SPECIAL CONTRACT REQUIREMENTS
FOR THE CONSTRUCTION OF
OTTER CREEK CULVERTS
Description of Work
The work to be done under this contract includes all labor, supervision, transportation, equipment, tools, supplies, and materials necessary to remove and dispose of two existing timber bridges and to construct two new single barrel pre-cast concrete box culverts. The project sites are located upstream of Otter Creek Reservoir near Angle, Utah. Work includes installing erosion control, dewatering, clearing and grubbing, constructing new road alignment, installing Contractor supplied pre-cast concrete box culvert and associated wingwalls and cutoff walls, reclamation of the stream embankment, removal of existing bridges, placing riprap, relocating cattle guards, traffic control and signage, and all other work necessary to complete the project. This project is in Piute County off SR 62. The North Otter Creek site is located on the Narrows Road 7 miles north of Angle, Utah at 38° 19’ 31.90” N, 111° 57’ 04.25” W. The South Otter Creek site is located on an unnamed road 3.3 miles at 38° 17’ 41.17” N, 111° 57’ 08.24” W.
Applicable Standard Specifications
The General Requirements (Division 100) and the applicable sections of Divisions 150 through 700 of the Federal Highway Administration’s "Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects, FP-14, U.S. Customary Units" of the U.S. Department of Transportation, Federal Highway Administration apply to this project as modified by these Special Contract Requirements and Contract Clauses contained in the contract. Unless otherwise noted, all reference headings in these Special Contract Requirements refer to divisions, sections, subsections, articles or paragraphs of the Standard Specifications, FP-14. The Contractor shall keep a copy of FP-14 on site during all construction for this project.

PREFACE
Delete the Preface and substitute the following:
These Standard Specifications for the Construction of Roads and Bridges on Federal Highway Projects are issued primarily for constructing roads and bridges on Federal Highway projects under the direct administration of the Bureau of Land Management. These specifications are cited as "FP-14" indicating "Federal Project" Standard Specifications issued in 2014 and contain both United States Customary and Metric units of measure.
When designated in a contract, the FP-14 becomes part of the contract and binding upon all parties to the contract. Construction contracts of the Bureau of Land Management are also governed by the following regulations:

The FAR regulations are not included in the FP-14. A complete copy of the FAR is available from the Superintendent of Documents, Congressional Sales Office, U.S. Government Printing Office, Washington, DC 20402.
U.S. Customary units of measure are used in the FP-14 as provided in the November 25, 2008 Memorandum from Jeffrey F. Paniati entitled Update on Metric Use Requirements for FHWA Documents. Metric units are noted in parentheses following the U.S. Customary Units. The references to Metric or Metric units apply only when the project or portion of the project expressly calls for Metric units of measure.

Section 105. – CONTROL OF MATERIAL
105.02 Material Sources.
(a) Government-provided sources. Delete in its entirety, and substitute the following:
Common borrow material from the Narrows Pit Quarry near the near job site just off HWY 62 located approximately 2 miles from the North Otter Creek Bridge site (N38°19’15.74” W111°57’56.44”) shall be used for the construction of the road and backfill for the box culvert. The material shall be screened for 4 inch minus material before using it for the road or backfill material.
The quality of the material is generally acceptable. Variations in quality should be expected as it is not feasible to ascertain the quality of material for an entire deposit from exploratory samples. Determine the quantity, type of equipment, and work necessary and produce acceptable material to be incorporated into the work. Do not perform aggregate source quality tests listed in the Sampling, Testing, and Acceptance Requirement table of other Sections when using Government-provided sources. Perform standard proctor according to AASHTO T99 on government furnished borrow.
(c) Contractor-located source. Delete in its entirety, and substitute the following:
The Contractor is responsible for Contractor-located material sources, including established commercial material sources. Use sources that fulfill the contract quantity and quality requirements. Determine the quantity, type of equipment, and work necessary to select and produce an acceptable material. Perform aggregate source quality tests and acceptance requirements in accordance with Section 703.
105.05 Use of Material Found in the Work. Delete in its entirety.
105.06 Material Source Restoration. Delete in its entirety and substitute the following.
Restore government-provided sources by knocking down all created head walls in the Narrows Pit upon completion of the work at no cost to the Government. Do not measure restoration of material sources for payment.
Section 106. – ACCEPTANCE OF WORK
106.05 Statistical Evaluation of Work and Determination of Pay Factor. Delete in its entirety, including all references to Statistical Evaluation. All references to Section 106.05 shall be replaced with references to Section 106.04 Measured or Tested Conformance.
106.06 Inspection at the Plant. Delete in its entirety.
Section 107. – LEGAL RELATIONS AND RESPONSIBILITY TO THE PUBLIC
107.01 Laws to be Observed. Delete in its entirety and substitute the following.
In accordance with the Archaeological Resource Protection Act, there shall be no disturbance of any buried or surface archaeological or historical sites, including graves, and no collection of any artifacts whatsoever. Also, collection of vertebrate fossils (fossil bones or teeth), including mammoth and mastodon bones, tusks etc., or any other significant fossils is strictly prohibited. If any archaeological, historical, or fossil resources are encountered during construction, operation, maintenance, or termination then all artifacts, graves, or fossils will be respectfully left in place, and gently covered. The Contractor, or any person working on their behalf will then suspend all operations within 100 feet of the discovery. The Contractor shall immediately notify the CO and COR of the discovery. The COR will then immediately contact the BLM Richfield Field Office’s Authorized Officer (AO) and their cultural resources staff. An evaluation of the discovery will be made by the AO in consultation with their cultural resources staff to determine appropriate actions to prevent the loss of significant cultural and scientific values or to respond to any Native American Graves Protection and Repatriation Act discoveries.
107.02 Protection and Restoration of Property and Landscape. Delete in its entirety.
107.03 Bulletin Board. Delete in its entirety.

