About this file
This document is a Questions and Answers (Q&A) file for a federal fence construction contract solicitation issued by the Bureau of Land Management (BLM). The contract involves fence installation and modification, with a 270-calendar-day performance period. Key contract details include requirements for deadman installation (using rocks or T-posts), wire tension standards, and specific construction guidelines such as no concrete usage for fence structures. Bidders must provide a 20% bid bond when submitting and 100% performance and payment bonds if awarded, with pricing required to remain valid for 60 days. The contract allows alternative construction methods like "A-frame" structures where terrain prevents standard installation, and specifies that wildlife markers will only be installed on completely rebuilt fence sections. Wood materials can be scattered on-site, but all metal materials must be removed.

NOTE: Contractor shall not move the location of the fence line and/or fence structures without approval by the COR.
Question 1: We have noticed there is no line item on the bid schedules for a deadman, but have noticed them referenced in the fence specification attachment. Per a physical site visit, we know deadmans are a necessity. Will they be added to the bid schedules as their own line item? Or are you including them in another listed line item?
Answer 1: Contractor shall install deadmen as necessary along the fence line to maintain proper wire spacing and height in uneven terrain. The installation of a deadman is not an identified bid item.
Consequently, each deadman installed shall be billed as the same as the installation of a new “T” post (bid item 19).
Question 2: Where rocks are not readily available along the fence line to use for rock deadmans, may we substitute 1 or 2 T-posts to create a deadman?
Answer 2: If a deadman is necessary it is permissible to utilize either a rock or two t-posts, installed at angles creating an “x” inline with the existing fence line. Wire would be attached to the t-posts where they cross.
Question 3: I want to make sure I understand Section L.19 Volume 3: Factor 2, Past Performance Letter
(c) page 67 of the solicitation correctly. The statement says: "Request for Past Performance shall be sent by offerors to those references provided above in (a). References shall return requests directly via e-mail to pfort@blm.gov." Could you please confirm: 1.) Are we, as the offeror, responsible for sending a specific past performance questionnaire or form to our listed references? 2.) If so, will the questions or form be provided in the solicitation package, or should we create our own? 3.) Should we notify our references to email the completed questions or form directly to you at pfort@blm.gov, without routing it back through us? Thank you for helping me ensure I follow the instructions as intended.
Answer 3: (1) See L.19 Volume 3: Factor 2 (c); (2) There is not a specific form so your format will be accepted. (3) ) See L.19 Volume 3: Factor 2 (c).
Question 4: There are boxes and questions on pages 51 through 59 which cause us to think we are responsible for answering them and providing the answers to you. Are these questions a part of our SAM registration, so as long as our SAM registration is current and up to date within 12 months, we do not need to provide the update here for this solicitation? Are we understanding that correctly?
Answer 4: These pages do not need to be completed as they are a duplicate of information available in
SAM.gov.
Question 5: Please confirm we are understanding the following accurately: we must provide a bid bond at
20% of original contract price when we submit our bid. Then, if awarded, we must provide a performance bond at 100% of original contract price and a payment bond at 100% of original contract price within 10 days. This information is based on what we read in section I.13 52.228-15 Performance and Payment
Bonds--Construction (Jun 2020) on page 33 of the solicitation.
Answer 5: That is correct.
Question 6: Please confirm we are understanding the following accurately: If we fail to "...execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default." Which this results in us, the contractor, to be liable for the cost difference between our original contract price and the newly awarded contractor’s bid price. This information is based on what we read in section L.5 52.228-1 Bid Guarantee (Sep 1996)
Letters (d) and (e) on page 61, as well as, in section L.13 Performance and Payment Bonds on page 63.
Answer 6: That is correct as stated in the Federal Acquisition Regulations (FAR).
Question 7: Will the period of performance on page 3 of the solicitation also known as Optional Form
336 be updated to reflect Friday, June 12th (which is technically 270 days) as the end of the performance period or will we actually have until Saturday, June 20th, which would end up being Monday, June 22nd due to June 20th being a weekend day?
Answer 7: The period of performance will be 270 calendar days from the date of the issuance of the
Notice to Proceed.
Question 8: Are submitted proposals required to be valid for a minimum of 90 days as stated in section
L.14 Supplemental Instructions – Preparation of Proposal – Competitive Acquisition, letter B. General, number (11) on page 64 of the solicitation? Or are submitted proposals required to be valid for a minimum of 60 days as stated on page one of the solicitation on SF 1442 box 13 letter (d)? Or maybe these numbers are representing two different values such as 60 days to receive word from the government on being awarded or not awarded the contract; and the 90 days represents that our price shall be valid for at least 90 days?
Answer 8: The pricing must be valid for 60 days.
Question 9: If wire can be stretched tight it is considered fine?
Answer 9: Wire that can be stretched to proper tension without breaking shall be considered functional and will not require replacement.
Question 10: Do steel brace posts need set in concrete?
Answer 10: No concrete shall be used for the installation of fence structures.
Question 11: Can two t posts connected at top and wire looped around wire down to rock as in picture in schedule c be an approvable method in lieu of drilling?
Answer 11: Construction of “A frames” (two T-posts crossed at the top and wired down to a rock) can be utilized in place of a rock drill where terrain prohibits vehicle access, with approval from the COR.
Question 12: Wood that is being replaced can it be left at fence line?
Answer 12: Wood removed from the fence line can be scattered on site. All metal material must be removed.
Question 13: I didn’t see detail of wildlife markers on plans.
Answer 13: Wildlife markers would only be installed where sections of fence are being completely removed and rebuilt.
