About this file

This document is a justification and approval for other than full and open competition over $150,000. The National Park Service Denver Service Center is seeking brand name equipment including a tank aeration system from Medora Corporation and a UV reactor from Atlantium to address water quality issues at Lake Mead National Recreation Area in Nevada. The aeration system will help manage water storage and ensure compliance with drinking water standards by reducing trihalomethanes, and Lake Mead National Recreation Area has experience with multiple Medora systems already in use. The UV reactor is needed to eliminate quagga mussel settlement in the raw water intake based on successful use at other facilities, as quagga mussels have caused water treatment impairments at this location. A Class A cost estimate was prepared valuing the brand name equipment at $95,000 of the overall $1.2 million project cost.

Estimated value = $44,000.

4. An Identification of the Statutory Authority Permitting Other Than Full and Open Competition:

FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements (for brand name items only)

5. A Demonstration That the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited:

Tank Aeration Equipment: Lake Mead National Recreation Area has installed and is using this brand of aeration system at multiple locations throughout the Park to manage their potable water storage and to ensure compliance with the State’s Safe Drinking Water Act permit requirements. Three aeration systems have been installed to date at the Park are serviced and maintained by the manufacturer to ensure proper operation necessary to meet permit requirements.

Medora Corporation is the sole licensee for the Gridbee model GS-9. Installation by Medora Corporation authorized installers will be necessary to ensure coverage of the machine warranty. Additionally, a service agreement will be required to ensure that all aspects of the aeration unit perform as designed for the life of the unit. Lake Mead NRA has existing service agreements in place with Medora Corporation.

UV reactor: With the recent infestation of the Colorado River System by Quagga mussels, public water entities, as well as, other entities on the River have struggled with maintaining the functionality of their facilities that are location in and under water.

The KL Water Treatment Plant (WTP) has been plagued with a significant impairment to the Park’s ability to conduct water treatment operations to ensure an uninterrupted supply of safe drinking water and meet Arizona Department of Environmental Quality (ADEQ) and federal requirements. The issue with the intractable problem of Quagga mussel infestation is their colonization in intake pumps, floating barge, waterline, continuous microfiltration (CMF) clearwell, basket strainers, connecting piping and the CMF submodules.

Directly related to the Quagga mussel infestation is the ongoing exceedance of the maximum contaminant level (MCL) for Disinfection By-Products (DBP). DBP exceedance has been compounded by the need to feed dilute hydrochloric acid (HCL) solution to preclude reproduction and growth of Quagga mussels in the CMF feed clearwell. The resultant powering of the pH of the treated water is causing further compliance issues with the leaching of lead and copper into the drinking water supply.

The DBP exceedance is ongoing and worsening, in spite of operational changes and installation of a new chlorine feeder, and is believed to be exacerbated by the buildup of biomass in the CMF clearwell and piping consisting of Quagga waste products and dying, dead and decaying Quagga adults and juveniles (veligers).

The selection of the Atlantium UV reactor is based on successful experience at the BOR hydroelectric power plant on Lake Mohave in prevention quagga mussel settlement on their underwater facilities. In addition, treatment has been demonstrated to be successful in at least 3 different facilities in North America with at least 6 active turbines protected in each application over the past 3+ years.

The proposed UV treatment unit has been evaluated by an independent researcher supporting the effectiveness of the solution, and to date, is one a very limited methods of Quagga, or Zebra, mussel treatment that has proven effective with an operational track record of success. All other treatment technologies are still in the initial roll-out phase or of marginal effectiveness, or are not suitable for use at Katherine Landing.

6. A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies:

Notice will be posted as required during solicitation in accordance with FAR 5.102.

7. A Determination By the contracting officer That the Anticipated Cost to the Government Will Be Fair and Reasonable:

A Class A Cost Estimate was prepared for this $1.2 million acquisition, with the total value of the brand name products only $95,000. It is unlikely that the value of this portion of the project will be a major factor in this full and open competition.

8. A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted:

Market research was conducted by NPS for TTHM removal equipment and benchmarking was performed with Bureau of Reclamation for invasive aquatic species removal equipment. Various design elements were considered for the brand name products as discussed above.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302-2 (9) (i) – (iii) for some examples):

From January 2017 to June 2017, Lake Mead National Recreation Area (LAKE) was subject to a consent order from the Arizona Department of Environmental Quality (ADEQ)regarding compliance monitoring for Trihalomethanes (TTHM) and Haloacetic Acids (HAA5 due to exceedance of allowable levels of TTHM and HAA5 as specified by the Arizona Administrative Code.

LAKE has taken mitigating actions such as maintaining lower tank levels, which has been effective in the short term to terminate the consent order, but not viable for long term operations. LAKE also conducted market research and installed an aeration system in multiple tanks, for which Medora Corporation is the exclusive manufacturer. This type of aeration system is recognized by the US EPA as a cost-effective solution to address TTHM compliance.

Use of the aeration system has been proven at LAKE as an effective means to reduce DBP.

The system is designed to remove up to 50% of TTHM as high as 0.112 mg/L, which is appropriate for the water system at LAKE where TTHM levels exceeded 0.08 mg/L at the time of the violation cited by ADEQ.

It is imperative that LAKE continue to comply with all governing drinking water standards, to comply with public health requirements and to avoid the risk of any enforcement actions. Installing equipment that has been proven on site will ensure that the LAKE’s drinking water system adequately addresses TTHM and HAA5.

Use of a system that LAKE has experience with also ensures that the system can be adequately maintained by operators at LAKE, which will ensure that TTHM and HAA5 are effectively mitigated over the life of the system and associated tanks.

This brand name equipment has been included as specific design elements which have been meticulously reviewed, analyzed, and approved throughout this project’s design review process.