(b) Oil and hazardous substances. Delete in its entirety and add the following:
Submit a Hazardous Spill Plan, prior to construction, stating what actions will be taken in case of a spill, notification procedures, and specific cleanup and disposal instructions for different products. This plan will also incorporate preventive measures to be implemented, such as the placement of refueling facilities, storage, and handling of hazardous materials, etc. Immediately notify the Contracting Officer of all hazardous spills. Spill plan shall always be available on site, in addition; at least one worker on site will be trained in spill containment.
Power equipment shall be refueled at least 200 feet from any stream, or as far away as possible.
Immobile equipment shall have absorbent pads placed under them to capture any petroleum products that may leak and be stored a minimum of 200 feet from any stream. All vehicles operating within 150 feet of a live stream shall be inspected daily for fluid leaks before leaving the staging area. Any leaks will be repaired before the vehicle resumes operation. Inspections shall be documented, and a copy provided to the COR.
Contractor shall have a SPILL RESPONSE KIT on the project whenever equipment is operating. The spill kit shall be sufficient to absorb 34 gallons of oil and designed to float on the surface while absorbing oil and repelling water. The kit shall meet or exceed the physical properties of “new pig products spill kit #408”. Oil-absorbing, floating booms shall be installed at both sites just downstream of construction activities.�
Any and all spills of chemicals, including petroleum products, shall be immediately contained, cleaned up and shall be disposed of, in accordance with State and Federal regulations.
(e) Project specific Environmental Protection. Add this section:
The Government may direct the Contractor to discontinue all operations in event that:
1) No construction or routine maintenance activities shall be performed during periods when the soil is too wet to adequately support construction equipment. If such equipment creates ruts in excess of 4 inches deep, the soil shall be deemed too wet to adequately support construction equipment.
2) In order to reduce the potential for the introduction of noxious weeds, all equipment would be cleaned by pressure washing, prior to operating in the project area. Removal of all dirt, grease, and plant parts that may carry noxious weed seeds or vegetative parts is required and may be accomplished with a pressure hose.
3) The project area would be monitored for weed presence following implementation and measures would be taken to control any new invasions.
4) Use of pesticides was analyzed in detail under the Programmatic Noxious Weed and Invasive
Plant Management EA (# DOI-BLM-0300-2011-009-EA). This EA analyzed 18 BLM approved active ingredients. Use of pesticides shall be in conformance with this EA along with applicable Federal and state laws. Pesticides shall be used only in accordance with their registered uses and within limitations imposed by the Secretary of the Interior. Prior to the use of pesticides, the holder shall obtain from the authorized officer written approval of a plan showing the type and quantity of material to be used, pest(s) to be controlled, method of application, location of storage and disposal of containers, and any other information deemed necessary by the authorized officer. Emergency use of pesticides shall be approved in writing by the authorized officer prior to such use.
5) If any cultural or paleontological resources are exposed during the proposed action, work must stop at that location and a qualified BLM representative must evaluate the find.
6) Vegetation removal should be avoided during migratory bird nesting season (April 1- July 1 for non-raptor; January 1- August 31 for raptor species). A variance to this may be granted upon completion of a raptor/migratory bird survey by a qualified wildlife biologist. Surveys would be completed 7-10 days before construction begins. If active nests were located, appropriate spatial and temporal buffers would be applied.
7) Surface disturbing activities should be avoided during Greater Sage-grouse (Centocercus urophasianus) breeding (February 15-June 15), brood reading (April 15-August 15), and winter (November 15-March 15) periods. Modifications to these dates may be granted by a qualified wildlife biologist based on site-specific conditions. Field verification would be completed 7-10 days before construction begins.
8) If vegetation removal is needed, a survey for migratory birds and Greater Sage-grouse shall occur during breeding seasons by the government.
9) Revegetation of disturbed soils would occur shall be done by government.
10) A stream alteration permit would be obtained, and all permit requirements would be implemented. If necessary, a preconstruction notification would also be submitted to the U.S.
Army Corps of Engineers.
11) Only properly operating, well-maintained construction equipment would be used onsite.
Section 108. – PROSECUTION AND PROGRESS

