SECTION 3: APPRAISAL PROBLEM IDENTIFICATION

Client: U.S. Department of Interior, Appraisal and Valuations Services Office

(AVSO)

Intended Users: AVSO and Northern Cheyenne BIA, on behalf of the United States of America

Intended Use: The intended use of the appraisal is to assist the client and intended users with approval of a negotiated sale of land.

Type of Value: Market Value

Definition of Market Value: Federal regulations prescribe the definition of market value for use in negotiating a sale of Indian trust land as:

The most probable price, as of a specified date, in cash, or in terms equivalent to cash, or in other precisely revealed terms, for which the specified property rights should sell after reasonable exposure in a competitive market under all conditions requisite to a fair sale, with the buyer and seller each acting prudently, knowledgeably, and for self-interest, and assuming that neither is under duress.

Source: The Appraisal of Real Estate Appraisal, 16th Edition, The Appraisal Institute

Effective Date: The effective date must be no later than 30 calendar days prior to the submission of the completed appraisal report, unless the AVSO review appraiser approves in advance other conditions in writing.

SECTION 4: ASSIGNMENT CONDITIONS

Confidentiality: The appraisal report and all information furnished by the BIA or AVSO to the Appraiser are to be considered confidential.

Property Inspection The contract appraiser must inspect the subject property and all comparable market data used in the appraisal, unless the AVSO review appraiser has approved other conditions in writing. Extent of inspection should be sufficient to adequately identify those characteristics which impact the estimate of fair market value. The inspection of the subject property will be coordinated with the BIA realty staff and/or landowner. The appraiser must notify, in advance, both the BIA and AVSO review appraiser when the subject property inspection will occur so they have adequate time to make travel arrangements.

Extraordinary Assumptions: None. If the appraiser determines that extraordinary assumptions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.

AVSO Statement of Work Page 3 of 7

Hypothetical Conditions:

The valuation of the subject property in fee simple title is a hypothetical condition, the use of which may affect the assignment results. This assignment has the following authorized Hypothetical Conditions:

1. The property rights for trust land held by the United States on behalf of the Indian or Tribe are assumed to be equivalent to fee simple status, although the allotment can consist of numerous fractional interests that have never been legally partitioned from the whole.

2. The allotment is not affected by Federal or Tribal laws restricting the sale of trust or restricted lands; analysis assumes the allotment could be sold and purchased on the open market without any restrictions.

3. For the purpose of analysis, the subject parcel is assumed to have similar land use restrictions (zoning) and encumbrances (property tax load) associated with the comparable sales used in my analysis.

4. For the purpose of the analysis, the subject parcel is assumed vacant and unimproved.

The Appraiser must invoke the above hypothetical conditions. If the appraiser determines that any additional hypothetical conditions are necessary, he/she must contact the AVSO Review Appraiser for prior written approval.

Jurisdictional Exceptions: None. If the appraiser determines that a jurisdictional exception is necessary, the appraiser must contact the AVSO review appraiser for prior written approval.

Pre-Work Meeting: The contract appraiser will be required to attend a pre-work meeting. The pre-work meeting will be conducted prior to the inspection of the property.

The purpose of the meeting will be to discuss this Statement of Work and the expectations of AVSO. The meeting will be held via teleconference.

The AVSO review appraiser will coordinate the date and time with the appraiser.

Appraiser Qualifications: This appraisal assignment requires a State Certified General Appraiser in good standing in the state in which the subject property is located. The Appraiser needs to be licensed or certified or hold a temporary permit in the State prior to accepting the assignment. The engaged appraiser must sign the report.

Appraisal Methodology: The Sales Comparison Approach is the only relevant valuation methodology anticipated in this assignment. The Cost, nor the Income Approach to Value is not applicable nor necessary and is not a violation of

USPAP.

Market Value Analysis: The extent of market analysis should be sufficient to accurately characterize the market for such properties including those characteristics

AVSO Statement of Work Page 4 of 7 that impact values. Recent transactions of relevant sales should be researched, confirmed, and analyzed.

Applicable Standards / Law Regulation and Policy:

The standards applicable to this appraisal assignment include:

- Uniform Standards of Professional Appraisal Practice (USPAP), 2024 edition.

The appraisal must conform to the following laws, regulations, and policies:

- Federal Regulations 25 CFR, Part 150.2

AVSO Statement of Work Page 5 of 7

SECTION 5: APPRAISAL REQUIREMENTS AND INSTRUCTIONS

The appraisal shall be an Appraisal Report, as identified by USPAP SR-2(a). See USPAP AO-28 for clarification. Additionally, the appraisal must include the following:

1. Cover Page must prominently identify the USPAP Reporting Option (Appraisal Report), as well as the Client, Property Identification, Appraisal Request Number and BIA AVIS number, Effective and Report Dates.

