such payment is in accordance with the terms and conditions of the agreement or invoice.

(C) To the extent able, the Contractor shall-

(1) Obtain materials at the most advantageous prices available with due regard to securing prompt delivery of satisfactory materials; and

(2) Give credit to the Government for cash and trade discounts, rebates, scrap, commissions, and other amounts that are identifiable to the contract.

(D) Other Costs. Unless listed below, other direct and indirect costs will not be reimbursed.

(1) Other Direct Costs. The Government will reimburse the Contractor on the basis of actual cost for the following, provided such costs comply with the requirements in paragraph (i)(1)(ii)(B) of this clause: None.

(2) Indirect Costs (Material Handling, Subcontract Administration, etc.). The Government will reimburse the Contractor for indirect costs on a pro-rata basis over the period of contract performance at the following fixed price: $0.

(2) Total cost. It is estimated that the total cost to the Government for the performance of this contract shall not exceed the ceiling price set forth in the Schedule and the Contractor agrees to use its best efforts to perform the work specified in the

Schedule and all obligations under this contract within such ceiling price. If at any time the Contractor has reason to believe that the hourly rate…