This work consists of controlling and protecting traffic adjacent to the project area. This section supplements FAR Clause 52.236-13, Accident Prevention.
156.03 Qualifications. Delete in its entirety.
156.04 Accommodating Traffic During Work: Add the following:
The Contractor shall be responsible for maintaining at least one bridge crossing as a temporary by-pass road during the construction of the new road alignments and culverts. This will allow public access to the area during construction. Contractor shall provide the Government at least 15 days advance notice prior to any temporary road closures, so that the Government may post the necessary closure notices.
Contractor shall submit a traffic control plan for approval prior to beginning work. Traffic Control Plan shall meet MUTCD) and include the use of temporary signs for the duration of the work.
156.05 Maintaining Roadways During Work: Delete in its entirety and substitute the following:
Maintain the roadway in a safe and acceptable condition. This includes using a water truck and grader as needed to keep the roadway in operational condition during construction. If corrective action is requested and the corrective action is not taken immediately, the condition may be corrected by the Government, and the cost of the corrective action deducted from monies due to the Contractor.
156.08 Nighttime Operations. Delete the second paragraph.
156.09 Traffic Control Supervisor. Delete in its entirety.
156.10 Qualifications. Delete in its entirety.
Section 157. – SOIL EROSION AND SEDIMENT CONTROL

The Contractor shall submit an Erosion Control Plan for approval. The Erosion Control Plan shall typically detail how the Contractor will control sediment and protect downstream water quality. The plan shall be submitted no less than 7 days before any work that disturbs the site.

EARTHWORK
Section 201. - CLEARING AND GRUBBING
201.02 Conform to following Subsections: Delete in its entirety.
201.03 General. Delete in its entirety and replace with the following:
Do not disturb vegetation outside of the construction area. If vegetation outside the construction limits is disturbed, Contractor shall repair or replace the vegetation at no cost to the Government.
Government will reseed disturbed areas within the construction limits.
201.06 Disposal. Delete in its entirety and substitute the following:
Woody and vegetative, fencing, concrete abutments, and timber bridge material shall be removed from site and disposed of in a legal fashion.
Section 203. – REMOVAL OF STRUCTURES AND OBSTRUCTIONS
203.01 Delete in its entirety and substitute the following:
This work consists of removing the North and South Otter Creek Bridges.
203.03 Salvaging Material. Delete in its entirety and substitute the following:
Salvage with reasonable care materials designated to be salvaged. Salvage cattle guards and associated bases for reinstallation at locations shown on the drawings.
At South Otter Creek, salvage cattle guard bases that are currently being utilized as channel bank protection. These cattle guard bases shall be stockpiled on site adjacent road.
203.04 Removing Materials. Delete in its entirety and substitute the following:
Remove all abutments and bridge materials from the channel. Existing bridges are timber construction with concrete abutments. North Otter Creek Bridge is approximately 12 feet wide by 16 feet long.
South Otter Creek Bridge is approximately 12 feet wide by 19 feet long.
203.05 Disposing of Material. Delete paragraphs (b), (c), and (d).
Section 207. – EARTHWORK GEOSYNTHETICS
207.01 Add the following:
Separation geotextile shall be a woven Class 1 geotextile per Table 714-1.
207.03 General. Add the following:
Place separation geotextile between embankment and riprap adjacent to culvert wingwalls, riprap lining the upstream channel banks shall also have a separation geotextile place between the bank and the riprap.
Section 208. –STRUCTURE EXCAVATION AND BACKFILL FOR SELECTED
MAJOR STRUCTURES
208.03 General. Delete in its entirety and substitute the following:
Follow OSHA safety regulations 29 CFR. Part 1926, Subpart P, Excavations for sloping the sides of the excavation. Provide necessary safety features around the excavation.
Clear the area of vegetation and obstructions according to Sections 201 and 203.
Request approval from the CO as to the character and suitability of the foundation material when the excavation is complete. Provide a firm foundation with uniform density throughout its length and width.
Blasting rock is not allowed.
Remove safety features when no longer necessary.
208.04 Channel Preservation. Delete in its entirety.
208.05 Cofferdams. Delete in its entirety.
208.06 Foundation Seal. Delete in its entirety.
208.07 Dewatering. Delete in its entirety and substitute the following:
Contractor shall notify the COR a minimum of 14 calendar days in advance of all plans to construct, alter or remove dewatering measures so that the any requirements the US Army Corps of Engineer permit may require fish salvage efforts, as necessary. Generally, this is completed by the Utah Division of Wildlife Resources. Fish salvage efforts will take approximately 2 days over the course of a work week and time to set up nets. Contractor shall be responsible for all coordination according to their stream channel alteration permit.
Contractor shall submit dewatering plan for approval prior to initiating any dewatering activities.
Dewatering plan shall include the following:
(a) Drawings with the locations of all dewatering measures to be utilized.
(b) Description of how the dewatering measures will be altered to facilitate construction over throughout the project.
(c) A list of equipment and materials that will be utilized in the dewatering effort.
Any pumps utilized to draw water or reroute water shall have Utah Department of Fish and Wildlife approved fish friendly screens on the intake side.
Dewatering measures shall be in place prior to any excavation or clearing and grubbing activities. Any dewatering necessary within the active foundation excavation shall include the use of a silt control collection bag to capture sediment prior to the water being released downstream.
208.10 Compacting. Delete in its entirety and substitute the following:
Compact according to Subsection 204.11 (a).
If less than 80 percent is retained on the No. 4 sieve, classify the material according to AASHTO M145.
Adjust the moisture content to a level suitable for compaction. Use nonvibratory rollers at speeds less than 6 feet per second and vibratory rollers at speeds less than 3 feet per second. Compact each layer of material full width according to Subsection 204.11 (a).
Do not apply density requirements as measured by AASHTO T 310 to materials incapable of being tested or compacted to maximum values determined by AASHTO T 99. For these materials, fill the voids around the rocky material in each layer with earth or other fine material. Compact each layer until there is not visible evidence of further consolidation.
Section 209. –STRUCTURE EXCAVATION AND BACKFILL
209.04 Channel Preservation. Delete in its entirety.