2. Subject and comparable property descriptions should contain enough information to allow the intended users of the appraisal to adequately visualize the relevant characteristics. (e.g., legal description, land uses, type and quality of access, improvements, source and adequacy of fencing and water supply for grazing), vegetative cover, soil types, topography, etc.). All comparable sales used should be confirmed, analyzed, and reported in similar detail and consistent fashion to the subject property.

3. The report must contain at a minimum an aerial photograph with the estimated property boundary for the subject and each of the comparable sales and a photograph from the property inspection, unless waived by (AVSO). Additional maps, surveys and plats may be included if germane to the appraisal problem. A comparable sales location map is required. The aerial photographs must not be so dated that they do not accurately represent the property as it physically existed on the date of inspection. Any unusual property features must be photographed from ground level and included in the report.

4. Ownership and History of Property (summarize analysis of the most current Title Status Report (TSR) on the property). Reconcile any significant differences in current sales and Market Value conclusion.

5. Sales Comparison Approach: The analysis must include a summary of the relevant market data in grid or tabular form; sales comparable data should be transacted in similar market conditions, and in areas appropriate for the effective date.

6. The preferred method of adjusting comparable data includes adequately supported, quantitative adjustments (%, $/acre, etc.). Qualitative adjustments (similar, inferior, or superior) are acceptable when there is insufficient data to support more specific adjustments. All comparative adjustments must be narratively supported by clear, appropriate, and credible analysis based on documented market research. The level of detail should be commensurate with the complexity of the property type and the transaction, but at a minimum, the analysis must include a discussion of relevant characteristics and how the unit price from each of the comparable sales relates to the subject. The data must be narratively reconciled into a point estimate of value.

7. The AVSO Statement of Work, pages 1 & 2 of the Contract Award, and any documents provided with the request must be attached as an addendum to the appraisal report. Reference to these documents should be provided in the body of the report.

8. Unsigned and draft reports will not be accepted.

9. When the appraiser has performed any services regarding the subject property within the prior three years, the he/she must disclose this to the AVSO review appraiser prior to engagement.

10. AVSO is the appraiser's sole client. The appraiser may not communicate assignment results to any party except AVSO, unless authorized to do so in writing by AVSO.

AVSO Statement of Work Page 6 of 7

11. If the appraiser discovers material facts which differ from those provided by AVSO or encounters circumstances which prevent the appraiser from developing an unbiased appraisal, the appraiser must contact the AVSO review appraiser for instructions.

13. Even though communication is encouraged with the property owner and BIA, only the assigned AVSO review appraiser can modify appraisal instructions (in writing).

14. Any communications between AVSO (Client) and the contract appraiser that pertain to the appraisal review (i.e., review questions, comments, concerns, etc.) are confidential. Disclosure of these communications requires the written approval of AVSO.

15. This appraisal assignment will be an engagement between the appraiser and AVSO, the appraiser’s client. The appraiser must address any questions regarding appraisal instructions and/or technical requirements for the appraisal to the AVSO review appraiser. SECTION 1: APPRAISAL PROBLEM IDENTIFICATION

Case Name / Case Number: Cheyenne River Sioux Land Exchange – Group 1

This SOW is applicable to all 26 tracts of land that are included within the attached Group 1 Tract List – See Exhibit A. The attached Group 1 Tract List provides the individual case names, case numbers, and corresponding tract numbers.

Agency or Tribe: Cheyenne River Sioux

Requested Service: 26 current market value appraisals

Narrative or form reports are acceptable. Individual appraisal reports or project reports (book and chapter) or a combination of both are acceptable.

Property Description: The 26 individual tracts being appraised in Group 1 are identified in the attached Exhibit A. The tracts are all located within Cheyenne River Reservation and range in size from 10 acres to 680 acres. The tracts are all reported to be used for grazing and while some of the tracts might be improved with residences or other improvements, no vertical improvements are to be appraised under this assignment. See following Hypothetical Condition No. 3.

Each of the individual tracts are located within a defined range unit. Maps showing the range unit boundaries and stocking rates for each of the range units will be provided to the contract appraiser at the time of the award. The stocking rates provide an indication of the overall range quality/condition, and they are updated every five years. Note that some of the tracts are fenced or partially fenced and water for grazing is either on the tract itself or on other lands within the range unit.

Legal Description: Please refer to the individual Title Status Reports for the legal description for each appraisal. These documents will be provided to the appraiser once the appraisal contract is awarded.

Ownership: The subject properties are either tribal owned or held in trust for one or more Native American landowners. Because the appraisal assumes a single trust‑held ownership by the United States, the names and fractional interests of individual beneficial owners are not relevant to the appraisal problem.

