(2) “Confidential commercial or financial information” means any business information (other than trade secrets) which is exempt from the mandatory disclosure requirement of the Freedom of Information Act, 5 U.S.C. 552. Exemptions from mandatory disclosure which may be applicable to business information contained in proposals include exemption (4), which covers “commercial and financial information obtained from a person and privileged or confidential,” and exemption (9), which covers “geological and geophysical information, including maps, concerning wells.”
(b) If the Offeror, or its subcontractor(s), believes that the proposal contains trade secrets or confidential commercial or financial information exempt from disclosure under the Freedom of Information Act, (5 U.S.C. 552), the cover page of each copy of the proposal shall be marked with the following legend:
“The information specifically identified on pages ______ of this proposal constitutes trade secrets or confidential commercial and financial information which the Offeror believes to be exempt from disclosure under the Freedom of Information Act. The Offeror requests that this information not be disclosed to the public, except as may be required by law. The Offeror also requests that this information not be used in whole or part by the government for any purpose other than to evaluate the proposal, except that if a contract is awarded to the Offeror as a result of or in connection with the submission of the proposal, the Government shall have the right to use the information to the extent provided in the contract.”
(c) The Offeror shall also specifically identify trade secret information and confidential commercial and financial information on the pages of the proposal on which it appears and shall mark each such page with the following legend:

The Offeror will also be promptly notified of the request and given an opportunity to provide additional evidence and argument in support of its position, unless administratively unfeasible to do so. SECTION 5
EVALUATION FACTORS FOR AND BASIS FOR AWARD
5.1 BASIS FOR AWARD
Award shall be made to the responsible Offeror whose offer, in conforming to this RFQ, provides an overall best value to the Government, technical and all other evaluation factors, and price considered. The Government reserves the right not to make an award as a result of this competition.
5.2 EVALUATION FACTORS
Technical evaluation factors (Factor A and Factor B) are of equal importance and are more important than Price (Factor C). However, between submissions that are evaluated as technically equal, price will become a major consideration in determining the best value to the Government.
• Factor A, Suitability
• Factor B, Past Performance
• Factor C, Price
5.2.1 Factor A: Suitability
Suitability encompasses the factors that contribute to the overall success of the meeting and to the meeting attendee's convenience, comfort and safety at the hotel. The suitability assessment will focus on the following:
1. Evaluation of the ability to provide the supplies/services detailed in the Statement of Work, Attachment 1, and hotel services offered.
2. Evaluation of the condition of the hotel facility (new, old, remodeled).
3. Evaluation of the condition of the meeting rooms (size and shape, obstructions such as pillars, soundproofing, security, proximity of rooms to each other).
4. Evaluation of the availability of public transportation between the hotel and the airport, accessibility to airport, and characteristics of the neighborhood in which the hotel is located.
BSEE reserves the right to perform a SITE VISIT to gather information to determine suitability.
If a SITE VISIT is determined necessary, all offerors will be equally subject to the site visit.
5.2.2 Factor B: Past Performance
The past performance evaluation will examine the extent to which the Offeror’s past performance demonstrates its capability and capacity to successfully perform the requirements of this solicitation. In assessing relevance of past performance, the Government will consider relevant contracts as those contracts that are ongoing or completed within the last three (3) years having comparable level of size, scope, and complexity to the requirements of the solicitation.
The Government will evaluate Past Performance by assessing the following:
Page 23/24
CIVIL PENALTY SUMMIT MEETING
1. Evaluation of the history of developing and delivering high quality services/products in the areas described in the RFQ (or areas similar to those described in the work statement) to large-scale organizations, especially those primarily Governmental in nature (such as State, local, or Federal Government entities).
2. Evaluation of fulfillment of contract requirements and technical excellence. This includes meeting or exceeding past contract requirements, commitment to customer satisfaction, cost control, and demonstrating business-like concern for the interest of its customers.
The Government reserves the right to obtain and utilize information from sources other than those identified by the Offeror, such as contractor past performance information that is collected and reported in the Government’s specified automated past performance information collection systems.
5.2.3 Factor C: Price
Evaluators will consider the total evaluated price for all CLINs in accordance with Attachment 3, Price Submission. The total evaluated price will be used to determine if the pricing proposed is fair and reasonable.