209.08 Bedding. Delete in its entirety and substitute the following:
Place and grade base rock in compacted layers not exceeding 6 inches in depth. Compact each layer according to Subsection 209.10. Place and grad bedding material in one layer and compact according to Subsection 209.10.

Section 602. –CULVERTS AND DRAINS
602.01 Delete in its entirety and substitute the following:
This work consists of furnishing and installing two single barrel precast concrete box culvert with overall dimensions of 24’ -0” +/- wide by 18’-0” long (not including wingwall dimensions). Minimum interior opening of each culvert barrel shall be 24.0’ wide by 6.0’ high. Culverts shall include concrete wingwalls, cut-off walls, and curbs.
602.03 General. Add the following:
For the pre-cast concrete culverts provided by the Contractor, structural load calculations shall be performed and submitted to the COR for the following design and legal truck configurations: HL93, Type 3, Type 3S2, Type 3-3, NRL, Special Hauling Vehicles SU4 through SU7, and Emergency Vehicles EV2 and EV3. Load rating calculations shall provide rating factors for each of these truck configurations. For the HL93 design vehicle, both an inventory and operating rating factor shall be calculated and provided. Utilize AASHTO’s Load and Resistance Factor Rating (LRFR) method when performing structural load rating calculations.
Structural load rating calculations shall be signed by a professional engineer registered in the state where the culverts will be to be located or in the state where the fabricator’s offices are located. Contractor shall also submit structure model using BRASS software and any computer runs and data files used in the analysis, as well as the input files for the model. Submit a final model capable of analyzing permit vehicles for the structure. If alternative load rating software is required and/or used, provide a brief summary of the applicability over BRASS. All alternative software requires approval prior to load rating.
Load rating related submittals shall be submitted to the COR prior to request for final payment.
Section 619. – FENCES, GATES, CATTLE GUARDS, AND BOLLARD POSTS
619.03 Fences and Gates: Add the following:
(C) Wire fences and gates – Provide all labor, materials, and equipment to reinstall install fence at cattle guards as shown on plans. Contractor shall remove the metal gates in a manner which will not damage metal gates. All metal gates shall be return construction to the government.
619.07 Cattle Guards: Add the following:
Contractor shall remove the existing cattle guard without damaging the cattle guard and concrete foundations. All cattle guards shall be reinstalled at the grade of the finished road.

Section 703. – AGGREGATE
703.05 Subbase, Base, and Surface Coarse Aggregate. Delete in its entirety and substitute the following:
Furnish hard, durable particles or fragments of crushed stone, crushed slag, or crushed gravel meeting the appropriate gradation from BLM borrow site. Furnish a material that is free from organic matter and lumps or balls of clay. Do not use material that breaks up when alternately frozen and thawed or wetted and dried.
Section 705. — ROCK
705.02 Riprap Rock. Delete in its entirety and substitute the following:
Select hard, durable, angular rock that is resistant to weathering and water action and free of organic or other unsuitable material. Angular rock is characterized by sharp, clean edges at the intersections of relatively flat surfaces. Do not use shale, rock with shale seams, or other fissile or fissured rock that may break into smaller pieces in the process of handling and placing.