Latitude / Longitude Provided in Exhibit A (i.e., Group 1 Tract List).

Property Rights Appraised: Fee Simple Estate

AVSO Statement of Work Page 2 of 5

Outstanding Property Rights and/or Reservations:

Any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances discovered must be identified and discussed in the appraisal report in relation to their impact on value. However, Life Estates and Fee Ownership Interests listed as encumbrances in the title status report do not require additional discussion or analysis as they are undivided interests.

Unsevered mineral rights must be considered unless specifically excluded in the appraisal request.

Real Property Improvements: No structural/vertical improvements are to be appraised under this assignment.

If improvements are present on inspection, they should be briefly noted in the reports but not valued.

Personal Property: Personal property must be disregarded for purposes of the appraisal.

Client: U.S. Department of Interior, Appraisal and Valuations Services Office (AVSO)

Intended Users: AVSO and BIA, on behalf of the United States of America.

Intended Use: The appraisal report will be used by the BIA to assist in a potential land exchange.

Type of Value: Market Value

Definition of Market Value: “The most probable price, as of a specified date, in cash, or in terms equivalent to cash, or in other precisely revealed terms, for which the specified property rights should sell after reasonable exposure in a competitive market under all conditions requisite to a fair sale, with the buyer and seller each acting prudently, knowledgeably, and for self-interest, and assuming that neither is under duress.” [The Dictionary of Real Estate Appraisal, Eighth Edition, Appraisal Institute 2026]

Effective Date: The effective date must be no later than 30 calendar days prior to the submission of the completed appraisal reports, unless the AVSO review appraiser approves in advance other conditions in writing.

Applicable Standards: The standards applicable to this appraisal assignment include:

Uniform Standards of Professional Appraisal Practice (USPAP), current edition.

The appraisal shall be an Appraisal Report, as identified by USPAP SR 2-2(a).

Extraordinary Assumptions: None. If the appraiser determines that any additional extraordinary assumptions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.

Hypothetical Conditions: The following hypothetical conditions should be invoked:

1. It is a hypothetical condition that the subject tract could be sold and purchased on the open market without any restrictions associated with trust, restricted, or fractionated ownership.

2. It is a hypothetical condition, for the purpose of analysis, the subject parcel has similar land use restrictions (zoning) and property tax load associated with surrounding private property as well as the comparable sales data used in the analysis. The stocking rate for each tract would be akin to a zoning regulation, or other semi-permanent restriction.

AVSO Statement of Work Page 3 of 5

If applicable, the following hypothetical condition should also be invoked:

3. For the purpose of the analysis, the subject parcel is assumed vacant and unimproved.

Include the USPAP-required statements related to Hypothetical Conditions and Extraordinary Assumptions and their impact on assignment conclusions.

The meeting will be held via teleconference prior to the property inspections. The AVSO review appraiser will coordinate the date and time with the appraiser.

Property Inspection The engaged appraiser will inspect each of the individual tracts. Personal, on-stie inspections are preferred, however, alternative inspection methods (i.e., viewing from adjacent tracts, via a drone, or aerial images) will be allowed.

Under no circumstances will an alternative inspection method (i.e., something other than personal on-site) be justification for a limitation of scope.

Note that access to a number of the tracts will require the use of an ATV/UTV and that will be the responsibility of the contract appraiser. Once the appraiser selects the dates for property inspections, the appraiser must notify the BIA contact listed in Exhibit C so they can coordinate / notify the respective grazing permittees.

Market Analysis: A thorough and detailed determination of highest and best use, supported with adequate market analysis, is required for this assignment.

Relevant transactional data should be researched, confirmed, and analyzed.

Adequate confirmation of market data is critical to credible assignment results.

Appraisal Methodology: The Sales Comparison Approach is expected in this assignment. Development of additional approaches should be determined after analyzing the quantity and quality of market data available as well as what is typically required for valuation assignments of that type. Applicable approaches are required if they are necessary for credible results. A detailed discussion of the reasoning to omit typical approaches must be included.

Any relevant, unusual property features should be photographed from ground level and discussed in the report.

5. Sales Comparison Approach: The analysis must include a summary of the relevant market data in grid or tabular form with discussion of differences in relevant characteristics. The characteristics presented in this analysis should be relevant to the highest and best use and consistent with the market analysis developed elsewhere in the appraisal. For land with grazing highest and best use, a discussion of range quality and corresponding stocking rates would be required.

6. The AVSO Statement of Work, pages 1 & 2 of the Contract Award, and any documents provided with the appraisal request package must be attached as an addendum to the appraisal report(s). Reference to these documents should be provided in the body of the report(s).
