STATEMENT OF WORK – June 2022

YELLOW CREEK SHOOTING RANGE LEAD REMEDIATION

Township 4 North, Range 3 East, SE corner of Section 15.

GENERAL INFORMATION

Background: The Yellow Creek Shooting Range is a public firing range located approximately 4 miles south of Lead, SD in Lawrence County. The range was developed in 1979 and has been utilized by the public for recreational shooting, police training and South Dakota Game Fish & Parks youth events. It had been leased under the Recreation and Public Purposes Act since 1979 until 2015. While it was under lease, there has been no documented cases of lead remediation at the site. The site is undergoing numerous construction projects to improve safety and functionality so the need to remove lead from the berms prior to them being relocated is needed. Berm relocation is not part of this contract. The Yellow Creek Range is remote, unmanned, unsecured facility with no electricity. It is currently available to the public at all hours of the day. The firing range is an outdoor facility of approximately 7 acres consisting of 100-yard, 200-yard and 300-yard berms. There is good access to the shooting range and within the shooting range to get equipment to the base of the berms.

Points of Contact:

Task Order Contracting Officer (CO):

Rebecca Undlin – (406) 233-2829, rundlin@blm.gov

Task Order Contracting Officer Representative (COR):

Ryan Larson – (605) 892-7033, rlarson@blm.gov

Scope of Work: In carrying out work under this contract, the contractor shall furnish, unless otherwise specified, all labor, supervision, equipment, supplies, and materials necessary to accomplish removal of heavy metal particulates (lead) located at the Yellow Creek Shooting Range. All trash and shooting stand material will be removed by the Bureau of Land Management prior to the contract start date.

The objective of this contract is to screen the material from the face of the berms, directly in front of the firing line, and in front of target stands, in order to remove heavy metal particulates to provide a safe and healthy environment for the public. All lead fragments 3/16” and larger must be removed from the treated material. Once the range material has been processed, the material must be stockpiled at a designated location within the shooting range to be used on the reconstructed berms. Lead removed from the soil will be containerized and transported to an approved recycling center by the contactor.

The contractor will be required to remove the top 2” of surface material beginning at the firing line to the 100-yard berm (see attached map). This area was utilized for ground targets and contains bullet fragments throughout. There is also approximately 200 cubic yards of berm material to be processed from the 100-yard, 200-yard, and 300-yard berms. Berm material should be excavated to a depth of approximately 12” to capture as much of the lead as possible. The shooting range material in both the berms and on the surface is primarily rock (see attached pictures for reference).

Estimated Quantity of Material:

Location
Quantity (Cubic Yards)
Berm Material to be processed
200
Firing Line to 100-yard Target (2” topsoil removal)
250

All work performed by the contractor under this contract shall be conducted in full compliance with Federal, State and local environmental regulations. The contractor shall be responsible for ensuring that their employees and other personnel are adequately protected from all hazards encountered during the course of the work.

Contractor will be paid by the cubic yards of material treated according to the schedule of items. Any additional quantities treated shall be pre-approved by the Contracting Officer.

Period of Performance: Project needs to be completed by September 31st, 2022.

Quality Assurance: The government has the right to inspect all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections in a manner that will not delay the work.

Site Access: The shooting range site is located approximately 3 miles south of Lead, SD. Access to the site is by taking Highway 385 south from Deadwood, SD, turn right after approximately .3 miles onto Kirk Road. Once on Kirk Road, travel 1.7 miles to the west and turn south on Yellow Creek Road. Travel Yellow Creek Road for approximately 3.6 miles and the shooting range will be on the left.

While the contractor is on site, the shooting range will be closed to the public to ensure the safety of the contractor, employees, and equipment.

Recycling: It is the intent of this contract to recycle all removed heavy metal particulates to the greatest extent possible. The contractor may propose an alternate means of managing heavy metal particulate and debris for removal by the CO. The contractor shall arrange for and coordinate recycling of all bullet fragments to the greatest extent possible by:

· Verifying that the recycling facility specifically recycles heavy metal fragments and other incidental materials.

· Verifying that the recycling facility has all required Federal, state and local permits and approvals for heavy metal recycling.

· Accomplishing all handling, transportation, disposal and documentation requirements necessary, including loading material for transport. The contractor shall comply with all DOT shipping requirements, including labeling, placarding, training, and manifesting. The contractor shall provide certified weights of all containers.

The contractor shall provide Safety Data Sheets (SDSs) to the CO for all hazardous materials used during the project. Usage of all hazardous materials shall be tracked and reported to the CO.

Submittals: All required submittals shall be provided to the CO for approval.

The contractor shall submit for approval written evidence of training that demonstrates their personnel have been properly trained for lead abatement work (i.e., lead worker, lead supervisor, etc.) prior to commencement of work on site.

The contractor shall provide reports to the task order CO and the task order COR. The task order CO requires an electronic version only.

The contractor shall provide certification that the recycling facility selected shall, to the greatest extent practicable, recycle all bullet fragments and any other excess material generated under this contract. The contractor shall provide a description of the method or recycling and information regarding the recycling facility along with documentation of proof of recycling.

Applicable Documents: The contractor shall comply with all applicable federal, state and local environmental statutes, instructions, manuals, handbooks, regulations, guidance, policy letters, and rules. It is the contractor’s responsibility to identify all applicable federal, state and local environmental statutes, instructions, manuals, handbooks, regulations, guidance, policy letters, and rules for all work performed and apply the procedures and protocols required.

Safety Requirements: The contractor shall be responsible for protecting the lives and health of employees and other persons on the work site; preventing damage to property, materials, supplies, and Health Administration (OSHA) regulations. The contractor shall perform all operations in a prudent, conscientious, safe and professional manner and conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.
