About this file
This document is an attachment containing clarifications for a Request for Proposal (RFP) to conduct a Non-Time Critical Removal Action (NTCRA) under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) at the Caneel Bay Resort in the Virgin Islands National Park.
The key details are:
- Excavated soils must be disposed of at a USDA APHIS-permitted facility on the U.S. mainland, and the contractor is responsible for coordinating APHIS inspection of the containers prior to export.
- The contractor will need to use a power washer to remove sediment from an estimated 150 feet of undergrounded drainage swale.
- The RFP requires identification of the CONUS port of entry in the technical proposal.
- This is a best value negotiated procurement set-aside for small businesses, with a NAICS code of 562910 and a size standard of 1,000 employees. The contract will be firm-fixed-price.

Conduct NTCRA under CERCLA at Caneel Bay Resort Virgin Islands NP Attachment 4: Clarifications
1. Will the excavated soils within this project need to be disposed of in a USDA APHIS licensed/permitted landfill on the mainland?
a. We do not anticipate that Bovoni Landfill on St. Thomas will accept excavated soils for disposal.
b. Soils imported to CONUS will need to be disposed at a USDA APHIS-permitted facility.
c. The Transportation and Disposal Plan (Attachment 1, Section 02 61 29 and elsewhere) shall include:
i. The disposal facility’s active APHIS permit.
ii. Planned method(s) to containerize materials in compliance with disposal facility’s APHIS permit.
iii. Evidence from the disposal facility that they are permitted to receive the type of waste (non-RCRA Hazardous Waste or RCRA Hazardous Waste).
iv. Evidence from the disposal facility that they intend to accept the full estimated quantity of that type of waste.
v. Letter from the Department of Agriculture of the state where the disposal facility is located agreeing that the full estimated quantity of waste can be imported to and left in their state.
vi. Name and location of CONUS port of entry.
vii. If the ocean voyage doesn’t end in the state where the disposal facility is located, written permission from relevant authorities of states across which trucked material will travel.
viii. Logistical details to accommodate APHIS inspection (see below).
2. To comply with the United States Department of Agriculture Animal and Plant Health
Inspection Services (USDA APHIS) requirements for the USVI/Puerto Rico export of soil to the US mainland, all excavated material must be inspected by APHIS before it is exported to the mainland. The inspection will be performed and the containers will be sealed and approved (written) by the USDA APHIS for export to the mainland. Often the inspection occurs in San Juan, Puerto Rico. Will NPS work with the USDA APHIS - Puerto Rico Office to have the USDA APHIS personnel onsite at the Caneel Bay Resort for the APHIS inspection?
a. The contractor, not NPS, is responsible for making logistical arrangements with the shipping company to accommodate inspection of the containers and with APHIS to conduct the inspections.
b. Some shippers’ voyages pass through San Juan PR and if this is the case, the shipping company is likely familiar with separating items requiring APHIS inspection and coordinating inspections with APHIS staff in San Juan. APHIS typically does not charge a fee for inspection in San Juan, if it is performed Monday through Friday, 0800-1630 local time.
c. If the voyage will start in St. Thomas and end in CONUS, the contractor must coordinate APHIS inspection on St. Thomas; inspection shall occur in the shipper’s yard prior to loading on the ship. APHIS may charge travel and per

d. Notify APHIS at mobilization with estimated inspection date(s) and location(s), and provide at least two weeks’ notice of actual requested inspection date(s).
e. The disposal facility’s APHIS permit will describe the containment requirements for materials they receive, e.g. use of bags vs bulk-loaded containers.
f. The APHIS inspection includes the exteriors of the shipping containers (refer to Attachment 1, Section 02 51 00) and the materials’ compliance with the requirements of the disposal facility’s APHIS permit.
g. Include the cost of APHIS inspection in CLIN 1, Contract Support Tasks; use Revised Form 3.
3. An estimated 150 feet of drainage swale is undergrounded at the Caneel Bay Resort. The contractor will need to use a power washer to collect and remove the sediment. What is the NPS recommended approved method to reach these areas that are undergrounded for sediment removal?
a. A possible method is water jetting for underground portions of the drainage swale.
4. Section L.4 of the RFP is amended to require identification of the CONUS port of entry in the technical volume; include in Item 5.
