Questions and Answers 3
1. The BIDDING SCHEDULE issued in addendum 1 lists an item after BASE TOTAL for OVERHEAD AND PROFIT (percentage) which is pre-filled with a zero in the dollar value column. What is the purpose of this item, or it’s intended use? Will any additional work that may be requested by the Owner be subject to this percentage during the project as well? Since this will become public knowledge, it may put contractors at a disadvantage for future projects with this being disclosed to competitors.
Answer: The bid schedule is not public knowledge. Just the lump sum amount. However, when the bid schedule is attached to the contract award it can be requested via a FOIA request.
However, per 15.403-3(b) the line items of the bid schedule would be redacted on a FOIA request and only the lump sum amount would be visible. The breakout of pricing on the bid schedule helps the Government determine that the price is fair and reasonable.
FAR 24.202 Prohibitions.
(a) A proposal in the possession or control of the Government, submitted in response to a competitive solicitation, shall not be made available to any person under the Freedom of Information Act. This prohibition does not apply to a proposal, or any part of a proposal, that is set forth or incorporated by reference in a contract between the Government and the contractor that submitted the proposal. (See 10 U.S.C.2305(g) and 41 U.S.C.4702.)
(b) No agency shall disclose any information obtained pursuant to 15.403-3(b) that is exempt from disclosure under the Freedom of Information Act. (See 10 U.S.C.2306a(d)(2)(C) and 41 U.S.C.3505(b)(3).)
2. There is a fair amount of concrete rubble in the existing rip rap, can this material be reused as part of the salvage and reinstall or will that need to be disposed offsite?
Answer: Please remove and dispose of any concrete rubble mixed in with the existing rip rap.
Please reuse rip rap.
3. Near station 0+00 on east side of project, there is a corner post system for the existing fence. Is this part of the remove and reinstall?
Answer: If the fence post interferes with final site grading and restoration, remove and reinstall after final site grading. If posts are outside of area of construction disturbance, leave as is.
4. Several feet of the existing fence to be removed and reinstalled is knocked down and posts are bent/damaged, wire down and potentially broken. Are and additional items needed to reinstall the fence incidental?
Answer: Please replace any wire fencing or posts that need replacement. These items should be incidental to the project. Contact COR if more than 50 linear feet of fence need replacement.
5. At the existing spillway on the west side there is a fence system not shown on the plans. Does this need to be reinstalled back to the new structure wall?
Answer: If fence interferes with final site grading or construction activities, remove and replace at conclusion of construction. If outside of limits of construction, leave as is.
6. Reference plan Sheet No. S1, General Structural Notes, C. Concrete, 1. “Self-consolidating concrete shall be used in labyrinth weir walls.” . We request using the same mix design for the weir walls that will be used for the spillway walls, a standard mix design per spec. The weir walls contain less than 5 CY per each and based on my understanding of the specifications will require three pours (two contraction joints) per wall. We do not believe the local ready mix supplier will provide a quote for SCC concrete for the small volume and limited pours. Also, no specification requirements are provided for an SCC mix. Please clarify.
Answer: Self-consolidating concrete is not required for the labyrinth walls. The contractor shall ensure an appropriate mix design, formwork, and consolidation is provided to ensure the labyrinth walls are constructed to the dimensions as shown on the drawings. Prior to construction, the contractor shall submit the mix design for approval.
7. It appears that there is only one weir wall construction joint required per wall. Please confirm.
See attached plan sheet for locations.
Answer: No additional construction joints are required.
